I was told to never file an appeal. Just refill the claim.
A BVA appeal is not the best first option. You have two additional options to appeal: Higher Level Review (HLR) and Supplemental Claim. Our coaches make recommendations for each based on the Veteran’s specific situation. We recommend that Veterans try the HLR if the right evidence was submitted the first time. We recommend the Veteran submit a Supplemental Claim if they have new and relevant evidence to support the denied claim. A Board Appeal should be the last resort because it takes much longer, and we do not Coach Veterans through that process. VACI does not assist with BVA claims.
@@SeanRoulhac That sounds easier, but if you do that, you lose all of your back pay from the original claim date. That means that I would lose 11 years of back pay.
BVA Judge instructed VA to send me to an ortho doctor after three C&P exams with a general practitioner. So my fourth appointment was again with a general practitioner, then had an ortho doctor review exam. That was two months ago.

Question I went in the military with flat feet. So it was diagnosed. I had to get a waiver. I was also airborne. Now I have knee problems diagnosed. How would I file that?

Since this the latest video and didn't know where else to ask you but my question is the VA just sent me a form to verify if there has been any change in my dependents ie... wife and child but my question is by doing that is it normal for them to do that or does it mean something else????? Thanks

I have learned alot during this appeal ,I have medical records from va health and 2 nexus letters and 3 buddy statements. If it gets denied I will appeal and take to veteran law judge,I will not give up I have enough evidence for my claim.
That's the attitude! Education is key!
That's what happened to my husband. He filed a FDC with nexus, diagnosis, DBQ, reference material and still got sent to a C&P exam. Unreal.

QUESTION: I am 70% PTSD and hearing combined. Should I try to increase to 100% PTSD? I filed for sleep apnea and was denied because the DR said " "The sleep apnea was "probably because of service connected" So they denied me. So I am given the option of a SUPPLEMENTAL CLAIM OR HIGHER LEVEL REVIEW. So now I either have to take it to the next level or get another Dr top re-write it. What should I do?. Not sure what would be the best route for getting to 100% Thanks! I would really appreciate the help

Hi there! 100% is the maximum amount of benefits and compensation you can get. We advise against opening up your rating for re-examination, unless you are experiencing a life threatening condition.
Good Video. I have quit going to the VA. They took my only secure internet connection I had with the outside world. I had a loaner iPad that said I was 44 miles from where I really am and the restrictions on it makes me wonder why such an expensive device. But that is another story. It had T-Mobile which everyone knows has no coverage at Lake Nona or Titusville where I am. I have given up to the point I took back all the meds to them 2 one gallon ziplock bags full. Didn't take the insulin or sharpes no bin for them. The thing that got me so mad was my research on the contamination at Pease AFB, NH and the injuries are no combat related so thanks to Camp LeJuene for locking out any claims because of the settlement they made. 114 bases and camps in the USA in out of luck.

also would like to talk with the ex vba breaded guy. im working on issues with comp and pension department and things are not adding up. i have spoken to the vba director about lhi and wtc. i have spoken to qtc and things arent adding up.
I had a QTC appointment for ptsd upgrade and my video link didn't work. I called customer support a hr before my appointment and they told me I never had an appointment. They sent it back to the va as a no show and I've been calling since September atleast twice a week and they've been putting in service request since September I haven't heard a word from Noone
We are sorry to hear this. Unfortunately, the VA is not exempt from human error. We hope they rectify this situation as soon as possible.
NAVY 99-04. Stopped loss 12/20/2003 to 01/09/2004. Was put in a naval hospital and those medical records have been made calcified/confidential. I have a rating after being denied 7 times. Is there anything I can do in regards to those records? I feel they are crucial and holding me back to be 100%.

Any idea on the timeline of a supplemental claim? Unfortunately im in san diego so i believe theres a lot of claims. I submitted additional evidence that should prove a nexus. My initial claim took 3 years, any chance it would take less than 6 months? Ptsd claim.

If I’ve put eight elements on one claim that all relate directly to the back and only three of the eight have a diagnosis with the diagnosis code will the remaining five be denied? In the doctors notes I provided two of the remaining five states from my doctor that I am diagnosed with those two things, I do have a coach, but my understanding was all of my non-diagnosed things are on my x-rays and MRI so there is clear evidence. Can they rate the three with the diagnosis or would they deny everything in my claim?

I went to the va hospital and was diagnosed with chronic ptsd and depression and high blood pressure\. They (VA) have me seeing a mental health person. .I have no records before that can I still put in a claim .

Initial Denied on OCT 2019. Currently Appealed “Evidence Docket Route” at the BVA for PTSD. Had a sexual assault/rape happen to me in service. Used a County Government VSO. “Very good.”
Been sitting at Board since July 2020, which is about 1,125 Days+.
(During this process at the board, the Army Discharge Review Board Granted me an Honorable Discharge and said I should have never been discharged and was result from the innocent that occurred. New DD-214 and granted relief decision was sent to the board 01/2023.
According to BVA’s Evidence Docket Route Time Goals, for ADP & ADC is 1,068 Days. I’m about 60 Day’s + over there AMA Evidence Appeal Timeliness goals.
2 Congressional Inquiries in 2022 & 2023 stone walled me and my congressman.

My AMA Evidence Appeal has been sitting in a submitted status for almost 3 years. I’m a Combat Veteran with solid evidence backing my claims and I still get denied. It’s an injustice I will never forgive. This country has failed me and many others veterans.

My lawyer suggested I not put any more claims while my appeal is pending. It could lower my current rating and/or change the effective date of my appeal goes through. This is unfortunate because I want to make claims on the PACT ACT.

We advise you contact the VA immediately. This is what the VA says: "If your decision notice shows at least a 10% disability rating, you'll get your first payment within 15 days. We'll pay you either by direct deposit or check."
