    I was awarded sleep apnea secondary to ptsd on the first try and with just a nexus letter from my va doctor.... its the knees that have given me the most trouble and I was a marine grunt

      No, neither VA Doctors (employees) nor VA contracted doctors (private contractors) can write Nexus Letters for veterans.
      Why?
      Because they are not “independent.”
      Since VA doctors and VA contracted doctors are “hired in the service of VA,” by regulation, they are not appropriate medical experts for the purposes of providing an Independent Medical Opinion for a veteran.
      Again, because they aren’t “independent.”
      In fact, they are “dependent” on the C&P examination system in which they work.

    I was approved for allergic rhinitis and chronic Sinusitis but got denied sleep apnea but i file a supplemental claim and the Va had say it is service connected but didnt proved how it is link to my allergies. I got my CPAC machine and did the C&P exam. All my notes are from my doctor visit dueing my deployment.

    @Brian Reese - I 'm a VACI elite member and I submitted a fully developed secondary claim using Telemedica's Nexus and IMO letters for both Mental Health and Sleep Apnea and my Sleep Apnea was denied and my Mental health IMO was rated at 70% but I only got 50% rating from VES. I spoke to my coach and I opened up a HLR for this denial and lower rating than expected.

    I have 50% for ptsd and have a cpac machine I filed a secondary claim and got 3 deferred statements from the VA I'm not going to pay a penny for a nexus letter

      Bro, I was in the same boat...rated 50% for PTSD and then, a few months later, I had my VA Primary care physician order me a sleep study. I had extreme fatigue. He did and the VA performed it with an at-home sleep study WatchPat. When the VA sleep study doctor called me with the results, he diagnosed me with severe sleep apnea and ordered me a cpap machine. Here's the thing though...the only way I could file a sleep apnea claim was to file sleep apnea secondary to PTSD. When you do that, you want a strong argument and will want a nexus letter linking sleep apnea to PTSD. It's almost like a game because the VA raters KNOW these things are linked but they make you follow the rules of the game. I paid for my nexus letter, but it was from a freaking expert Psy. D. who has written books on sleep apnea...the letter was 8 pages long! From all of my research, I've never heard of the VA approving a secondary claim without a nexus letter...I could be wrong. I don't think they are required...has anyone reading this ever been approved for a secondary claim without providing a nexus letter?? Let me know if they approve you without one. I hope it goes well for you.

    How do we prove the depression and anxiety. A year out of the military, I failed a psych exam for employment due to depression and anxiety. I went to the Dr for migraines while I was in. Osa is what cases a lot of my migraines are caused by osa. I have been denied depression, anxiety and OSA.

      There are a few options if you've been denied. A BVA appeal is not the best first option. You have two additional options to appeal: Higher Level Review (HLR) and Supplemental Claim. Our coaches make recommendations for each based on the Veteran’s specific situation. We recommend that Veterans try the HLR if the right evidence was submitted the first time. We recommend the Veteran submit a Supplemental Claim if they have new and relevant evidence to support the denied claim. A Board Appeal should be the last resort because it takes much longer.

    Filed fdc for sleep apnea with nexus and dbq I’m on day 76 with no movement since gathering evidence stage. Rations are good morale is low, anxiety is high.

      I currently over 15 months in my disability claim was denied in October but went ahead and done a supplemental claim right after before the time window so hopefully if I get approved they will back pay me for about 15-16 months😊

    I was discharged from the service for years ( maybe 8 yrs ) before being diagnose with Sleep Apnea. Never knew I had it. All those years my Wife and Hunting buddies said sound like a bear. To add to this I've been discharged for 47yrs. I'm not a combat veteran, I served in Panama. Is it worth while bringing up? The reason I'm going to the VA now is to see if I can get help for Prescriptions

    Brian I have watched your videos and have done a lot of research for the last 30 some years on my claims. As I retired in 1992 and I know I should have been 100% then. I was 0%. After fighting the VA for 30 years I am at 90%. Waiting for the BOA to make a decision as I have a VA claims Attorney on about 4 issues at the moment one is obstructive sleep apnea which they are going after as secondary to hypothyroidism, typII diabetes. Which I not only had civilian doctors and VA doctors say you need to push away from the table your gaining weight. No sh_t Dick Tracey. Our medical teams only know how to do treatment medicine not preventive medicine. As I had mentioned do you think I am insulin resistant? no answer. I would like to hear a video on how to get your claim to the rightful date and not the VA date which is if you let a year pass you can no longer get it at that date it must be at the next time you file. I feel that is wrong. i.e. We just received the presumtive pact act. Those of us that were on Guam during the Vietnam War won't get the rightful claim which was when we were either station on Guam or when we left the service or retired from service. In my case I was on Guam in 72-73 and or my retirement date is 1992. I think they are planning on paying us when they added it to the list which is wrong. We have suffered from exposure to Agent Orange and the rest of the rainbows all that time.

    I have had an appeal filed on my Sleep Apnea denial since 2020. Randomly I get updated that I’m still “in line” for my hearing.
    I’m at 90% and my VA Sleep Dr has diagnosed my Sleep Apnea so severe he wants me to see if I qualify (medically) for a machine they’ll surgically install under my skin in my chest with leads going to the muscle groups in my neck to open my airways at night.
    With having the appeal in and waiting an I able to add a Nexus Letter to my filing ?
    If so, I believe I have have a primary disability that Sleep Apnea would fall under.
    Do I need to have the filing state that I’m filing for “ Sleep Apnea SeCoNdaRilY to Depression” , or in their review will this NOT BE considered since I didn’t file it stating it Was a filing secondary to Depression “ ?
    Very Confused and Frustrated in Georgia .

    I have been diagnosed twice with Sleep apnea and CPAP needed. First time Sleep apnea diagnosed was while on TDRL 2012 again diagnosed by the VA 2023. Is Sleep apnea a secondary to stage one adenocarcinoma lung cancer diagnosed in 2009 service connected while on active duty.

    I am in Austin and need some references for some claims... I get 70% PTSD and 10% tinnitus.. GERD and Liver issues were denied and I was at Camp Lejeune during water contamination period.     they want me to appeal my denial instead of putting it as secondary to my sinusitis. even with nexus and buddy lay statement from my mother and section leader, they want me to appeal it instead. Im getting frustrated with this VA that keeps running me in circle with my sleep apnea even if they were the ones that issued my CPAP.

    if I have multiple conditions of the ones that was mentioned (asthma, sinusitis, rhinitis), can they all be tied together in the nexus letter & DBQ to create a much stronger case to win sleep apnea? meaning instead of secondary connecting it to just one condition could they connect sleep apnea at least 3 conditions that are already rated?

      Hi there, VACI does not provide nexus letters.
      Nexus letters do not guarantee a specific award percentage. There are many factors that go into which award percentage is assigned by the VA, and even though the document may be written to support a higher level than you received, a denial may have been due to other factors in your claim filing or during the C&P exam.

    My sleep apnea was denied beore. However, i have 100% for other conditions. Can i request sleep apnea again to have it for service connect?

      If you're already 100%, we advise against opening up your claim for re-evaluation. 100% is the maximum amount of benefits and compensation you can be awarded unless you're trying to secure P&T or qualify for SMC.

Im just wondering bc you dindnt mention endocrine disorders as secondary to sleep apnea. .Already got sleep study done not by va but private doctor. Results are moderate sleep apnea. Many thanks. Should i go for the claim or no go?

    I have been diagnosed with Sleep Apnea and given a cpap machine through the VA.
    Do I still need a Nexus or DBQ from another doctor?

      Yes. My journey: I took an "at home" sleep study (kit supplied by the VA). From that, VA said I had sleep apnea. VA supplied me with a CPAP machine. I filed a fully developed claim (secondary to PTSD) INCLUDING a very good doctor-supplied nexus letter. VA sent me on a C & P exam. Results: exactly 37 days start to finish and received a 50% rating.

      Receiving medical care at the VA for a specific condition does not mean that condition is eligible for VA benefits under the law. All disabilities must be “service-connected,” meaning they were caused or made worse by your military service or another service-connected disability.

      100% is the maximum amount of benefits and compensation you can get unless you're trying to secure P&T ir qualify for SMC!
