    Kami po ay 9 na magkakapatid ,Yong pang anim ko Pong kapatid ang nagsasaka simula ng iyaward ng Land Bank ,payable for 10 yrs . Siya na po ang naghuhulog ,kasi sya lang ang nagsasaka.

    Hindi pa doon natatapos ,nangutang po siya sa Sure Harvest ng pataba worth 20 K ,inabot po ng 20 yrs bago nabayaran ,ang sabi po ng Mayor namin ay forfeited na ,wala naman po si mayor na maipalad na contract ,titulo po ng lupa na nakapangalan po sa aming mga magulang ang nacollteral.sa nasabing utang

    Hello good morning EVP Atty. Jayr 😊 Pasensiya na sa abala. Just have a quick question regarding sa hatian ng lupa ng parents. May right ba ang isang apo sa hatian ng isang lupa. For example. May 3 magkakapatid. Hinati na ng parent yung lupa. But instead na equally devided to 3 na anak ay it’s devided to 4. Yung isang part ay para sa parent kung saan nakatayo ang ancestral house. And then at the end yung kay parent ay ibinigay ngayon sa apo. Buhay pa yung parent(lolo) May right ba na magreklamo ang tatlong anak? Since marami namang apo hindi lng iisa. And yung dalawang anak, sila ang nagpagawa ng bahay or nagparenovate ng ancestral bahay noon? May right bang magreklamao yung mga anak?

    Good morning po atty , ask ko lng po kung pasok padin po sya sa action for partition of properties , may lupa po kc sa probinsya ang yumao kong nanay at mga kpatid nya na pamana sa kanila ng kanilang magulang , ngunit naibenta npo ito ng mga kapatid ng nanay ko noong 2011 ng hindi pinababatid sa akin ., Ngaun ko lng po nlaman 2022 .. hndi nila binigay sa amin ng kaptid ang parte ng aming nanay ..

    Hello po atty, good day. What if po yung property is sold po by a single heir and it was not stated that, he together with other heirs, have made settlements with the property. Ano na po yung rights ng buyer sa sold property po?

    Atty. Ask ko po nagpapakabit ng kuryente ang mga pamangkin ko sa bahay ng mother ko kc cla nakatira doon ngyn kailangan raw ng extra judicial kc hinihingi ng munisipyo . Ano kailangan kung gawin sa akin kc pinangalan yun sa kuryente .salamat po ❤

    hello atty ask ko lang kung may karapatan ba ang ibang kaptid sa lupa.. kasi ang lupa na yon ang nakapangalan sa tatay ko pero ang tunay na may ari ay yong kapatid ko dahil pera ang pinangbili ng lupa na yon pero siya nasa abroad kaya yong tatay ko nag asikaso habang nasa abroad ang kapatid ko kaya pumayag yong kapatid ko na ilagay ang pangalan ng tatay ko dahil ang kaptid ko ay nasa abroad pero siya ang tunay na may ari....

    Atty. good day po! paano po kung nagkabentahan na at nasa DAR na po ang mga Documents para s DAR Clearance tpos SPA ang gamit, while halimbawa po pumanaw ang nag benta ng CLAO at nasa name n'ya? paano po ito malilipat? meroon n din pong DOAS at SPA paano po itutuloy ang process ng transfer to seller?

    Attorney sa pag process po ng estate tax payment. Kailangan po ba Mauna ang extrajudicial settlement WITH PARTITION na may plan ng geodetic engineer. Or ok lang po na after na magbayad ng estate tax iyung plan ng geodetic engineer?
    Magkakasundo po magkakapatid, Hindi po ibebenta ang lupa, gusto po na magkakatabi pa rin pero Tig iisa ng titulo.

    Hello po Atty. 5 po kaming mgkakapatid. Medyo matagal na pong ibeninta ng apat kong kapatid ang kanilang share siguro more or less 20 na. Tapos wala po akong dokumentong hinahawakan sa lupang natitira para sa akin. Ano po ba ang gagawin atty?

    Hello Atty..allowed po b ang EJS ESTATE na Wala Partition of Deeds sa kakulangan Ng Budget sa Pg Survey bale One Whole Lot muna ang SURVEY para Mahiwalay Lang po sa Mother Title pero naka Indicate nmn po sa Agreement at Equal Share lahat pero mananatili muna Un devided ang mana lote Habang Wala pang budget mgpaindividual survey at Pg title.?ano documento need para Doon .Salamat po

    Attorney, nakabili po ako ng lote, deed of absolute sales po ang ginamit namin at extra judicial settlement among heirs (asawa at 1 anak lang) patay napo asawa na babae, asawa na lalaki ang nag benta sa akin. Yung anak hindi naka pirma sa deed of sales
    Concern ko po, may gap po ba sa mga documents. Ano pa po ang dapat icomply Para ma pa transfer ko po sa name ko ang titulo.
    Yung extra judicial settlement among heirs need pa po ba ito ipapublish?
    Tama po ba yung form na ginamit, extra judicial settlement among heirs.
    (na dapat ay extra judicial settlement of Estate with sales)

    atty. is it required that the property is transferred to the heirs before they can execute the sale of property? they already have the plain EJS and publication was done and estate was paid but nag stop po sila sa part ng registering sa register of deeds since they are planning to sell it, so the property is technically still named after the deceased person. will there be issue with this one? specially that the buyer is planning to have this bought thru bank/pagibig loan, and they are saying that banks are against EJS unless 2years has lapsed?

    Good day po attorney! Buyer po ako, Mag kahiwalay po yung extra judicial settlement at yung deed of sale namin. Kami napo nagsettle ng estate tax, bayad napo (whole property) ask ko lang po, sa BIR ONETT, hindi po kinuha ang deed of sale. Bakit hindi po kinuha? Di po ba dapat naka attached ang deed of sale sa extra judicial settlement.
    Concern ko po, baka sa release ng eCAR (estate tax) eh nasa pangalan parin ng heir dahil hindi kinuha ang deed of sale.
    Paano po ba gagawin dito.
    CGT and doc stamp bayad napo (eCAR po nasa name ko na released napo). Please advise po attorney. 🙏 Maraming Salamat po

    paano po kung nawawala ang titulo ng bahay at lupa ? namatay kasi ang Uncle ko na humahawak ng titulo hindi namin alam saan na yung titulo 10 yrs ago

      Kanino po yung bahay at lupa? Una po ay magpagawa kayo ng affidavit of loss upang maipa-annotate ito sa Register of Deeds. Kumuha po kayo ng abogado na makatulong po sa inyo sa pagfile ng petition for reissuance of lost title.

    Atty. regarding po sa titulo na nakapangalan sa magulang ko pero namatay po ang Tatay
    ko.Ang nanay ko po ay buhay pa. May tatlong anak naman po si nanay sa una nyang asawa. Ang tatay ko ay naging pangalawang asawa at may dalawang anak kay nanay.
    yun po bang anak ni nanay sa una nyang asawa ay may karapatan sa lupa. Balak ko po kasi ayusin na ang estate tax ng tatay ko habang may amnesty program ang gobyerno.

    Atty may tanong po ako.....Meron bang makukuhang mana ang mga anak kung namatay ang kanilang ama sa bagong asawa? Bali ang story po ay, nag asawa ulit ang kanilang Ama dahil namatay ang kanilang ina tapos po after 9years namatay din ang kanilang Ama at bininta ang bahay na pinatayo with her new wife at sila ay hindi binigyan kahit singko....meron ba silang rights to claim sa kanilang mana in behalf sa kanilang Ama...Salamat po.

      Yes po, in as far as partition is concerned. Bahagi pa rin po yun ng estate. But as to the titling, the heirs must apply with the DENR if the land is untitled.

    Hello po Atty. I have my personal question, pero just to think of it sobrang haba ng kwento.🤣 If am going to direct my question, I don't think It satisfy my question because the problem is too complicated with my sister in law and my brother( were their marriage is on the rock ) and they are staying in my house for almost 22 years,they didnt share any cents, for paying water, electric ,monthly dues in other words Free accommodation etc.my parent suffered and me too kasi wala akong bahay na mauwian.Gusto ko sana silang paalisin! .Pero ang kapatid ko? kasama sa mana kahit maliit na lupa at bahay. My Nanay died last March😢😭 with sharf memory and very strong and father died 6 years ago.
    If I get a reply I would appreciate if not not maybe in the near future someone with share their story that is mostly like similar then I will get an idea..God bless po at ingat din po kayo palagi.

    Ask lang po, Ang estate tax penalty po ba ay dahil sa kung kelan mo na ipanotary yung EJS at hindi mo ito kagad naifile sa BIR OR ano po ang dahilan kung bakit nagkaka roon ng penalty sa estate tax.
    Katulad po ng EJS ko, Buyer po ako, yung seller Nagbigay ng EJS MARCH 2021, namatay ang asawa sa US last October 2019.
    May penalty na po ba yung EJS ko dahil (1 year and 4.months npo ito) deed of sale po May 2022.
    Please advise po. Maraming Salamat po 🙏

      May penalty po talaga kapag late ang pag-file ng estate tax return at ang pagbayad ng estate tax.
