I submitted a claim for a severed vocal nerve. The surgeon cut it during surgery. I was awarded 20%. I wasn't happy but I couldn't find information on my condition to appeal. 2 months later I received a letter stating my rating was now 70%. The letter showed the VFW worked my file. I still have no idea what happened to get the increase, but I feel their rating is fair. Also your closing you stated " we all signed up to serve". Check when the draft ended, these are the Viet Nam vets. A lot had no choice. I still know a few that won't go to the VA or acknowledge they served. The were the "baby killer" and were spit on. I also am a Nam era vet.

I’ll try to keep this as concise as possible. I submitted a claim for an increase and went through a private company who provided a DBQ. Submitted it as a fully develop claim and request to not go to C&P exams VA moved it to a fully develop claim and the last update I got from calling the one 800 number was they just needed a second signature from a VSR before moving to the next phase. Could you provide any clarification as to what that means if you can with that amount of information. Thanks for doing all the great work you do and helping veterans.

Filed July 6 for Migraines Got the notice to make an appt for C&P on 8/30. Appt is on 9/15. I’m guessing a decision around thanksgiving. Question, I have migraines and I am getting ready to initiate my claim with the VA for that, however, I have been in a position for several years that when I have to call out sick from work for the issue, I am able to use my Vacation time instead of using my Sick time. Will that count or do I specifically have to utilize Sick time?

I sent pictures my surgeon took during surgery and hilighted (color coded) every page of treatment for the things I was claiming. Pink was one condition, green another, blue another. I was not playing

In the legacy appeals system, after the VA Regional Office issues an SSOC continuing to deny all or part of a remanded case, the case will return to the BVA for it to review whether the VA Regional Office corrected the previous mistakes.

Great video. Question, I am currently at 70%, (10% tinnitus and 70% MDD), that said I was just granted SSDI as well. When I first submitted for my SSDI I was not approved and I appealed it and it went into reconsideration. While in reconsideration I was awarded the 70% MDD from the VA and my attorney uploaded to the VA the granted MDD rating of 70% for it. Within 1 week of him doing that the SSA granted my SSDI and he told me the MDD pushed it over the top for me. Now the question I have is I am currently fixing to file a migraine claim and request TDIU at the same time, will a copy of the verification letter from the SSA granting SSDI help in anyway to get my TDIU since the MDD was also a deciding factor in their decision? I know that both are separate from one another and SSDI is actually harder to get but I was just curious if it may help my TDIU journey.

Had my CP Exam today for Diabetes under the PACT Act. Lasted 5 min. Showed them my AIC docs and that was it. CP examiner was not interested in my Medication List or other documents that I had.

Im sitting at 20% for a total of both knees they got me down for degenertive arthritis, but recently got diagnosed for psoriatic arthritis in my knees which is 2 total different dianoses, granted when i did my first c and p exam i was new to it and didnt do a personal statement etc so now im getting it all documented through va doctors and community providers and gile for an increase
I served as a marine machine gunner and both my knees are shot...multiple surgeries , degenerative arthritis and now need both knees replaced....Been fighting to get them service connected....finally got a nexus letter....hopefully I get connected

I told a coworker (TSGT) about getting my specialist doctor for my migraines to fill out a DBQ and he said be careful that I’m not malingering. How does getting further medical evidence and professional doctor to certify my claims malingering?
It’s only malingering if you’re lying about your symptoms. If you have been diagnosed and are suffering from migraines you are NOT a liar.

Here at VACI, our Veterans, on average, get a decision back within 90-120 days after they file their claim. It could be shorter, or take longer, so we focus on making sure you submit proper documentation and hopefully shorten any delays.

I had my mental health c&p exam. Favorable resukts for depression anxiety secondary to tinnitus. Today 2/19/24 got a text saying they need another c&p exam for the same thing except they included behavioral health. Why. Doesnt make sense to me please help.

Have an Apnea claim that is in Supp Appeal after an HLR w/ DTA error. Filed secondary to lower back rated injury due to inability to sleep on my sides at all. Been in appeal since April 2023 in “gathering evidence” mode. 134 days and counting while they “gather evidence???”

@@VAClaimsInsider but this IS NOT a BVA appeal. This is a Supplamental appeal that was sent back to the Regional office to be re-evaluated. Been sitting at the Regional after HLR for 135+ days now.
Two days ago I had a Mental Health C&P exam. I went in for anxiety and depression and really laid it all out. At the end the Dr. told me he was recommending me for service connection for anxiety, depression, panic disorder and insomnia. Would you consider this a positive exam? Does it seem likely I will get a rating? I am currently only at 10%.
Of all the C&P exams I had recently, that was my best one. The guy was honest with me and said he’s diagnosing with depression.

It sounds like a beneficial C&P exam! Your rating will ultimately take into consideration service connection and the severity of your symptoms!

Is there a "duty to assist" for 100% convalescent pay following a surgery performed at a VA hospital? I had hip replacement surgery and was told at the hospital that I would receive 100% will I recovered. I was later told that because it wasn't service connected that I wasn't eligible.

Appeal certified to March 2011, Lost OG Status for Higher Review via my last Attorney; He Prevailed at CAVC 2018, my 2nd Prevailing (2015) at CAVC. Was ADVANCED on Docket July 2021 on my 75th. BVA HEARING on August 7th 2022 and (Remanded) Decision of December 7th 2022. Approx 240 days later (today) we still have No Finality; final decision with Remand!

Can’t get a solid answer on this, only “maybes” so here it goes: pact act claim for pancreatic cancer. To cure my cancer they took 1/2 my pancreas and all of my spleen. Will the VA back pay the pancreas and spleen removal. I got my claim in on time for the back pay.

Hello my brothers from another war time. US Marine here 89-93. I recently filed a HLR for GERD 2nd to Mood Disorder. I have a nexus letter stating GERD was caused by Mood Disorder. Instead they merged it with Crohn’s disease. The decision letter did not mention the Nexus letter. Can not mentioning the nexus be grounds for reversing the decision??
A nexus letter is supporting evidence reinforcing your claim, yet it is not an imperative. You can file an HLR or appeal if you feel like your rating decision was not correct. I filed for anxiety/ptsd for mst, i was worried about markers and evidence.....i got my C & P exam rather quickly....throughout my c and p exam i broke down crying uncontrollably and thoroughly explained my symptoms of my first wife, job, lack of friends....just waiting for the decision....its been about 2 1/2 months...ive been back andnfor with the va talking to doctors and psychologist in hopes to.get real help

Had another c and p exam, and to be honest, the examiner felt more human....it was a safer place to share, she allowed me time to gather myself after I broke down....it felt at sometimes she was a bit leading me to express myself, now my claim is in the evidence gathering......she asked me 3 or 4 times are there anymore markers, I really want to help you and I wish you the best!! I've been in outpatient with almost all of the programs, my question is if the va med center gave me meds for anxiety, ptsd, schizophrenia is that a diagnosis??
You may not see certain things in your medical records. I was attacked when I was in and it is not in there and I went to the hospital when I was attacked, but it's not in there.

Can you guys help me, i never graduated basic training because of my injuries and 4 recycled me back to day 1 after having 4 to 5 week finished on a 6 week program! After 212 days, my claim has been with a rater for the last 10 days... I've noticed that there has twice been a request for a second signature. Any idea what that means!?!?
I had to upload my brother's medical records which the VA requested, but had not received, through a portal to which I was directed by a letter from this Private Medical Records🎉 office in Janesville. I went through the process but there was no indication that the upload was successful, which any good system should indicate. I tried calling Janesville to find out if the upload was indeed successful and could not reach anyone. I contacted the VA and no one knew of Janesville. Each VA rep said I should submit through the VA site which I did. Lo and behold the VA portal did indicate how many files were uploaded, time and date of upload and a transaction number. Moreover one can return to the vets record and see the existence of these documents, something that was not provided by the Janesville system. So this is yet one more example of the right hand not knowing what the left one is doing and the lack of consistency and reliability of the process.

And I actually disagree. Under development is a bigger issue than overdevelopment. VSRs are supposed to work the claim in its entirety as much as possible before kicking it to the next phase. But because of unrealistic production standards, a VSR will find one thing to address, and it kicks it into limbo again until the one thing is resolved. But then the next person gets it and finds all of this other stuff that didn’t get done the first time. Now that same claims goes back into limbo while we wait for more to be done. Perfect example, I just worked a claim where a veteran uploaded several sets of private records to prove all of his diagnoses. The VSR ONLY reviewed his STRs and confirmed one of his contentions warranted his exam. They did NOT bother to look at his private records to work the other contentions. 3 months went by until we got results for the one exam… that is 3 months lost when he could have been getting his other exams. One of those was an exam for PTSD… the Veteran clearly has an 0781 in his file… it went totally ignored. Now do some math and think about how many times this happens… EVERY SINGLE DAY and think about the number of pending claims! This is a huge part of why claims take so long! Veterans need to speak out against unrealistic production standards because its the number one reason why these claims take so long… the VSRs and RVSRs are not given adequate time to properly work these claim’s with errors and underdevelopment occurring.

Why doesn't the VA tell us all of this stuff. I was told to get a Nexus letter. I was getting care through the VA. The Va would not allow the primary care doctor to give me a nexus letter. Who am I supposed to go to? I have not seen any other doctors?? What's up with this??

I know you said it would be helpful to include which page number your diagnosis is in your medical records. Is it an insult to the rater to actually highlight it? I have heard do it and not to do it.

Still don’t understand how you can have a diagnosis, symptoms, quality nexus letter, lay statements, va gets one statement from a dr in a 5 minute c& p then deny the claim

I I know I have a 160 percent disability rating I need to add other things wrong with my body from agent orange so that if I pass away then my wife would get the benefits from the veterans association like the scar tissue inside my lungs that we just discovered last year that is more likely caused by Agent Orange in 2005 I had a major heart attack and caught head congestion heart failure the VA made me a hundred I mean 30% disabled as of 2007 they did not go back in my records to find out I had a major heart attack and it's in records also I think they had an error because they didn't go back to when there was supposed to go back to the first time in my records as a guidelines for agent orange pacifically sets that's why I need help please advise if you think you can help me

My claim is still sitting in the hlr work load que, pending review for 7 dam Months, knowingly that they are going to deny it, because the cand p ex.wrote me up for a personality disorder. Now ain't that a bitch !!! I have an attorney.😢😢

BIG Problem: getting civilian doctors to write NEXUS letter! I used medicare and they won't touch em. I can't afford thousands of dollars to pay these other specialists.

I served in two services, two military services. I started out in the Army National Guard. I didn't like going back into civilian life National Guard so I entered service, transferred into the Navy. I was a hospital corpsman in the Navy assigned to a ship in dry dock in Little Creek, Virginia, USS Sumter LST 1181. I got in multiple Captain's Mast because of just different things that I did that I regret but I developed a mental disorder of anxiety, depression. Later on I was found to be unfit so they sent me to a court martial for being UA. I had an Advocate General represent me in this court martial and all charges were dropped. I was sent back to my ship. I asked for a leave of absence. I hadn't seen my wife who I married at court school in Great Lakes, Chicago hospital corps School. I graduated 3rd in my class. I really wanted to be somebody but it seemed like every time I tried the anxiety and the depression would set in and I would go backwards instead of forwards. It seemed like every time I took five steps forward I took 20 steps backwards so I asked for leave. Be XO on my ship. Decided to give me an early discharge. I wasn't told that it would be an oth but it was and I didn't find out that I had other than honorable discharge at the bus station on base when the MPS came to get my uniform and they went through my seabag and took everything that was official naval. Even though I bought it with my own money everything was confiscated. I went back to the ship when I found out I hadn't other than honorable discharge and I explained that I was not informed that this was going to be another than honorable discharge or I wouldn't have signed my separation before all this happened. When I got back to the ship I was offered $16,000 reenlistment bonus and I asked if I could get off the ship and he said that he couldn't guarantee that I could get any sure duty if I signed up for another 4 years. So I refused to reenlist but I really wanted to but I couldn't see going through the anguish of being on that ship with the XO that hated me and still have the symptoms of anxiety and depression. I couldn't stand that again. I needed to go well. Needless to say, the EXO gave me no choice. He had me escorted off the base December 24th 1982 what can I do about getting my deserved honorable discharge to this day? I have blood cancer called myelo fibrosis I take medicine for anxiety and depression. I have erectile dysfunction because of this medicine. I take diabetes medicine. I have diabetes. I have hyperglycemia. I take medicine for blood pressure. I had a heart attack quadruple bypass surgery. I'm obese and I marry the wonderful woman who is the nurse and we've been married 23 years. I went to college. I got my degree as a chef from Western technical college in La Crosse, Wisconsin. I made the Dames list at college but all the problems I had with depression and anxiety. I asked for help and I never got it when I was in the Navy. All I got was Captain's mast Captain's mast please help me to get my DD-214 upgraded from the Navy and my dd214 a copy of it. I've been waiting over 3 years for a copy of my dd 214 from the army.

Are raters benefiting from lowball ratings given to veterans with a well developed claim? Seriously, do they get some reward ? There must be a reason. I am only discussing well developed claims with excellent medical evidence, nexus letters and medical reports supporting your claim. Nobody on the internet makes videos for veterans that helps them when raters screw up. Make that video, because a lot of veterans feel the same way. It's not always the veterans developed claim, it's often the raters. After several years of appeals, the appeals court ends up helping the veteran. It's not the VA as this guy says...its the raters

I submitted an increase claim on March 18, in April o had my c&p, submitted all my evidence and im still stuck on the gsthering information 7 months as of October. How long can it take? Yes my injuries are all service connected.

When the process seems nebulous you feel anxious. This makes more sense and I’ll only be checking for updates 3x per day vs every waking hour. 😊. Thanks guys.
It helps to check the VA site for updates because if you submitted a claim and you see one that got taken out but there is an update saying “you or someone else submitted an AMA”…. You should immediately get started on correcting that yourself. An AMA means you must’ve sent a claim on the wrong form or something like that. Identify which claim that is and refile right away. Don’t wait for their denial letter.
