The penalties for touching, pinching or brushing against the body of the victim are; • 1st offense: Arresto Menor 11 to 30 days of imprisonment or 30, 000 pesos of fine and attendance in Gender Sensitivity Seminar. • 2nd offense: Arresto Major 1 month and 1 day of imprisonment or 50,000 pesos of fine. • 3rd offense: Arresto Mayor in its maximum period or 100,000 pesos fine. When all of this acts is performed in public places we can have or conduct Citizen Arrest - it is when someone experiencing this act on public and the private person or someone who was having knowledge of it especially it is caught in the act he/she can arrest the offender under the law which is Citizen Arrest. Gender-Based Sexual Harassment in Public Utility Vehicles. -In addition to the penalties in this Act, the Land Transportation Office (LTO) may cancel the license of perpetrators found to have committed acts constituting sexual harassment in public utility vehicles, and the Land Transportation Franchising and Regulatory Board (LTFRB) may suspend or revoke the franchise of transportation operators who commit gender-based streets and public spaces sexual harassment act.

Thank you for another knowledge for this video lesson, This video lesson atty Leslie Apostol she discuss the other punishments for violating the Safe Spaces Act specifically by touching, pinching, or brushing against the body of the victim and I also learned that any citizen who can witness of any kind of crime can arrest the perpetrator even if he/she is not a public officer. First offense punished by Arresto Mayor 11 to 30 days imprisonment or a fine of 30, 000 pesos and attendance in a Gender Sensitivity Seminar. Thank you for sharing your knowledge Public spaces cover the public utility vehicle and also the private cars like grab, the penalty of person who work at the said occupation can penalised, in LTO the cancellation of license, in LTFRB suspension or revocation of their franchise, but this is not automatic this is passed to their administrative procedure of LTO and LFTRB their is still due process. Where we can we file the case? - We can file the case to their Administrative LTO/LFTRB and we can also file the case in our police station agains the perpetrator. Where we can Blotter the case ? - We can blotter the case in our Barangay but the ultimately is the Police Station to launch the complainant. What evidence we can bring ? -We can get the CCTV footage or Witnesses to prove harassment, this is evidence that can use as backup.
