Ito yung kasong CIVIL na specific performance, kaya yung gusto nyang habulin yung damages dagdagan pa niya ang kaso CIVIL CASE: SPECIFIC PERFORMANCE WITH DAMAGES, dahil obligado ang lahat ng mga taong qualified at may kapasidad na pumasok sa isang kontrata na gawin ang lahat ng obligasyon na hindi labag sa batas; public moral, public policy, at iba pang sinasabi nating alituntunin ng ating siyudad o komunidad na gawin ang kanilang mga mandato.
SPECIFIC PERFORMANCE: When no other remedy (such as money) will effectively recompense the other party, courts apply a particular remedy called specific performance. The court will use a legal remedy if it will put the injured party in a position where he or she would have been if the contract had been properly executed. When it's not only an issue of money or the exact amount of damages is uncertain, the most typical reason courts grant specific performance is because the contract's subject is unique or distinct. When a contract is for the sale of a one-of-a-kind property, for example, monetary damages may not be enough to compensate the client.
