It Just Got EASIER to Get a 50 Percent VA Rating for Migraine Headaches!

  • On September 14, 2023, the VBA updated M21-1 to clarify a prostrating migraine headache, including the new VA rating for migraine headaches criteria and evidence requirements.
    Headaches are still rated from 0% to 50% with breaks at 10% and 30%; however, the symptoms and impairment required for a 50% VA rating for Migraines have been better defined and clarified.
    The VA will look for a medical diagnosis of headaches (in a medical record) along with any link or connection to your military service to include the frequency, severity, and duration of symptoms.
    VA disability ratings for Migraines depend primarily on the frequency of attacks and the degree to which symptoms are “prostrating.”
    Work impairment due to your headaches is also a factor for a 50% VA rating for headaches.

    I recently was upgraded from 0% to 50% for migraines. It did take an appeal, and a second exam, so hang in there! My local VSO is incredible, and just kept me in the fight. The video is right about the word "prostrating" and I was advised the same (and mine definitely are). Just remember, the longer it takes, the more back pay they owe you!!

      @@Kas873 I just had my rather quick migraine C&P exam with QTC this afternoon, and when I mentioned "prostrating”, the examiner got all bent out of shape at me and said you are not the one to use the word "prostrating”, she said she would make that determination after reviewing the evidence and me answering her questions. So when she said we were done and I could leave her office I asked her if my migraines were "prostrating” based on her exam, and she told me she did NOT give out any information, that I would have to wait for a letter from the VA? She was very rude to me throughout the entire exam, and many times told me to stop talking, and only answer her specific question, I tried to show her my personal statement, migraine logs, and other info I had brought with me, and she refused to look at anything. I was the last person for the day, and she was rusing me, so she could get out of there.
      It's a shame they bill the VA thousands of dollars for these C&P exams that affect us veterans and our lives, and they don't really give a dam, they are only in it for the money. It's sad that I am a 75-year-old Vietnam vet and have waited 54 years to file for VA disability and have never been to the VA for any care.
      This is my 3rd C&P exam with QTC in the last month, and all three examiners were rude and rushed me through the process, not one showed any interest or concern for this 75-year-old Vietnam vet who served 16 months in Vietnam proudly in 1969. I really want to file a complaint about all 3 C&P exams.

    Over 2 years of migraine logs, military medical records incidents, and a C&P examiner that even said it was one of the strongest cases he had seen and yet only 30%. Unfortunately, the raters don't always go by they own system. But great video and content.

    I see many "migraine" videos on TH-cam but very few focus on other headaches like "tension" or "cervicogenic". I know they are rated the same. Glad you mentioned a few other headaches but would love to see video/s devoted to other headaches. Thanks

      All headaches are rated with the same criteria. you have to have a current diagnosis of headaches , you need to document severity using va criteria, you have to show how it is service connected, either during service diagnosis or secondary to other service connected conditions. you can do it this yourself without paying someone else. Take the time to learn what is needed. You can do it!

    I am 70% ptsd. Totally debilitating migraines 3-4 times a month. Claim denied due to no continuity. Positive presumed eligible because records show I was treated for migraines in service

      So show continuity. Gather all your records… missing some? Write a personal statement and use a buddy statement. Get another doctor today “he’s had continuous migraines.”

    I only got one Neurologist to document "prostrating" headaches in my medical records. The Headache specialist would not use the word specifically. She's been excellent at everything else, even getting me accommodations for school* but she will not specifically use that word in her documentation. She actually told me "I know it's important for your Service Connection but medically I cannot use that term."

    This is what I did two months ago. I sent them a list of all my migraines since Jan 1 to May 1 along with length of time and that I had to lay down in a dark room with a cold towel on my forehead. So far no C/P exam just waiting on a result. I filled under secondary to high blood pressure.

      I logged all of mine in an app called Migraine Buddy and then printed out a log of 3 years worth and gave it to them.

      Remember, not every claim requires a C&P exam if the rater feels they have enough medical evidence to make a decision.

    Applied for migraines in 2021. History of them dating back to Iraq, showed continuous treatment, had a migraine log spanning over several months, denied. Been sitting since 2021 waiting for it to be sent to a veterans law Judge.

      You have to read why it’s denied. No nexus? Get a nexus statement from a doctor. No diagnosis? Have your doctor formally diagnose you.
      You need 1. Diagnosis 2. Nexus and 3. How it affects your employment/social life for a percent

      Diagnosis from doctor, documentation from doctors in Iraq in 08, proof via myhealthevet, VA, and PCP showing continued complaints, treatment etc, proof of missed work, months and months of Migraine Buddy logs, C&P states they agree I have migraines, denied it due to "no proof of continued care".

    I was granted 60 percent on one rating and 10 percent on another. But my combined rating is only 60 percent. Is this right? Also, the VA is withholding my benefits. Can i get normal military retirement and my va benefits at the same time. i ask others this in hopes of getting an answer. I may have to check with a VSO as well.

    So they gave me a 30% rating For my migraines.the Doctor say that they were prostrating. I had letters from my boss where I missed work. I gave a log I had a Nexus letter from the doctors everything should have pointed towards a 50% rating. But for some reason I got 30% What can I do about that?

      Look at criteria for 50% migraine on the VA website 38cfr ratings criteria. Do you have enough headaches per month to rate 50%.? If you file a Higher level review within one year, you should be rated properly.

      @westbows yes I was having 4/5 a month until treatment now I have 2/3 per month. Clearly 50% should have been given. My boss even sent a personal statement that had missed work because it headaches before. And I was becoming an issue

    I just got approved for 80 percent va disability but dont have a regular doctor that i see. Who should i get a nexus letter from about migraines? Would any dr suffice ? What are your recommendations on who i should get to diagnose me? Any advice is greatly appreciated 🙏 thank you!!!

    I got 0% for headaches so does that mean i at least have a rating? Now i just need to work on gerting a real rating. Cant tell you how many timesive had to lay down or leave work because of migraines.

      Why were you denied. You need to figure out why you were denied and then correct that.

    I wish that your staff had spent the time explaining all of this in detail. I used your services including a telemedica nexus. The nexus stated 3 or more per month secondary to tinnitus and mental health. Nexus stated 3 or more per month, loss work isolation, 1.5 years of primary doctors notes stating the same, C&P telephone interview stated the same, yet I was rated at 0% service connected. After the denial my coach asked if we submitted a personal statement as well, the answer was no because I was never urged too. Submitted a supplemental including personal statement 4 months ago, and no decision by the VA. With the charges that you have your coaches should ensure that any information which could help your claim and is truthful is submitted.
    I am also concerned that the recent legal action and VA notifications regarding your services could now be hurting your claim chances when Telemedica is involved in the nexus.

      Thank you for sharing your experience. We're truly sorry to hear about the difficulties you've faced and appreciate your feedback. We understand how frustrating it can be when expectations are not met, especially regarding your VA claim decision.
      It looks like the Telemedica provider connected some of your medical conditions as well. You can contact Telemedica at 512-883-8446 and ask about their rebuttal letter service which ma be benefical for your claim.
      It seems like there was a misunderstanding about the importance of a personal statement in supporting your claim. While our coaches should indeed highlight the necessity of all supporting documents, we regret that this wasn't communicated clearly in your case. We are addressing this internally to prevent such oversights in the future. We understand the frustration with the VA's timeline for decisions. Unfortunately, while we aim to provide all necessary support and documentation, the final decision and processing times rest with the VA.
      We respectfully disagree with the lawsuit, please rest-assured that documents from Telemedica will strengthen your claim.

      do you have a current diagnosis for migraines? direct connection? secondary to PTSD? How frequent do you have migraines ?, How severe?. What was the reason for denial? do your own research learn Va criteria for you conditions . You can do it yourself.
