    Paano po ang hatian ng estate ng lot property if co-owned ng 2 magkapatid noong single pa sila? Namatay na po ang isang kapatid na may isang anak at buhay na asawa...at buhay pa iyong isang kapatid na co-owner na nanatiling dalaga. Is there such term paraphernalia property at batas ng hatian?

    Magandang tanghali po Atty, paki topic kung gaanon khalaga itong EJS sa mga heirs at ano mangyayari kpag isa sa mga heirs ay nmatay na. Mag aaply p b ng panibagong EJS at estate tax sa yumaong EJS member. O ano mas magamda? Pwede bng gumawa sa una pa lang EJS ang heirs n npagkasunduan n pwede kaagad ibenta nila ito? Paano po pala kung 2 U. S citizen at 2 ay dual citizen ang heirs .pwede pa bang may partition din sila sa mana ng lupa at bank accounts ng yumaong nilang magulang?

    Question: Nakabili ako ng lupa na 217 sq meters tax dec only and classified as irrigated riceland. Namatay na po ang nakapangalan sa tax dec nito pero mas naunang namatay ang kanyang asawang lalaki. Ngayon meron silang 1 anak na babae.
    Ang nag iisang anak na babaeng ito ang nagbenta sa akin ng parcel of land na ito.
    Ano po ba dapat ipagawa ko: DEED OF ADJUDICATION SALE or DEED OF EXTRAJUDICIAL OF SETTLEMENT?

    Atty if the Extra-Judicial Settlements were forged by two out of six signatures? That's the remaining land they submitted for EJS. They already sold some lots after my parents died. And there are still some portions not included just waiting to be sold illegally, it happened on January and the two lawyers refused to issue the Deed of Sale. What do I do Atty. Thank you for shedding lights on my journey.

Pasagot nman po Tanong ko'ng ito: nabili ko po ang lupa CLOA title registered/awarded sa pangalan ng asawang babae yung Asawa ay patay na. May apar na anak.. nagexecute sila ng deed of Sale pero yung Isa anak ay Hindi mentioned sa deed of Sale ang sabi paguwi daw sa abroad papirmahin na Lang sa deed sa baba as winess po ok lng po ba yun.. then kailangan po ba nagexecute lahat sila ng deed of extrajudicial settlement of estate para mapatitulohan ng bago in my favor ang lupa na nabili ko? And how about po sa estate tax nagbabayad pa din po ba?

    Question lang po....my single mom died w/o a written will. My brother died in the US but have an illegitimate daughter left in the Phil, however, he has a wife there in the US w/ no children. I am the only descending heir left alive. Since the land title was lost. what do I need to have? self-adjudication or extra judicial settlement?     Atty, ano po ang gagawin ko?Kasi po nmatay n yung mader ko last month at may isa apt at mga titulo ng lupa n nkapangalan sa kanya at meron din sia pera sa bangko militar.     Atty. Magandang araw po. Paano po kung ang paghahatian lang ni ng mga heirs is ang lupa lang po. Pero may nakatayong bahay sa lupa na namana nila, pero yung bahay po na yun is yung isang heirs lang po ang gumastos. Tapos beninta ng 2 heirs ang ang portion na parti nila kasama na doon yung sakop ng bahay. Pero hindi alam ng isang kapatid nila. Kasi 3 po silang magkakapatid. Yung nagpagawa ng bahay hindi nya alam ba beninta na pala ng dalawa nyang kapatid yung portion nila sa iba. Pwede pa po yun mahabol? Salamat po.

    Atty R.Batu, please I need your advice. Both our parent died 33 days gaps only on 1993. Got married overseas and my younger brother didn't tell me that my mother died until my father died. Two weeks later, hee wrote a letter in a very thick envelope saying that they're all died and I'm going to sell a land to pay for the cost for hospitalisation. I answered you don't need to because our father has the SSS and the Veterans to cover the cost. He didnt listen and sold one lot and the proceeds was divided among 3 siblings only out of 8 heirs. The remaining lots were presented to a businessman who made the Extra-Judicial Settlement and only 2 were presents out of 8 heirs. These 2 brothers who were attented forged all of our 6 signatures. The partitions were not equal. These two have had 1000sqm while the rest have had 600sqm to 800sqm only. One of my brother who did forged our signatures and 1 sister sold their lots and quickly built their house in my lot. After one year my brother sold part and parcel of my lot and was acquired a OCT. I feel sorry for them and I went home and I made a written contract that they can stay in my lot on their life time. Recently he died and I thought his occupation has finished but now his wife and son rented out the house and the part and parcel of my lot that has been sold was now a sari sari store and also rented out . They collected the rent in my place and I'm going to pay the estate tax by January. According to the EJS even though it was forged, that lot belong to me. Can I waive the said lot because I'm the rightful owner even though it was forged? The Assessors office told me that the BIR can't compute because it does not match the area from the original land. One brother didn't come back for his lot for 40yrs. I would like to buy his and the proceeds I will divide it to those having less including myself If the forger brother won't sign? What would I do? Please advice me I'll be home January to transfer title to my name. Thank you Atty your advice is highly appreciated.🙏🙏🙏🙏

May problema po kasi kami dahil hindi po na recognize yong lola ko bilang heirs, bali 7 po sila magkakapatid bunso lola ko, tapos may 2 anak papa nya sa ika lawang asawa. Ganito po atty. Yong anak po ng isa sa mga heirs ay ayaw po kami erecognize kasi hindi daw po anak si lola ko po kahit may Baptism cert, marraige cert, at birth cert. Ang lola na magpapatunay na anak po sa at isa sya sa heirs. Ipinakita na po namin sa kanila docs na magpapatunay pru ayaw po nila isama lola ko, tapos minamadali po nila pagprocessyong lupa kahit po alam nila na anak si lola Kaso hindi po nila ererecognize lola ko tapos may subdivision na po sa lupa, tapos nalaman namin na wala po talaga sa subdivision ng lupa ang lola ko po, nakapangalan po ang subdivided na lupa sa mga heirs maliban po sa lola ko, tapos nalaman namin namagbibinta napo sila ng lupa. May tatlong portion po sa lupa ang isa may title na nakalagay heirs of Andres Tidalgo (papa ng lola ko), yong dalawang portion ay tax decleration po at nahati2 na po sa heirs maliban sa lola ko. Ano po ggawin namin Atty. Salamat po sa tugon. Paano po at saan mag file ng claims against the estate?

    Good day Atty! Ask ko lang po. If conjugal property and the wife died. Hindi naasikaso ng surviving spouse and their children ang EJS and estate tax. Then, after 22 years, the father died.     Hi atty.,
    Napanuod ko rin po yung isang video mo at maganda yung mga content mo kaya nagsubs na po ako.
    Paano po kung may binibenta pong lupa na sinasabi ng seller at ng ahente na original yung titulo na hawak ni seller tapos pinaverify ko po sa rd yun po pala ay nakapangalan pa sa NHA. At wala pa talagang titulo. Pangatlong seller napo yung nagbebenta. May naglalakad po ng mga papers para maayos yung mga documents ng seller pero sinagot na ni buyer kasi yung nagpaprocess ang sabi maayos daw po sa mababang presyo. Binibenta po yung lupa sa napakataas na halaga na parang may titulo. Pwede pa po bang umatras kung ang buyer naman po ang gumagastos ng mga documents at nalaman namin na mas malaki pa talaga ang magagastos sa NHA pala kumpara sa sinabi ng nagpaprocess ng mga document. Wala pa pong pinirmahan na kasunduan kasi ang buyer po ang gumagastos at di pa sigurado kung may humabol sa lupa na binibenta kasi nagpapublish pa po. Paano po kung hindi na kaya ng buyer yung gagastusin para lang mapatituluhan at mabayaran yung mga tax na dapat sagot ng seller?kasi nagbaba ng presyo yung seller magkano lang po para panglakad daw para sa mga titulo at tax pero kulang po ang budget na naitawad sa kanila. Tapos ang seller ayaw na magpababa ng presyo at ngayon yung seller lalo na ang ahente at nagpaprocess ng dokumento at kami ang gumagastos ay tinatakot si buyer na magkakabreach of contract daw po sa seller na dapat bayaran yung seller kung magkano daw po ang napagusapan. E wala pa naman pong assurance ang buyer na wala talagang maghahabol kaya po si buyer nagpalakad para mapublish sa newspaper. Wala parin naman pong pinirmahan na kasunduan. May karapatan po ba na si ahente, seller at yung nagpaprocess ng document na takutin ang buyer kahit na wala naman silang ginastos at rights lang palang ang binibenta nila?     My husband passed away already. Is there a need for me as surviving spouse of a conjugal property (house and lot only) to transfer the title under my name and the heirs (3 sons) if and when I sold the property ? Original tile of property is under my husband and me. The property is only consist of 300 sq meters lot and single story 2 bedroom house. Am living in California and I want to settle this documents in preparation to sell. Please advise to the next proper action to settle this matter. The property is in the Philippines. All real estate taxes are up to date in payment. No mortgage loan.

      if you want to keep it, transfer it under your name and kids and execute extra judicial settlement. If you want to sell, execute an extrajudicial settlement with sale [assuming the kids are all of legal age]

      if done within the 2 year lien under rule 74, pwede po questionin or pa void ang sale. Pag lampas na 2 years pero may knowledge sa buyer about omitted heir, pede pa rin question. If after 2 years, at in good faith si buyer, yung omitted heir can go after the co-heirs who sold it. kaya dapat after 2 years, file kaagad petition to cancel 2 year lien si buyer

Nagfile pala brother ko ng self-adjudication at may fake deed of donation pa, they forged my mom's signature. Nakalusot sya sa unang property naibenta nya then inulit nyang yung process sa pangalawang property nagtataka ako bakit di ako nakatanggap ng letter dun sa first property. I think sa unang property may conspiracy, tinulungan sya ng buyer tapos inulit nya sa pangalawa at di na nakalusot kasi nakatanggap ako ng sulat from the court. :(

      Hello jasmin. Upon the death of your father naging heir si mama mo. Therefore, ang share nia equivalent sa 1 share ng anak. In your case, ikaw, your mom and your 3 kapatid mag hati equally
