    G.R. No. 196403, December 07, 2016
    “As enunciated by the Supreme Court in Alejandrino v. CA, et al.:
    x x x Under a co-owners/tip, the ownership of an undivided thing or right belongs to different persons. Each co-owner of property which is held pro indiviso exercises his rights over the whole property and may use and enjoy the same with no other limitation than that he shall not injure the interests of his co-owners.
    The underlying rationale is that until a division is made, the respective share of each cannot be determined and every co-owner exercises, together with his co-participants, joint ownership over the pro indiviso property, in addition to his use and enjoyment of the same.
    Although the right of a heir over the property of the decedent is inchoate as long as the estate has not been fully settled and partitioned, the law allows a co-owner to exercise rights of ownership over such inchoate right. Thus, the Civil Code provides:
    Art. 493. Each co-owner shall have the full ownership of his part and of the fruits and benefits pertaining thereto, and he may therefore alienate, assign or mortgage it, and even substitute another person in its enjoyment, except when personal rights are involved But the effect of the alienation or the mortgage, with respect to the co-owners, shall be limited to the portion which may be allotted to him in the division upon the termination of the co-ownership.
    With respect to properties shared in common by virtue of inheritance, alienation of a pro indiviso portion thereof is specifically governed by Article 1088 that provides:
    Art. 1088. Should any of the heirs sell his hereditary rights to a stranger before the partition, any or all of the co-heirs may be subrogated to the rights of the purchaser by reimbursing him for the price of the sale, provided they do so within the period of one month from the time they were notified in writing of the sale by the vendor.”

    Attorney, salamat po sa paggawa ng mga videos na ganito, napaka helpful and marami kaming matututuhan. Attorney, na inherit ko ko ang property ng parents ko sa pamamagitan ng Extra-judicial sa Pinas. Kapag po ba ipinagbili ko ang property at nakapagbayad ako ng Capital Gains Tax, miscellaneous, fees, and other payments at na complete ang process ng selling, iyong matitirang profit, kailangan pa po bang magbayad pa ng income tax sa Pinas para dun, aside sa Capital Gains Tax? Ang primary residence ko po ay U.S.A.

    Good afternoon, napanood ko po mga vlog nyo they are all very informative thank you very much po, what if po kung sa “extra judicial settlement of estate with sale” ang nkalisted at nka pirma lang po yun surviving spouse only, yun po 2children nila na single legal age wala pong pangalan at walang pirma sa document pero nka lusot po ang payment sa BIR, valid po ba transaction between seller and the buyer?
    How long po pwede maghabol yun 2children na heirs, Kung mkalusot din po sa “Registry of Deeds” na maparelease nila ang title?
    sabi po kasi nila, 2years invalid na yun paghahabol nun 2children na heirs?

    hi po atty may katanongan lang po.. may kilala po kasi ako grupo o mga tao na ngbebenta ng lupa kung saan nkatirik ang up diliman.. particular ung kahabaan ng philcoa market at lupang bakante doon kung saan UP daw ang may ari.. ang grupo na eto ay may hawak na certified true copy at sila daw ang orihinal na may ari ng lupa na iyon.. katunayan eh nghahanap sila n mgsponsor upang mabayaran ung taxes at penalties nto.. may kausap silang judge at mga buyer para mabenta eto.. possible po ba eto? sna mapanagot ang mga sindikatong eto

    Halimbawa po kung ung isang heir ibenta ung share nya, tapos ung mother title ng titulo po ay isinanla na pala ng isang pang hier na hindi alam ng ibang hier at hindi na kayang tubusin nung nagsanla ng mother title , tapos ngayon po ung isang hier gusto ng ibenta ung share nya, pero c buyer nag aalala sya na baka hindi mailipat sa kannyang pangalan ung mabili nya kc hindi na makuha ung mother title na titulo, attorney ano dapat gawin pag ganun?

    Sir quick question po, pano kung death certificate ng owner is issued sa US kasi dual citizen sya, the property is in the Philippines, may kaakibat na requirement po ba dun?

      Documents emanating po from abroad must either be apostilled or authenticated by the Philippine consular office.

    Ask lang po, Ang estate tax penalty po ba ay dahil sa kung kelan mo na ipanotary yung EJS at hindi mo ito kagad naifile sa BIR OR ano po ang dahilan kung bakit nagkaka roon ng penalty sa estate tax.
    Katulad po ng EJS ko, Buyer po ako, yung seller Nagbigay ng EJS MARCH 2021, namatay ang asawa sa US last October 2019.
    May penalty na po ba yung EJS ko dahil (1 year and 4.months npo ito) deed of sale po May 2022.

      Requirement po yung publication sa settlement of estate - either through an affidavit of self adjudication or extrajudicial settlement of estate. Hindi po ito requirement sa pagbenta pero need pa rin po ito kung ipapalipat ang titulo sa buyer. Dahil kailangan din pong mabayaran ang estate tax sa BIR.

      Ang tanong po pagbile po ba namin yan ay malilipat sa amin ang titulo lapse na po ba ung encumbrance.

    yung seller na responsible na magbayad ng gain tax eh namatay 2020, binenta yung lot 2016 pero d pa na trnasfer sa buyer dahil overseas sya .. sino ngayon ang magbayad ng gains tax

    Atty., paano po kung ang bahay at lupa ay gustong iwanan ng mga magulang sa bunso nilang anak pero 7 silang magkakapatid pero walang inexecute na last will and testament. Pwede pa rin po bang co-owners ang ibang mga anak? Thank you po.

      Pag walang last will po, all the legitimate children will equally share in the inheritance. An illegitimate child is entitled to 1/2 of the share of the legitimate child.

    Question po attorney, Namatay po ang Mrs. nya sa US nung 2019, sabi nya may death certificate na daw po siya. Dapat po ba naka apostile na ang death certificate nya.     Ask lang po attorney, Buyer po ako, pwede po ba ako ang magprocess ng estate tax (may Extrajudicial settlement of estate March 2021 and deed of sale May 2022 separate documents). Ok lang poba ito, o dapat mag ka pareho po ang date ng extra judicial settlement at deed of sale
    Concern ko po: yung lote lang po ba na Nabili ko sa seller ang Subject sa estate tax. Hindi na po ba Masasangkot ang iba pa nilang property. Please advise po. Maraming Salamat po.

      Pwede po kayong magprocess. At pwede pa rin po i-process yun pareho. Yun nga lang po, most likely, may penalties na po yun. Estate tax, CGT at DST po ang babayaran dun, plus penalties. Sa estate tax, kabuuang estate po yung kailangang bayaran, not the portion only.

    Attorney, pwede nyo po ba ako bigyan ng idea kung magkano po magpagawa ng extra judicial settlement of estate with deed of sale (yung pinaka documents lang po) kami napo kasi ang mag papa publish. Nag ask po kami sa isang law firm na nag Nonotary, hinihingian po kami ng 15k, and that's too much. Nakabili po ako ng lupa last month. Please advise po. Waiting for your reply. Salamat po.

      Depende po kung saan po kayo. Bawat Chapter po ng Integrated Bar of the Philippines ay may schedule of fees na sinusunod ang mga notary public. Nakabase po ito usually sa amount ng contract.

      For sure sa Inyo ung naiwan ng ex hubby nyo kung legit kayo kaso need mag lawyer or nagpagawa ka ng special power of attorney sa Canada then send sa relatives u na trust na nasa Pinas need mo ipa apostille ung document before send Philippines

    Good day po! Buyer po ako, Mag kahiwalay po yung extra judicial settlement at yung deed of sale namin. Ask lang po, nagbayad na kami ng estate tax pero hindi kinuha ng BIR sa ONETT ang deed of sale. Bakit hindi po kinuha? Di po ba dapat naka attached ang deed of sale sa extra judicial settlement.
    Sa pagrelease ba ng eCAR (estate tax) nasa name na po ba namin or sa name parin ng heir.
    Paano po pagdating sa RD, magkaiba po ang name ng eCAR (sa estate tax) at yung isang eCAR nasa name ko po.
    Paano po ba ang gagawin dito
    CGT and doc stamp bayad napo (eCAR po nasa name ko na released napo).

      isubmit mo na po yan mam sa rd okay na po yan mam ung ecar na nakaname sa previous proof po yan na nabayaran ung estate tax ng decedent and dumaan ng settlement extra judicially, while ung isang ecar naman po sa name nyo para sa sale nyo po un between you and the owner/s of the property transfer sa inyong name.

    Atty sabi saken ng mga atty dito sa north caloocan. Illegal daw un ganyan proseso kasi mag nilagpasan daw po na step which is un hindi na nilagay sa name ng mga heirs un titulo kundi from mother title galing sa mga magulang na namatay na diresto na sa buyer ang paglipat ng pangalan.       It is not illegal. As explained, walang nilagpasan na step. Hindi mo nilalagpasan ang pagtransfer sa mga tagapagmana.

      Kung portion lang po yung ibinenta at titled yung property, mahihirapan po sila sa pagpapalipat ng titulo dun sa portion na nabili.

    Ask lang po, urgent lang po. Deed of sale + extra judicial settlement of estate (ama at 1anak). Magkahiwalay ang documents with notarized.
    Buyer po ako, nagbenta ng lupa ang ama (seller), ngunit hindi nakasama ang name ng anak sa deed of sale,
    pero may Extrajudicial settlement with estate napo. (ama at 1 anak)
    Tanong lang po, paano po gagawin po Para maisama ang name ng anak nya sa deed of sales (willing naman po mag sign ang anak)

      Kung buong property ang ibinenta at co-owner yung anak, kailangan ang pirma ng anak sa Deed of Sale, unless naka pag-execute sya ng SPA, authorizing the father to sell the property.

      @@YourLawyer opo, buo po yung property Attorney. Nagkabentahan po kami nung May 05, 2022.
      Nasa akin napo yung eCAR, inasikaso ko muna yung cgt at doc stamp.
      Pero hindi pa po nasesettle ang estate tax at hindi pa po napapublish ang EJS (isusunod ko po ito)
      Magpapagawa nalang po kami ng SPA (anong date po). I think this is the best advice.
      Maraming salamat po talaga attorney, hulog po kayo ng langit, wala po kasi ako magpatanungan. Nasstress napo ako.
      (may nag advise nga po sa akin papirmahan nalang daw po sa deed of sale sa 2nd page, kaso paano yung 1st page nakalagay lang dun ang name ng ama.
