Fishing expedition or including many offenses in the search warrant to gather more evidence is not valid. 2.How long is a search warrant valid? First of all there must be probable cause,there is a basis for the crime and what is said in that incident is true.The probable cause must be connected in one specific offense to be determined personally by the judge. As a general rule a search without warrant is invalid or unlawful but there is an exception.
Under Rules 126, section 4 - Search warrant shall not issue except upon probable cause in connection with one specific offense to be determined personally by the judge after examination under oath or affirmation of the complainant and the witness he may produce, and particularly describing the place to be searched and the things to be seized which may be anywhere in the Philippines.
-In applying for a search warrant the judge himself is the one who determines if there is probable cause to issue a search warrant by examining the evidence or witnesses that the complainant may produce.
-The place to be searched and the things to be seized must be specifically described.
-Always remember that a search warrant can only be issued upon probable cause and only for one specific offense. Fishing expedition or including many offenses in the search warrant to gather more evidence is not valid.
2.How long is a search warrant valid?
Under Rule 126, section 10 - A search warrant shall be valid for ten (10) days of its date. Thereafter it shall be void.
-A search warrant is only valid for 10 days, unlike an arrest warrant wherein in 10 days if the person is not already arrested the arresting officer can issue an alias warrant.
-The time that a search should be conducted is only during the day time of any day.

1. What are the Requisites of a Search Warrant?
✔️ Under Rule 126 of the Rules of Court in Section 4. Requisites for issuing search warrant. A search warrant shall not issue except upon probable cause in connection with one specific offense to be determined personally by the judge after examination under oath or affirmation of the complainant and the witness he may produce, and particularly describing the place to be searched and the things to be seized which may be anywhere in the Philippines.
✔️ The condition for issuing a search warrant is that it must have a probable cause related to a crime and be personally determined by a judge.
2. How long is a Search Warrant valid?
✔️ Under Rule 126 of the Rules of Court in Section 10. Validity of search warrant. - A search warrant shall be valid for ten (10) days from its date. Thereafter, it shall be void.
✔️ As a general rule you can only search during daytime, but as an exception it can be done day or night.

Good afternoon Atty. Jeffrey Bajita. In this video, I learned that 10 days is the validity of the search warrant and if it is not done after those days the search warrant will be void. Furthermore, I also learned the requisites for the issuance of a search warrant. A search warrant must have probable cause and it should be connected in only one specific offense. Also in a search warrant, it must contain particularly describing the place or specific place that will be searched. On the other hand, I learned what is the definition of a fishing expedition. A fishing expedition is the wrong practices that law enforcement officer do sometimes, they are just likely fishing any evidence and they are not sure about it. Thank you!
