In a HLR (Duty to Assist Error Correction) battle right now for Migraines, Secondary for Mental Health. I have a diagnosis, I have submitted a written tracker over the course of 3 months, printed out Time and Attendance tracker for how much work I have missed due to the Migraines BUT my VSO advised not to get a Nexus Letter until they come back with a decision on the correction. I was skeptical about this for several reasons but hopefully in a few months they come back with good news. Thanks for this video; great info.

what did you decision letter say for the reason?
I did everything the VA Claims Insider recommended. I had my CMP examination September 14, 2023. During my CMP exam, a hired contractor doctor didn't even ask me how many times I had to lie down monthly. Guess what, guys, if the doctor doesn't ask the right questions. Fellow VETS, you're screwed if the doctor doesn't ask you the right questions.

I had my migraine C&P exam around the same date, I had what appeared to be a really good examiner she asked a lot of questions pertaining to my headaches etc. she basically said it’s definitely connected from my severe PTSD, read her findings a couple weeks later, she wrote a good nexus. I have not received an answer or results not sure how long this will take I anticipated I would have and answer within a few weeks of the exam. I been waiting on a BVA hearing for almost 2 years for another claim regarding PTSD I sure hope the migraine answer or results takes as long as the BVA hearing as been taking.
No! You CAN AND SHOULD report a bad C&P exam to the VA immediately by calling 1-800-827-1000 and reporting it to the company that the C&P examiner works for (check your C&P exam paperwork). My C&P was done over the phone. I told the doctor I have 2 to 3 episodes per month and sporadic headaches that are not as strong as a migraine. I just found out, thanks to your advice, that he wrote I only get migraines once every two months and got 10%. This was last year.
My C&P exam was Sept 6 and the decision came in the mail unexpectedly on Sept 29th. Keep an eye out. I'm in the VA region for Reno, NV. which shouldn't matter due to the adjudicators not being in Reno, (yeah it's a John Wick thing lol but a real VA job title). : )
Hang in there man I was in the same boat for tinnitus and back pain. 3 to four months of nothing and I had already lost hope. Last week I got rated at 50% and was completely shocked.
I have a 30% rating for migranes. Im on .my back 3 to 5 times a month. I recorded everything for 6 months. I was first denied completely. I was retired. Self employed had testimonials from 3 employees, my wife and 2 other family members. They told me that those don't count because they are to close to me. I appealed. Took 1 year to seea judge And a year later they gave me 30%. This was 16 years ago. Itcontinues to this day. 9 migrane pill a month from VA sence then and I use every one of them. How do you get 50%? I gave up. The process will break anyone.

I have migraines diagnosed in service - C&P examiner said that should be open and shut as it was diagnosed in service - SURPRISE, the VA comes back saying NOT service connected 🙄, same issue with tinnitus, it was deemed not service connected even though I have a documented exposure to loud noises from working on the flightline...It's like the person who got my case didn't even read it, just stamped it "not service connected"! No wonder so many vets give up fighting with the VA, they're impossible to deal with, and it all comes down to who's desk your case comes across, considering I have ALL of my service medical records!

Mine are so severe I have the VA giving me botox and Zolmitriptan. I didn't submit a tracker, but I did have a VA neurologist add an addendum that other PTSD symptoms trigger it. The severity thing might be an issue as I haven't reported them as much as before botox. I have A LOT of it noted in my chart over the last decade, but I don't think anyone will read all of that. The QTC guy didn't ask about symptoms or severity. So it was likely designed to deny my claim. I have absolutely no expectations about them accepting it. Getting a 0% in itself would be a fucking miracle.

@VAClaimsInsider They're accepting migraine claims easily. I can't prove they were caused by combat si the VA thinks they aren't real. Filing is a waste of time.
I had my Tdiu Qtc/Cp exam lastweek, i was in my appointment for 5mins. Before walk in appt i filled out 5 questions about my migranes. And while in appointment the Dr ask 3 questions and was done.
But i think it was good appointment but i wont hold my breathe. Praying for good outcome, time is hard now and not working pass 4 months after being laid off. Was employed for 2 years

I got all my secondaries (migraines & GERD) connected with out any sort of Nexus letter. I submitted a Dx, Symptoms, and 3-4 peer reviewed medical journal articles showing that there is evidence that the meds I took for a primary service connected condition was causing these secondaries.

It's just a shame how many people or companies are charging Vets thousands of dollars for Nexus letters. Most are just flat out unreasonable and damn near criminal. It's bad enough the system isn't built to help us, then we have to deal with people that only see profit in our pain. The system is paid to not pay us benefits we earned and deserved for giving up our bodies, then these companies charge us to again for the pain in our bodies to get what we deserve. This crap is so scandalous. I appreciate the information and the first company that comes up with a flat really reasonable price will put all the others out of business.

I was smart enough to be a doctor but i found a niche where I could work 4 days a week as a nurse with accomodations. So I found a pretty lucky niche but I could have been much more but for my disabilities

Turned in all the evidence needed from my neurologist. VA gave me 30%, I HLR it and explained that the number 10 was higher than the number 3. Got the 50% after that

Are headaches/migraines presumptive for gulf war? I have had migraines since before I got out in 2006, saw neurology in 2009, but never filed a claim. Not sure what to do.

They told me that I got 0 for less frequent attacks so I’m going to apply for an increase with a log and letters from 2 supervisers and wife I had a kneck injury and I have been dignosed with tbi
I have sleep apena, use cpap. I wake up every morning already prostrate with pounding headaches.

@@christinesantelli3828Refer to your military medical record for any Dr. notes stating "morning headaches." I have Sleep Apnea & Migraines & it was in my medical record that suffered from morning migraines.
I’m speaking from personal experience here. Peer reviewed articles can serve as nexus evidence in some cases, you don’t necessarily NEED a nexus letter to link secondary conditions if it’s already been proven a thousand times.

What does it mean when it says updated September 20th in my claim? No write up stating what changed.
They just updated your claim status. The only thing to do is wait for a decision!
Exedrin (generic equate at Walgreens)works best Migraine. Prevention and control. Works better than any RXs I ever used. My mom sent me bottles every month while I was deployed.

Me too. I'm having my cervical c3-c6 nerves 'burned' on Oct 12th(LOD injury in 2011). VA said my migraines are from my neck-cervicogenic headaches that mirror migraines. I'll refile in a few months with my fingers crossed.

@@willmills1370 My neck is already service connected. Headaches can be secondary to a few different things. Tinnitus, ptsd, neck injuries or a combo of all! Looks as if my PTSD appt went favorably. Hope the rest does too, I will keep ya updated when I hear something. Oh, I have done the Rf ablations for many years, it does hlp!
I got 50% traumatic migraines connected due to c2-3 c3-4 herniations causing the headaches . There is literature on this. The cp exam rater even wrote this on my report. I also take methodone , amitriptiline for my back and neck injuries and it helps with my headaches and migraines.

I need some advice.. I was told because I’m already 70% connected to PTSD to not file secondary for my migraines because my rating will not go up. My overall VA Benefits is at 93%, I’m so close to 100, but I’m needing some advice because I do NOT want to shoot myself in the foot. Any advice?

That’s wrong. I was a cook and got rated for it.
Tylenol does nothing for me. I use sumatriptan, rizatriptan, eletriptan, amitriptoline emgality shot and zonisimide… and now ubrelvy. I am completely prostrate 3-4 times per week for several hours at a time and they rated me at 30%.

I've tried several headache trackers and they are all crummy and I deleted them. I then just now tried the free migraine tracker and it wanted $199.00 for lifetime membership and jumped to a different screen when I didn't want to purchase it. I then deleted the app out of concern and lack of trust in their process. I'll just use a frickin' notebook!

I used Migraine Buddy and gathered a few months of logs. The VA accepted it, and I moved my rating from 0% to 50% in just a few weeks (from claim submission to decision).

@@alphadelta87 I crossed my T's and dotted all my I's . Did it all, I mean that. I died last on Sept 29 when I found out I got a 0% rating. So... what did you do differently to get to 50%? I meet all the guidelines for 50%. I meet up with my Coach on Oct 22nd to discuss strategy etc. Thx for a reply
What do you do when they keep deny your claim? And you've been a victim of Agent Orange splashing. I have been ordered to swim in crude oil for 5 hours. Clean up torpedoes, so they deny any of this, there was a lot of detail tasks they should've done with mechanical stuff. But being so first class, it was in charge of me. Had a short man's disease. I got punished all the time.

Will my C & P exam be a nexus letter to the VA if they say yes this is happening because of this?

The more evidence you submit, the stronger your claim is.

@@team541rocksout I did just that and more, with a Nexus and two MD diagnosis and still got a 0%, but moving on with a different strategy after my neck/nerve procedure. VA is the scrooge.
I had migraines for forty years. From when I broke my neck in 78 until 2018 when the I had the last neck surgery. National VA yes it was service connected with Zero Percent. Blinding pain at least three days a week. Longest one lasted 18 days. Laying in bed except to get up and throw up. Forty years and nothing. Blinding 100% debilitating unable to do anything! Can I go back and get the increase for the 21 years of migraines?

I'm rated 50% for migraines and my doctor gave me a blood pressure machine that sends a message back to them and you can write about your migraines on your phone and it will be recorded back to your doctor.

Not sure if you still need advice on this topic. Basically what I did was keep records of my migraines on the Migraine Buddy app. The smart way I believe is to submit a. VA Intent to File a Claim. That way the time clock starts for any back pay if you get rated for migraines. Keep records going for 6-12 months for evidence. I went for the entire 12 months and submitted a fully developed claim. But my migraines are secondary rated to another disability. I won 30% off the bat. I had a Nexus letter from a private doctor. I have however been missing more work this past year so I am going for an increase next to hopefully get to 50%! Hope this helps someone 😊

I filed mid 90s for chronic headaches and am Tera conceded, denied my claim back then. Filed a supplemental, have a C&P exam scheduled. I’ll report back, but VSO stated they are under PACT Act….
My migraines are in the front right side and I vomit and have to prostrate and lay on my back in a room blacked out . Anyone going to c &p exam

My rating is already 100% for a Head injury contusion of my chest but didn't get ratings for my Migraines and massive Gerd! Can I get my rating higher?
Hi there! 100% is the highest rating you can get and the maximum amount of benefits and compensation awarded. We advise against opening up your rating for reevaluation.
Question if anyone can answer about getting 50% ... To get 50% you need to show severe economic adaptability. One way you do this is to get a list of sick time taken from your employer. My question is, what if you are self employed? I have lost lots of work due to my migraines but have "proof" of that. How would that work for someone like me?

@@fyop1987I didn't need to show a list of sick days, I just explained to the C&P examiner that "I have had to take sick days, and even had to leave during work, because the headaches were debilitating".
Migraine Buddy logs is all I submitted for evidence to show frequency of episodes.

@@fyop1987 Logs are sufficient enough evidence. Anything beyond that would be icing on the cake (letters from supervisor, co-workers, spouse, etc)

@@6mallards Same, I was at 60% for so many years. Scared to file for an increase or more claims. I pulled the Kimber 1911 trigger 2 years ago and I'm at 90% and one day I'll be at 100% bc I'm not giving up.

I have 30% now for headaches and they're worse than they were. Can I get a secondary claim for bruxism for that or my sleep apnea? I grind bad. Dentist says worse he has seen. I have 3 implant or I couldn't chew my food. I have split my teeth down the middle to the roots. Already have a 30% for depression it's much worse now. Third place I have been moved at work this year. I can't remember all the steps to complete my jobs.

I was rated 0% when I EAS'd in 2010. I filed a few years ago for an increase when I learned about using the Migraine Buddy app. Logged about 3 months worth.
Submitted for an increase, included my log file. The C&P exam was over the phone. Explained my debilitating episodes at work, and the frequency of migraines (referencing my log file I uploaded). My claim was decided in under a month from when I submitted for an increase to decision letter. Fastest I've ever seen a claim get decided.

My doctor wouldn't sign onto a nexus letter. I can see why so many vets just give up.
I had a letter and two seperat test for hearing loss and tinnitus because I worked flight line. VA denied, no service connection.. FML

Ive had an Appeal for just over a year now for migraines. Am at 30% and on sumatriptan and acetaminophen, both from the VA.
Dont know why my representative didnt do a HLR, he just went for an appeal. Ive heard it takes years. =/
How do you like the sumatriptan? I'm on that too, haven't filed for migraines yet though. Why do you think you got 30%?
@@Maab32 I got the dosage increased to 100mg, usually ease up the intensity but I still have headaches, pounding on my temples. Been getting heartburn, but I got 2 other new mental health meds. So, who knows.
I think the 30% was for my frequency, the fact that I had to lay down, strap a bandana around my head, soft music, breathing exercises and I already was on meds and had a diagnosis from the VA, been seeing the VA Neurologist, got a MRI that showed white spots in my brain, common for migraine patients... was also deployed to the middle east. Guess all that got me the 30%
Funny, the doctor at my C&P NEVER asked me about if migraines interfere with working. He just marked "Yes", he can work. ....Im unemployed
My appeal was filed in June and approved in August. Not sure why yours is taking that long.

Not entirely true. My claim for migraines has been denied even though I had a DBQ and a Nexus letter stating that due to the Tinnitus I am having migraines and I was treated for them in service. My neurologist stated that the tinnitus was the cause of the migraines. My VSO commented that my claim was very well put together and there should not be any problem getting 50%. The ACE examiner in there DBQ stated that tinnitus caused migraines were purely speculation and gave me a bad DBQ and now my claim has been denied. I miss time from work and have to pay for the medication to treat my migraines. So a DBQ and Nexus letter from a private doctor or anybody else does not guaranty a winning claim. The VA raters WILL ALWAYS TAKE THE WORD OF DBQ EXAMIER THAT THEY VA PAY's FOR PLAIN AND SIMPLE regardless of the evidence that is submitted with your claim
Thank you for sharing your experience! It is true that these cannot guarantee a win, but they improve your chances infinitely by providing irrefutable evidence. With that being said, the VA can make mistakes, there is human error in the rating process. If you don't believe you got the rating you legally deserve, I'd encourage you to keep trying and challenge that decision or file again! Don't give up.
This same thing happened to me, dbq and nexus, horrible migraines due to tinnitus and I was just denied. So sick and tired of dealing with the va.
Did you submit a log or journal of your migraines too? They have to see records of the frequency, duration & severity of the migraines. I had a nexus letter and a bad C&P exam. Examiner said the migraines were commonly known to be caused by genetics, which was total BS! My nexus letter was very detailed and the doctor included medical articles stating how migraines are directly related to my other service connected disability. Without that Nexus my claim would have been denied. I suggest getting more evidence & a better Nexus. Also another suggestion is to send a private message to your primary care doctor every single time you get a migraine! Keep sending those messages because that is evidence too! You will probably annoy them but oh well this is for your claim! Good luck 👍🏼
