According to section 2: a court where an application to a search warrant shall be filed.
In paragraph 1 of section 2, you can file or apply for a search warrant in any court within the territorial jurisdiction a crime was committed.
Paragraph 2, if the criminal action has been filed, the application shall only be made in the court where the criminal action is pending, however, if there is or there are compelling reasons that your application within the territorial jurisdiction is unavailable, you can file or submit your application to any court within the judicial region where the crime was committed or any court within the judicial region.

Where to Apply for Search Warrant?
• Under Section 2 of Rule 126 of Criminal Procedures Court where an application for a search warrant shall be filed . An application for a search warrant shall be filed with the following:
I. Any court within whose territorial jurisdiction a crime was committed.
• meaning you can appy for a search warrant in the nearest court in the said place where the crimes commited.
II. For compelling reasons stated in the application, any court within the judicial region where the crime was committed if the place of the commission of the crime is known, or any court within the judicial region where the warrant shall be enforced.
• and if the nearest court in the said place where crime commited was closed, you can also apply for a search warramt to the next city but in the same region, and you must also indicate in the application the compelling reasons.
However, if the criminal action has already been filed, the application shall only be made in the court where the criminal action is pending.

Section 2 of Rule 126 of the Rules of Court states that Court where an application for a search warrant shall be filed with the following:
(a) Any court within whose territorial jurisdiction a crime was committed.
(b) For compelling reasons stated in the application, any court within the judicial region where the crime was committed if the place of the commission of the crime is known, or any court within the judicial region where the warrant shall be enforced.

However, if the criminal action has already been filed, the application shall only be made in the court where the criminal action is pending
-Based on paragraph (b) of the same rule, there is an exception wherein a search warrant can be applied in a court within the judicial region where the crime was committed. But the police officer must have a compelling reason for him to apply a search warrant in any court in the region where the crime happened.
-If the criminal action has already been filed, the police officer doesn't have any choice but to apply the search warrant to the court where the criminal action is pending.

Where to apply for search warrant?
Stated in Rule 126 of Criminal Procedure
Section 2. Court where application for search warrant shall be filed.
(a) Any court within whose territorial jurisdiction a crime was committed.
▪️A search warrant should be requested to the local court where the crime has happened. And if there's a valid reason you can't file for a search warrant in your locality, you can request it from other court within the region of the place you need to search and seize as stated in paragraph;
(b) For compelling reasons stated in the application, any court within the judicial region where the crime was committed if the place of the commission of the crime is known, or any court court within the judicial region where the warrant shall be enforced.
▪️When requesting a search warrant at other court within the judicial region, the applicant should include the compelling reason why they weren't able to apply for a search warrant at their local court.
However, if the criminal action has already been filed, the application shall only be made in court where the criminal action is pending.

Where to Apply for Search Warrant?
- According to section 2: a court where an application to a search warrant shall be filed.
- All applications for search warrants, if filed with the Executive Judge, shall be assigned, by raffle, to a judge within his administrative area, under whose direction the search warrant shall be issued for the search and seizure of personal property.
- After the application has been raffled and distributed to a Branch, the judge who is assigned to conduct the examination of the complainant and witnesses should immediately act on the same, considering that time element and possible leakage of information are primary considerations in the issuance of search warrants and seizure.

As a General rule, we can apply for search warrant at any court within whose territorial jurisdiction a crime was committed, but if the nearest court are closed or not available, you may apply to another court in same region or within the judicial region with compelling reasons stated in the application. As a general rule, the application for search warrant should be within the territorial jurisdiction a crime was committed and if all the court is not available there's the very significant exception For compelling reasons stated in the application, to apply in any court within the judicual region in other words, in application for search warrant can be apply within or outside of the territorial jurisdiction a crime was committed.
