How should you pay the estate taxes of your deceased parents?

  • What if you’re going to sell a property you inherited but it’s still in the name of your parents? How should you settle the estates of a deceased married couple? Where should you pay the estate tax for each of them?
    A lot of the properties we help buy or sell, are usually inherited properties that are still in the name of the parents, grandparents, or even siblings of grandparents. And the big problem here which complicates the sale is that all their estates have not yet been settled.
    This is the question of one of our viewers, Anthony and he writes:
    “Property is located in QC with both names under mother and father. Mother died in the province as indicated in the death cert. Father died in QC as indicated in death cert. My father died a few years after my mother. Will the estate tax be settled 50% in the province and 50% in QC?”

Attirney ang taning ko po ang minana ng asawa ko ay bili ng mga magulang niya tapos napatitulohan na nasa titulo ay ang mga magulang nya under sa representative sa pangaln ng may ari. Benenta namin at pinakuha kami ng estate. Kukuha kami ng PSA ng namatay na seller ng lote na binili ng mga magulang kc nakapangalan pa raw sa seller

    How cn we (two remaining cumpolsory heirs-who have not sold our shares) settle d Estate Tax : when there was NO EJS b4 partition; only Internal arrangement/partition, among five siblings. The three who sold their shares have not settled d Estate Tax. Hence, d Mun. Assessor's records show that d 5-hectare estate s still intact, thus, we/two remaining owners are compelled to pay d Real Property Tax for d whole 5-ha area.

    Dear Atty,
    Namatay po ang Nanay namin noong 2015 na walang nangyaring hatian sa mga ariarian nila ng amin tatay. Wala pong Estate Tax na binayaran at wala rin EJS na nangyari. Buong akala namin na otomatik na sa Tatay namin mapupunta dahil nakapangalan naman sa kanilang mag-asawa.
    Namatay ang Tatay namin noong Nov. 13, 2021. Bilang mga naiwan na walong (8) magkakapatid, nagkaroon na kami ng kasunduan kung paano ang hatian at pumayag naman na ang lahat.
    Ang mga bilang ng ari-arian na naiwan na puro Real Estate ng aming magulang ay hindi nagbago mula noong namatay si Nanay at hanggang sa namatay din si Tatay.
    1. Paano po namin babayaran ang Estate Tax noong namatay ang aming Nanay?
    2. At paano yung hatian dapat na ginawa noon na hindi nagawa? Yun po bang EJS na ginawa namin ngayon, puwede na rin yun ang EJS na isusumite namin sa panig ng Nanay ko.
    Pagsabayin na lang po sa iisang BIR Form o dalawang BIR Forms?
    3. Kung babayaran namin nga Estate Tax noong namatay si Nanay, siyempre iba na yung Estate tax na babayaran ngayon o babayaran uli kasi panibangong transfer tax. Paano babayaran ang Estate tax noong namatay si Nanay?
    4. Puwede bang magbayad na lang kami ng Estate tax ni Nanay na 50% na kanyang hati. Wala namang actual transfer ng properies noon, kaya palagay ko po hindi kami magbabayad ng transfer tax kundi Estate Tax lang.
    %. Yung sa Transfer o Donor's tax, gagawin na namin ngayon ang pagbabayad dahil namatay na si Tatay o parehas na silang namatay.

    In my personal observation hindi tlaga ito kdalasan ng tama npapatupad as described in video As in meron STOP n npktagal ? as hindi n usad to the end result n dapat m transfer to Heirs ang property after deceased n parent or both parents for example

    Atty good day. Ask ko lang. Ang parent nila may 5 parcel of lang in diff place in the same provinec. Ang tanunh ko nabikl ko yung isang parcel , yung ang bayaran sa estate tax lang bayaran? Ma sama ba yung ibang apat na percel? Kasi yung ibang parcel hindi na sila interesado. Kaya masama ba yung iba parcel?

    Sir both parents ko po patay na Halos 6 months lang pagitan nauna ang mommy ko, then naka received ako today nang Inheritance tax return. Diko siya maintindihan. Mommy ko po ay namatay dito sa province, pero citizen po siya sa Netherland. Ano po ba ibig sabihin nito?? May makukuha ba ako or ako magbabayad? Please let me know po.

    What if estate was not settled for both descended for multiple properties but now the children only wants to sell one piece of property?do we have to settle all the estate tax properties own by the descendents in one process or only only for the particular property?

I have a question to ask regarding po sa estate of tax yung grandfather ko namatay napo sa kanya nakapangalan yung title nglupa and ibebenta po yung property bali hahatiin ng mga anak nya yung minanang lupa bali yung tatay ko anak ni lolo pero namatay na po year2018 and now meron daw ppo kaming babayaran na compromise tax penalty na 5,000 po ,
    concern ko lng po tama po ba na magbabayad pa kami ng compromise tax kahit wala pa syang lupa na nakapangalan sa kanya?

    What if the only property left by the only living parent is the family home? is it also subject to estate tax or exempted? Thank you.

    May judicial order na po. Ipinatutupad na lang po ang compromise agreement ng korte na pinirmaan ng mga heirs.
    Mayroon po di ayaw pumirma na i settle na lahat ng bayarin kasama napo taxes for 20 yrs na po. Can we proceed to pursue the processing of the settlement by complyingnwith the BIR requirements on how to pay the estate taxes.
    Is it necessary that all heirs should sign in order to comply to pursue the settlement???

Considering may judicial order na po, I think best person to answer your question would be the lawyer who handled the case for you to ensure that all your actions would be consistent. The handling lawyer would be aware of any facts or possible complications that may arise. Your lawyer is in the best position to advise you at this point. :)

    wala po kayang amnesty sa estate tax ng namatay from January 2018 up to present?
    gusto sana namin i-settle yung estate tax ng father namin died on march 2019, pero baka sobrang laki ng interest, surcharge at compromise penalty.

    At the time of my wife's death in 2020, we live in Caloocan City. However, the estate tax I need to settle pertains to our conjugal property situated in Marilao, Bulacan which we have yet to move in to this day. It has already been fully paid with Pagibig Fund as covered by the mortage insurance. My question is should I file the estate tax with the RDO based in Caloocan as this was her place of residency at the time of her death or should I file it with the RDO in Bulacan who has jurisdiction over the location of our property there?     Mga sir ask ko lang po 2015 po kc namatay mom ko at still wla pa po ung Title galing sa BFS di rin po ako nkpagfile ng estate tax.     Good day po, pwede po ba na ang babayaran lang ng estate tax ay ung portion lang ng ibebenta galing sa mas malaking lote? meron po kasi akong bibilin na property pero ang meron lang sila eh tax declaration ng buong lote (1.8has) tapos 1000sqm lang bibilin ko.     We are trying to avail of the Estate tax amnesty deadline but our parents also left us with delinquent Real property tax. Can we combine both taxes in one transaction?

    HI po sirs! Do I need to pay estate tax in this scenario. Property and house are in co owned by 2 couples. One of the spouse died on Oct 2015. The remaining owners want to remove the name of the deceased spouse from the title. Hindi po mamanahin or transfer of property just removing the name of the deceased spouse po.Thank you so much and God bless.

    Attorney ask lang po, ipapa ammend po ang deed of sale, dahil hindi naka pirma yung anak sa deed of Sale.(co-owner) ama lang naka pirma.
    Buyer po ako, ano po pwede namin ipagawa na supplemental document para maisama ang pirma at pangalan ng anak sa deed of sale.

    Ask lang po attorney, Buyer po ako, pwede po ba ako ang magprocess ng estate tax (may Extrajudicial settlement of estate March 2021 - (hindi po na publishang EJS) and deed of sale May 2022 separate documents). Ok lang poba ito, o dapat mag ka pareho po ang date ng extra judicial settlement at deed of sale
    Concern ko po: yung lote lang po ba na Nabili ko sa seller ang Subject sa estate tax. Hindi na po ba Masasangkot ang iba pa nilang property. Please advise po. Maraming Salamat po.
