    I live in Louisiana, my wife and I raise our two grandchildren. We know first hand how the system works here. The rapist knows someone in a position and phone calls were made. I'm so glad this has made nationwide news. I hope they dig deep and exposed more judicial corruption.

      The Judge, the Sheriff, the Governor and the Dad are in child s.x ring and they're abusing this child. They're drugging her and abusing her at night, she even went to the doctor and confirmed she was being abused. I wouldn't be surprised if the poor girl "goes missing" and they cover it up as a runaway in order to hide what they've done.

    The other report they did also said the daughter has been drugged and raped twice by the father yet the authorities did not move on that either. This is an insane case.

      We don't know what was done. In that interview, the mother and her advocate wouldn't say, in fear of jeopardizing the case. An exam was done, but we don't know if the police or CPS were contacted.

    Unforgivable that judge needs to lose his license and kicked from office. This is just disgusting and confusing. I have been studying law in college so I can one day be a lawyer and I cannot understand how this possibly happened. Such an open and shut case.

      Poorly written laws can often explain baffling decisions. The 2nd Amendment is a good example. Custody cases are not considered criminal and may not be entered into evidence.

      The story seems too odd. Why is not the daughter standing next to her mother instead of an activist making the protest? She is 16,not a little girl, she knows what she wants and can speak out ,she is not behind bars. She is the primary subject in this story and what matters is her wish.

      @@arabellabirnbaum3997 Watch the other story, also by Banfield, that explains in more detail. The rapist was given full custody of the child. He prevents mom from talking to her. The corrupt judge ruled mom can only have supervised visits. There's many more horrific details as well.

    The judge, D.A., Police Dept. and the detective that took her statement 16 years ago should all be held liable. What happened to the evidence? This goes deeper than just the judge getting his ear bent.

    How did this guy not get prison time for this! My Daughter at 14 was statutory raped by a man who was 34 years old. She as a result got pregnant and had the child. He was put in prison had he's parental rights stripped and was for life banned from contacting the child (my granddaughter.) The judge even put it in the order if by some chance the child was to become an adult and reach out that if the rapiest responded he would serve the whole sentence. He was given a long sentence suspended but he still served like 10 years. How can this be happening??? I don't care what the mother has done he is a rapiest. He had sex with a child compared to he's age. She legally like my daughter couldn't consent to it. So legally it is rape and legally he is a rapiest who should have lost any rights to the child

      Someone needs to be held accountable and even the dcs records need to be retrieved if they were even involved and the courts need to go back through this case and that it says on a shelf for seven years someone hasant done thier job wright and most of all where is the avocatefor the child let alone the mother

      Yeah she was in a bar getting drunk at 16 and left the bar with him, so the rest is a he said, she said kind of case especially since no report was filed for over 10 years and she didn't check either of the boxes indicating whether or not she wanted to press charges on the report. She could've got him for carnal knowledge if it was consensual, but that's only a misdemeanor and wouldn't help her case. Plus she didn't file the police report in 2011 when he started the process to gain partial custody.
      So if everything was unsealed maybe we'll find out why she was only given supervised visitation after she lost custody.

Honestly are you really that ignorant that you don't know how to completely fill out a police report to accuse someone of committing a crime against yourself? Not to mention she was very light on actual details of the "alleged" crime and put in information that was completely irrelevant to the investigation of an "alleged" rape. Did you honestly forget that a person is presumed to be innocent until convicted of a crime in our country?
      I not blaming the "alleged" victim since I always ask questions first to gather information, instead of rendering an opinion on scant evidence of an ongoing court case.

    In cases of rape, the father should never have any rights to the child! The poor woman that suffers through giving birth to a child, decides to keep it instead of a abortion or adoption has suffered enough! To allow a convicted rapist to have anything to do with this child is totally ridiculous! He should be held in prison until said child is mature enough to determine whether he or she wants a relationship with their biological Dad!

      She was 16 in a bar with a fake ID. She said she assumed he knew her age. He says she said she was a college student. Apparently ignorance of someone's age is not a defense for statutory rape. I remember being 16 and looking 20 so everyone better start asking for id when they meet someone.
      The custody fight has apparently been going on for years and she was the one to ask him to be involved in the daughter's life to begin with. Custody battles get ugly so who knows who is being honest.

      The child reported that her father drugged and raped her twice. The medical exam concluded evidence proved the girl was raped with force. That's another horrific layer to this case.

      It already has. The daughter had drugs in her system and vaginal tearing on more than one occasion after being in her father's custody. Reports were filed but never investigated.

    Check out the recent video from KRQE News13 in Albuquerque. It's a Dem Mayor city and their Child Protective Service, called CYFD, put an 4 year old boy back with the man who he told hospital workers had been abusing him, when they found he had bruises all over his body in addition to the broken arm he went in for. When the CYFD worker brought it to the attention of her superiors and begged them not to put him back with his abuser, they said "calm down" and put him there anyway. He was later beat to death by the same man, entirely preventable. Search Lawsuit alleges CYFD coverup over 4-year-old's death.

      Yes Otto. I saw that hospital interview of that beautiful, little 4 year old boy. Horrible, what the authorities allowed to happen to him. He needs justice. I’m going to write to this reporter and see if she can help bring that system to light. Totally corrupt, uncaring, lazy social workers being paid to protect children. Collecting that paycheck for not doing the work! I could keep going on and on. I hate to see innocent children hurt by monsters. Especially when it was preventable!

    How does this man speak emphatically about the judge. Evidence was presented. The law is also there. On what basis was the judgement made. The girl is also now sisteen, we can imagine whatever. Who knows what his true intentions are. He can't wait for two more years for the child to decide where she wants to live. He wasn't okay with 50/50 custody? The judge let him have it. They're both questionable.

      I’m guilty of the same views. It’s a Deliverance mentality down there. I suspect the long history of slavery in the south has something to do with us seeing them as backwards and inbreds. I’m sure many down there are normal…but when my sister moved to Louisiana, she feigned a southern accent because “yanks” are not welcome.

It’s not a matter of right/wrong, corruption/non corruption, I’m voicing what tends to a reputation that has taken root. My sister married a Louisiana native. She had to develop a fake southern accent to be accepted because so many southerners believe the south won and the south will rise again. Shocked me. I never think about the civil war…it was settled a long time ago. But many southerners want the old way….which is what? Return to slavery. They need not worry since slaves are everywhere in the US. Waitstaff that are paid $2.13 an hour….”plus tips”, which have to be shared with the bussing staff, hosts and bartenders who are all paid at least minimum wage. The nail salons as well.     I think it’s most valuable to hear you also shared in this, because there remains a deep cognitive dissonance in the global ideals and beliefs, between how we think things are in 2022 America, and how things _actually_ are.
    You’re holding a mirror to our own individual thought processes- and our thought process as a collective.
    We really perceive in a nutshell in America 2022 (and Australia, and England, and France, etc…) the justice system is exactly that- a system of justice.
    Generally, we believe that: it gets things right most of the time; sentences are too short; and while it has a few bad apples, there’s too many checks in place to get away with extreme corruption- if a victim or defendant claims as such, they’re just lying for gain.
    We’re really (including myself) terrifyingly unaware to: the pervasiveness of corruption within the justice system; the levels it goes to, from the ground up; the frequency with which it occurs; how far it spreads beyond the court room (businesses, government); the tactics and methods used; what is being gained; the victims.
    Unfortunately, the only acknowledgment of corruption typically comes in the form of far fetched/unrealistic conspiracy theories, involving child sacrifice and cannibalism, rather than the actual realities- like a rapist, gaining custody of the child conceived as a result of his raping a woman, and being paid child support by his rape victim, before finally sexually abusing the child born from the rape 16 years prior.
    This is where our focus needs to be. The real victims of real corruption that we are really, really blind to.
    This just re-affirms the absolute importance of old-style investigative reporting. This saves lives.
    My strength and love to all the incredibly courageous women and girls involved here.

      The mother bought the sixteen-year-old a cellphone and that's what prompted to have the rapist take her child away from her.

      Right, there is a whole lot of something PERTINENT missing in this. If the daughter was court ordered to not have access to cellphone, internet and or social media sites...and she gave the girl a phone...then SHE SERIOUSLY F@CKED UP.
      I know that kids CAN AND ARE COURT ORDERED NO CELL, NO INTERNET, NO SOCIAL MEDIA for reasons such as abuse of those things. My youngest daughter was court ordered all of that AND NO FRATERNIZING with ANY MALES THAT ARE NOT BLOOD RELATED after I had already taken the cell, net and access to social media from her when she refused to accept my rules and was caught continuing to have contact with older teenage boys and men who were online predators. She didn't think that it was fair for me to forbid her from being able to speak to those p.o.s. I had to do something to show her I RUN THE HOUSEHOLD AND SHE WILL DO AS I SAY EITHER BY CHOICE OR BY FORCE...UP TO HER...EITHER WAY IT WILL STILL BE THE SAME OUTCOME...MY WAY. She found out, there is "no such thing as fair and unfair. There is only RIGHT AND WRONG AND I WAS RIGHT."
      There is also a statute of limitations as far as the mother filing charges of rape against him. She had not blocked the incident in her mind. Therefore she could not claim that she had just recently had a repressed memory come back to her...THAT would be when the time on that statute of limitations would begin ticking. But since this isn't the case...that statute ran out YEARS AGO. And its viewed by the courts as her trying to rehash something that was consensual at the time (although statutory rape by definition...it was not forcible rape) and that the sole reason behind her allegations now is to defame him in retaliation for getting custody of the child. I dont doubt that giving the girl the cellphone was viewed as CONTEMPT of the courts and UNDERMINING his parental authority. Who's to say if she had not COMMITTED PARENTAL ALIENATION during the time they shared custody. If she did...SHE SEALED THE DEAL AND BROUGHT IT ALL ON HERSELF with that stupid b.s. Playing games with the family courts, using the kids as pawns WILL DO IT EVERY TIME

      Evidently, the sperm donor had partial custody, but was upset that the daughter had a phone that he couldn't access. The mother was ordered not to provide the daughter a phone. It's not clear how she got one, but she did, and the sperm donor went to the judge to say mom defied orders. The judge then ordered him to get full custody. Hopefully, now that records are unsealed, his written reasonings behind this will be out in the open.

    Crystal or Crysta, take the lawyer's offer. He can co-counsel and he seemed very confident. Call him please and let him help you and your daughter get back together, and that piece of shit put in prison. I would also after that, sue for damages. I would recommend that this judge be removed and investigated. His decision was worrisome and unfit to be in a position of power. This is now more troubling because I would remove the judge until an inquiry is completed. Which may mean all rape cases before this judge be reviewed. Wow nothing shocks me anymore
