Good day Atty. This recorded lecture taught me that in searching a property or house, a withness is essential.The warrant must be served in day time but there is an excemption, if the person or place ordered to be searched, in which case a direction may be inserted that it be served at any time of the day and night. 2. WHEN MAY A SEARCH BE MADE?
Sec. 9 Time of making search. - the warrant must direct that it be severd in th day time. unless the affidavit asserts that the property is on the person or in the place ordered to be searched, in whcih case a direction may be inserted that it be seved at any time of the day or night.

I've learned that there's no search of house, room, or any other properties shall be made except in the presence of the lawful occupant. There are atleast two witnesses with sufficient age and not a teenager or any member of the family. Who should witness a search?
According to section 8: search of the house, room, or premises to be made in presence of two witnesses.
-Searching for properties without any members of the family is prohibited. There must be two witnesses of sufficient age, lawful occupant, or any members of the family and discretion residing in the same locality. These witnesses are also a protection to the officers who conduct search warrants for them to not be accused of any lost properties during search and seizure.
When maybe a search is made?
According to section 9 Time of Making Search.
-The warrant must be served in the daytime unless the affidavit asserts that the properties are on the person or place ordered to be searched, in which case can be served at any time of the day or night if necessary.

Thank you Justice Buddy! I have learned about the witnesses and the amount of time it takes to do a search. No search shall be conducted unless the lawful occupant or a family member is present. Two witnesses of legal age and judgment are required for the search. I've also learned about the length of time it takes to conduct a search. Unless it is required or there are valid grounds to serve it at any time of day or night, it must be served during the day.

Witnesses and Time of Making search
Section 8. Search of house room or premisesto be made in presence of two witnesses. - search shall be made in the presence of the lawful any member of his family ,two witnesses of sufficient age and discretion residing in the same locality.
Section 9: search warrant must be direct that it be served in the day time in general rule but their an exemption so it can be any time of the day or night.

In this lesson I've learned our rules of court set a rule regarding who should be present in conducting the search which is Section 8. Search of house, room or premises to be made in presence of two (2) witnesses. You cannot enter a house or property without a person, if the law occupant is not available the witness can be member of the family or two witnesses of sufficient age and discretion residing in the same locality. When it comes to Time of making Search, as a general rule The Search Warrant must direct that it be served in daytime, we have an exception it is the day and night. But if any member of his family are there, you can go and search. I also learned that the general rule in conducting in search warrant must be done during the day time. However, there is an exception which states that unless the affidavit asserts that the premises are on the person or in the place ordered to be searched.

Tanod). There is no search of a house, room or other premises if there is no presence of lawful occupant or any member of his/her family. If there is no lawful occupant and member in that time, two witnesses of sufficient age and discretion residing in his/her locality will do. Also, I learned that in conducting a search warrant under section 9 it should be day time and that is a general time. However, there is an exception if Law enforcement officers have valid reasons they can allow to conduct it in the night time. Thank you!

Discuss who should witness a search.
Under Rule 126, section 8 - No search of houses, rooms, or any other premises shall be made except in the presence of the lawful occupant thereof or any member of his family or in the absence of the latter, two witnesses of sufficient age and discretion residing in the same locality.
-A police officer should not conduct a search warrant alone, two witnesses are required to be present in making a search because planting of evidence might happen, also it is for the protection of the police officer itself.
-The owner of the property or member of his family must be present at the time of search, in their absence people that are residing in the same locality with sufficient age and discretion can be witnesses.
Good day atty. What i had learned on this topic is the right procedure how to conduct a search warrant , i learned that you must have 2 witnesses with sufficient age and have discussion have an ability to think what is right and what is wrong and it also need that the 2 witnesses is residing in the same locality . Also search warrant is only valid on day time . Thank you for the wonderful information atty.

Sec. 8. Search of house, room, or premises to be made in presence of two witnesses.- No search of a house, room, or any other premises shall be made except in the presence of the lawful occupant thereof or any member of his family or in the absence of the latter, two witnesses of sufficient age and discretion residing in the same locality.
When may a Search be Made?
Sec. 9. Time of making search. - The warrant must direct that it be served in the day time. unless the affidavit asserts that the property is on the person or in the place ordered to be searched, in which case a direction may be inserted that it be served at any time of the day or night.
