Under Section 5 Rule 113 - A peace officer or a private person may, without a warrant, arrest a person: (A) IN FLAGRANTE DELICTO -in American they call it "CAUGHT IN THE ACT" - one of the most famous exceptions to the rule on a warrantless arrest. (B) HOT PURSUIT - the crime happened that you didn't witnessesed it but the crime just happened minutes ago. - in other book, they called it "FRESH PURSUIT". (C) PRISONER ARREST - if the PDL run away from the prison and if you saw the PDL around the area, you can arrest it even without the warrant of arrest.

Here is my insight about Lesson 15; When is warrantless arrest is lawful -according to Section 2 of Articles 3, 1997 constitution no arrest can be made without a warrant of arrest as a general rule. In general rule Warrant less Arrest is not lawful or unlawful not a valid. This will be valid when exceptions are entered. Under Section 5 of Rule 113 of our criminal procedure there are three exceptions to warrantless arrest. We cannot arrest someone if we don’t have warrant of arrest of course basic rules but there are exceptions to make arrest valid. So, when will be a warrantless arrest be lawful? There are three exceptions to this; 1. IN FLAGRANTE DELICTO - In America they call it caught in the act. - The one of the most famous exceptions to the rule on warrant less arrest. 2. HOT PURSUIT - Don't have seen it but it's powerful. - Personal knowledge based probable cause. - In another book it is called as well as "FRESH PURSUIT". 3. PRISONER ARREST • The PDL flees and you see that even if you do not have a warrant of arrest according to the law, you can arrest that person valid such as cannot be charged because you are protected by Paragraph C. When is warrantless arrest is lawful
-according to Section 2 of Articles 3, 1997 constitution no arrest can be made without a warrant of arrest as a general rule.
In general rule Warrant less Arrest is not lawful or unlawful not a valid. This will be valid when exceptions are entered.
Under Section 5 of Rule 113 of our criminal procedure there are three exceptions to warrantless arrest. We cannot arrest someone if we don’t have warrant of arrest of course basic rules but there are exceptions to make arrest valid.
So, when will be a warrantless arrest be lawful?
There are three exceptions to this;
1. IN FLAGRANTE DELICTO
- In America they call it caught in the act.
- The one of the most famous exceptions to the rule on warrant less arrest.
2. HOT PURSUIT
- Don't have seen it but it's powerful.
- Personal knowledge based probable cause.
- In another book it is called as well as "FRESH PURSUIT".
3. PRISONER ARREST
• The PDL flees and you see that even if you do not have a warrant of arrest according to the law, you can arrest that person valid such as cannot be charged because you are protected by Paragraph C. Section 5 of rule 113 of our criminal procedure.

Discuss the three basic instances when a warrantless arrest is lawful:
Under Rule 113 Section 5 of Criminal Procedure Arrest
without warrant; when lawful.
-A peace officer or a private person may, without a warrant, arrest a person
I. In flagrante delicto
The arrest without a warrant is lawful because it was caught in the act.
II. Hot pursuit
When an offense has been committed and the authority has a personal knowledge
of facts that the person committed a crime.
III. Prisoner Arrest
When the prisoner has escaped from a penal place.

Three (3) basic instances when warrantless arrest is lawful.
Section 5. Arrest without warrant; when lawful.
- A peace officer or a private person may, without a warrant, arrest a person:
A. In flagrante Delicto
- Caught in the act
B. Hot Pursuit
- Fresh Pursuit
- The actual crime was not seen, but their is personal knowledge based on probable cause.
C. Prisoner Arrest
- The person who escaped from prison (PDL or Person Deprived of Liberty) can arrest without warrant.
