Does Titus and nearing lose have any connection to alzheiners? I have heard rumors about it is.
Do you know if it’s “Reviewers” or “Raters” who would constantly keep changing the way a veteran files their claim (now over 5 times for same claim)?
It’s gotten so bad, I challenged the VA back in personal statements and notifying the 3rd party QTC etc as well as VSO upon the on going crap continuing as the VA doing so keep’s resulting in denials. And I know damn well they aren’t medical personnel or doctors. When a veteran (myself) has submitted legit nexus letters, DBQs filled out by actual civilian and VA drs, and medical notes that say your conditions are service connected and fill out for specific rating and then someone at the VA denies your claim I am calling out the bs!
This week I reached out to both Congressman and Senator who is apart of Armed Forces Committee and I told them next step is contacting the White House. This is absolutely ridiculous!!!
Out of all the videos I've watched for help this one just tied everything together like when that light comes on! Thank you both!

Good info on tinnitus. When I first joined the VA suggested it. I was on the presumptive list. The examiner was more interested in my story than the presumption. Worked well.

I wish I had known about you guys before I hired a Different firm to Rep my Claims. While they got me from 0 to 60% at the Speed of Sound, the next 10% took forever plus my PACT ACT claim should have been filed before last July but it took me Filing the intent to file myself by the end of July to beat the August Deadline... It took forever to get the last 10% for documented neurological damage already diagnosed by VA Medical due to my Exposure to AFFF, JP5, Solvents, and Jet Exhaust as an AVIATION fire fighter long before the 1st Gulf War plus my Deployment to Desert Storm where I was exposed even more. I also have the diagnosis for Sinusitis and Rhinisitus and Asthma that I have been seeing the VA Primary Doc and Pulmonary Specialist at the Main VA Medical Center here in PHX. That's taking forever!!!!

Great video, awesome topic and look forward to more great content from ya'll!! I hear what you're saying about raters wanting to approve claims, but I just got a decision letter on two very simple straight forward claims. I had all my evidence, great personal statements and buddy letters, and what I thought was a good C&P exam. The rater made several obvious errors, ignored my personal statements and medical history and the C&P doctor made several DBQ and medical opinion mistakes. She said some very dumb things, like, "his OSA could not have been caused by his knee problems because he breathes through his throat and his knees are not in his throat". I am not kidding, a licensed physician actually said that! I did get a small increase and am now in the appeal pipeline waiting for a higher-level review. I'm at 30 but should have gotten to 80-90 percent on this claim. The RVSRs and C&P examiners are idiots and don't take the time to do a good job.
Hi there. First of all, thank you for being here and tuning in. I am so extremely sorry about this situation. Unfortunately it does not surprise us. Sometimes, the VA just flat out gets it wrong. There is plenty of human error in the VA claim process. Your VA Decision Letter is the roadmap we need to see why they made that decision. It tells us how to keep fighting.

Regarding Tinnitus, if you worked on or near a flight line would help very much, for your claim.
My VA shrink has blown off my last three appointments. Th elast time I did speak with her she told me that because i haven't applied to any assisted living facilities or Section 8 housing in Missoula, she saw no point in talking to me. I wanted a shrink to deal with decades old PTSD issues and the psychology of terminal prostate cancer. SO, I am trying to get my Primary Care guy get me a shrink thru the Care in the COmmunity program.

As for Tinnitus, you HAVE TO write an honest personal statement YOURSELF explaining your symptoms and how, when and why they started and how they affect you (Brian and the VA Claims Insider has a great outline for this). DO NOT allow your Veterans Service Officer (VSO) write your statement. I know a Dental Assistant who wrote his own statement and got 10% while a USAF Pilot had the VSO write it and got ZERO.

Yes! This is the biggest reason for rejections on tinnitus. Go into VA,GOV, and upload your compelling lay statement. Use this as a model: "Prior to my EOD in 2008, I had no symptoms of tinnitus whatsoever. However, during Basic Trg, in May 2008, I was subject to at least 12 occasions at the M-4, M-60, and hand grenade range and received noise exposure resulting in prolonged ear ringing. In July, at Ft. Bragg, i worked 12 months on the flight line, where I was exposed to jet ,rotary, and propeller aircraft noise at least 8 hrs per day at extremely loud volumes. As a result, I now suffer tinnitus, which has severely impacted my work life, as sitting at a desk, in an office, quietly is almost impossible. I have been passed over in carer advancement at least 3 times. Secondly, I can no longer attend church, as the silence is excruciating, which has disrupted my family and spiritual life. Lastly, this has led to severe insomnia, since even with a white noise machine, I am unable to truly sleep for length of time. This has caused me to feel social isolation and distancing from spouse and family." Advice: always use lots of dates when it happened, number of months/years, give specfic equipment or bases where damage occurred, and especially give specific life impacts.
I reopened my VA disability claim on 9/1/2023. It took the VA eight months to settle it. I went from 40 percent to 60 percent. My biggest problem is my right ankle with limited movements because of the fusion in my ankle plus degenerative arthritis. It's getting worse everyday I can't stand for long time and hard time walking. However my ankle claim remained the same at 40 percent. But I got 10 percent for tinnitus.
The VA disability process is never over unless you quit. You can apply as many times as you’d like. Maybe your conditions have worsened, so you want to file for an increase. Perhaps you realize you’re eligible for a secondary service connection and want to file a secondary claim. DO IT! We’re here to empower and educate you throughout the process.
Ill retire in 351 days and it literally ups my anxiety just worrying if im gonna get screwed out of a deserved rating just like iv been getting screwed my entire career.

A big mistake (yes- I made it) is to ASSUME the VA rater is going to act in your best behalf to begin with. Let me clarify: You cannot just take your medical record with you - or assume "they" will decipher it for you. You MUST exercise SIGNIFICANT due diligence and get a nexus letter beforehand. So: Take all of your ailments and make a list. Learn about secondary indicators (insomnia, anxiety, depression, migraines), etc for tinnitus, knee problems, secondary to foot problems, for EVERY ailment. Make an appointment with your primary care provider and share. Get referrals to everything. If your VA or private specialist fails to tell you what you want to hear, GET A SECOND OPINION from a private doctor (Community Care). Do ALL of this even before applying for disability compensation. THEY will NOT give you any clarifying advice unless you ASK. Nuff said...

When submitting a nexus letter, for mental health, along with a FDC and the VA refuses to use that documentation, what is wrong with the nexus letter and why would they not use that while decideing a claim? Any way to file so they'd use the IMO? Thanks.

I filed my pact act claim on the 14th online and the 16th online it says decision made closed? Unsure how long it takes to show rating online but still have the current rating percent prior to claim. Does it sound like denies or does it take a month or so to reflect? Just curious and Thank you!

True about Vietnam vets. The laws have changed a lot since then, so they definitely need to file again if their history supports it.

I submitted a claim for GERD secondary to Crohn’s. Claim was approved. GERD was added to Crohn’s at current 30%. Per 38 car 3.155, 38 car 3.400

I hear the single claims usually work through system faster. I’m curious are single claims earmarked or tabbed somehow in the system.
While each condition that a veteran chooses to file for can be claimed individually, it is often advantageous to file all claims together, particularly if they involve related issues.
I have a claim that to me seems straight forward. I have a service related rating for a neck injury. I had 2 civilian Doctors provide nexus letters stating that my lower back issues were caused by or aggravated by my service connected neck injury. The VA came back with true but "Not Service connected". I am now in the Higher Level Review process, moved to Higher Level Review in Jun. All I can say is I do blame the rater along with the C&P Doctor who knew nothing except what my PC Doctors provided. I know you said the motto was Approve if you can, Deny if you must, but I have to agree with the majority that it is still "Deny till they Die". I am a Retired Marine GySgt currently at 90%. Im concerned if I ask for assistance in getting this pushed through that the VA will screw with my Service connected issues and lower me. Im stuck in the waiting game. On my Higher Level Review I did request the rater contact me but I have not heard anything yet. Again I feel it is a case of Deny till they Die then Problem solved.
The VA does not intentionally deny claims. They’re following laws and regulations when reviewing your VA disability claim. With that being said: Sometimes, the VA just flat out gets it wrong. There is plenty of human error in the VA claim process, and also ,unfortunately, bad C&P examiners in some cases. We hope you get awarded the benefits and compensation you deserve! The VA as the NAME. Does not deny claims. But I could almost guarantee that the VA says from the Gov. says don’t approve. I know people I served with were admin and intel that got 100%, never saw combat sat in a chair and pretty much did nothing.
@@mikeotis5316 Mike, There are plenty of non-combat related service injuries. That is the nature of the beast. They had to prove their case just like everyone else. Ive seen this from both sides so you cant make it about MOS or about Combat / Non-Combat. The VA treats us all the same and we all think the system is sorely broken. Bottom line is we all get the big green one from the VA at some point.
It’s easy to blame the Rater. But the real issue is we can only work with the results of the exam. So if the examiner provides a negative opinion, that is more than likely going to be the decision the majority of the time unless we have the ability to grant based on presumption, as an example.
@@kellyjohnson3937 Thanks for the comment. It seems to me that the raters are "Developing to Deny". Why else whould they go back to the Dr a 2nd time for an opinion unless they were looking for a reason to Deny when they already have multiple Dr's saying it was related.
Hello, I have a question that's kind of off-topic but I want to ask you anyway because you have a good handle on VA administrative procedure. Does a VA Primary Care Manager automatically pass the results of routine examinations (example: Results of an MRI taken in conjunction with treatment for back pain) to the Compensation/Pension section and possibly trigger a reexamination of an existing disability? Or, does the Compensation/Pension section only get involved and order a reexamination of an existing disability when a veteran files a claim to get an increase on that existing disability? For further context, let's say that the veteran is currently 58 years old and all of his disabilities were deemed static when he retired. Asking for a friend. Thanks.

Any idea as to why the VA claims that Peripheral Neuropathy was "Presumed" by Agent Orange with the Pact Act yet denied because I didn't apply within One Year from leaving service? I didn't find out that I had this until 50 years after leaving Viet Nam. This makes no sense to me. The TV ads sound like it is on the list yet it isn't unless you know 50 years in advance.

We planned to file smaller claims but we had a claim in the system with C&Ps done but had to file the Gulf War presumptive before the deadline and they combined them claims. Does the VA give a response to all of them at once or can they approve/deny the systems/problems as they have the information for?

I have a presumptive condition of throat , prostate and Lymphoma cancers from serving in Gulf War. I am 100% service connected and I have plenty of medical documentation. However they did not permanently disable me and indicated I can be reviewed again at some point although I cannot be cured of the Lymphoma. Do I have to worry about my disability pension being lowered or taken from me. Additionally I have several other conditions and permanent side effects from my treatment. Should I file additional claims or just save my documentation for when I am reevaluated.

Hello. When I got out of the military in '96 I didn't get service connected for my knees, but I was diagnosed with arthritis after having a knee injury. I recently received 90% for my back, hip and migraines. Now that my knee pain and plantar fasciitis are worse, and were both diagnosed in service, do I still need to get my own Nexus Letter?
Here’s a simple litmus test to determine if you should get a Nexus Letter for your VA disability compensation claim:
If your disability was diagnosed during service, and it’s in your military medical records (Service Treatment Records), you probably do not need a Nexus Letter. Why? Because you have medical evidence that the disability existed during your military service.
If your disability was not diagnosed during service or if there are no documented symptoms in your military medical records, you probably do need a Nexus Letter. Why? Because you don’t have medical evidence that the disability existed during service.
If you’re attempting to service connect a previously denied VA claim or trying to file for secondary service connection, a Nexus Letter is highly recommended. Why? Because you need a powerful argument to overcome a previous VA claim denial. In addition, secondary service connection requires Medical Nexus Evidence that your new disability is “proximately due to” or “aggravated by” a current service-connected disability.

You need to do a video for those vets suffering from PTSD who fear the loss of their weapons if someday they come for them from vets who have PTSD!! Do a video on what the odds are that can happen. There’s are MILLIONS WHO HAVE PTSD who will NOT report IT!!!
Hi there! Your VA rating for mental health, including PTSD, has nothing to do with your guns. By law, the VA can not take away your guns. It would be an unlawful seizure without a warrant. However, while the VA does not have the authority to take away your guns or impose any other limitations based on ratings, VA ratings can potentially impact other aspects of a Veteran’s life, and I encourage you to consider your own individual circumstances.
If you contact your last Military Hospital you were assigned. They may be able to pull all of your Medical Records. I had been retired since 1996 and had been using the Naval Hospital in Jacksonville Florida 2005 to 2021. In February, I asked them to pull my records. To my surprise they somehow pulled almost of my medical records dating back to 1974 when I entered onto active duty. I couldn't believe it. Try contacting your last duty station Medical Command Records Office. They may be able to help you.

what are your thoughts on pact act claim if you are currently 100% P&T ?
100% P&T is the maximum amount of compensation and benefits you can receive. Unless you are suffering from a life threatening disability we advise against opening up your rating for reevaluation.
I have tinnitus in both ears anxiety disorder and cancer I filed my claim in 2008 hard to believe me I know it is but the va administration says my records burnt up in the records building in St. Louis
As of right now I don't think anyone at all from the va administration is trying to help me

Law on The books says that 30% 'Max' is The Percentage of A Veterans 'Retro' or 'Back Dated' benefits if awarded? that any Lawyer firm whatever can retain in a case..Does this apply to VaClaimsInsider?
We never take any back pay! We charge if you win your claim and get an increase in your VA compensation. The amount due to us at the end is a straight 6X your monthly increase, owed once. You can also take advantage of a 10% discount if you choose to pay a lump sum.

If I have an initial diagnosis of General Anxiety Disorder from a Licensed Clinical Social Worker and not a Psychiatrist, it that going to be enough to get a rating?
That doctor needs to fill out a Nexus/DBQ for you.
Thanks, but my concern is an initial diagnosis from a LCSW does not count, it has to be from a doctor that went to medical school. What if I submit the claim for Anxiety and it was only diagnose by a LCSW? Is that a denial right away or will they send me to C&P and then grant it?@@vividhaiku
Although any civilian provider can complete a Public DBQ, it’s often best to have a physician complete a DBQ. The VA holds a higher view of DBQs filled out by physicians.
Also, even if you submit a Disability Benefits Questionnaire as evidence prior to your C&P exam, your examiner will still complete one at your exam.

You guys said when a claim is denied, the rater oft times wishes they could tell the Vet what he needs to get his claim approved, but they can't. BUT isn't it the VA's "duty to assist" the Vet? The way I read it way back when, was that if a claim is denied, it is the VA's duty to tell the Vet exactly why it was denied and exactly what is needed/lacking to get the claim approved. Is this wrong? Thanks!
The road map to getting your VA claim approved is your final decision letter, that is what will ultimately tell you what you need to do in order to get the rating you deserve!
My husband passed in 2-2022 and he filed for agent orange on Guam in 2013. They denied and then lpassed the pact act in 8-2022, and I get DIC can I get the back pay now.

What does it mean when the VA says my increase claim and initial PTSD claim is up for the second stage of final review. My claim has been in for 2 months, I have not had any C&Ps for either the increases or the initial PTSD claim. Is this a good sign or a bad sign?
C&P exams are only necessary when the VA needs more information to determine the extent of your disability, the connection between your service and disability, or the value of your compensation.

I have nerve damage for my left foot that is 10% and put in for the first time for hip and back and I walk with the cane and still got denied. Hi Susie! There are three options if the VA previously denied your claim. You can file a Higher Level Review (HLR) or a Supplemental Claim. If those get denied, you can file a records-only Board Appeal or request a video teleconference with a BVA judge. There is always another path, but you must stay in it and never quit!

I was in a vehicle accident on duty in 1974 and screwed up my neck. Team leader kind of did that "Only pussies go to sick call, it'll be fine in a few days" I have MRI evidence of the problem but will in need to find a record of the accident. It is not in my service record. I don't recall who all in that van was injured much less their names.

There is one thing your wrong about. When you file, and every contention is from one event, such as an IED, that info is all going to be on the same pages. The VSR is going to be reading them anyways. So in a claim like that, list all of the contentions from that event together. What you want to do in such a claim is explain as clearly as possible how they are interconnected. Make it clear its from one event. Quote the date and Doctor who entered the even into your medical history. Help them search your record faster. In such claims, you are more likely to get a 100% rating the first time.

In order to get a VA rating for PTSD and Depression, you need to have (1) A medical diagnosis of both conditions with a separate diagnosis for each, (2) A clear Nexus to prove service connection for PTSD and Depression, and (3) Current symptoms of the mental health conditions.
Generally, a veteran will get rated for only ONE mental health condition.
The reason why veterans will only have one mental health condition with a rating is due to a legal concept called “pyramiding.”
Thus, it’s unlikely for a veteran to have a VA rating for PTSD AND Depression, however, it is still possible as explained here >

I totally disagree about the VA not deliberately denying people, the first time. I know of people who had in service records, along with a current diagnosis and was still denied.
Sometimes, the VA just flat out gets it wrong. There is plenty of human error in the VA claim process. Your VA Decision Letter is the roadmap we need to see why they made that decision. It tells us how to keep fighting.

Although any civilian provider can complete a Public DBQ, it’s often best to have a physician complete a DBQ. The VA holds a higher view of DBQs filled out by physicians.
Also, even if you submit a Disability Benefits Questionnaire as evidence prior to your C&P exam, your examiner will still complete one at your exam.

There are claims that are totally bogus. They were not even in the right region/base/whatever, and are still submitting claims. Which still need to be processed by the VSR. Which in turn wastes thousands of man hours showing a claim is false, which slows down how fast valid claims get processed. So the fakers need to stop. They are a huge factor in slowing down legit processing.
