She is 16 now and claiming her father has sexually assaulted her and there is proof from doctors that he raped her as well! So, you can't really deny that when there is proof from doctors! The more interesting question is why either parent is controlling in this case. In my state, when you're 14 or older--sometimes even younger if the judge determines it is appropriate--and your parents, bio or otherwise, are battling over custody or anything else about your life, _you_ and your best interests are given primary consideration by the court regardless of custodial "rights." So long as the daughter is informed about the circumstances, which she undoubtedly has been by now, this should not be primarily about the parents and certainly not decided in the media. It's her life and her relationships.

@@laverite1050 I don't think people realize how often accusations of this type are made in family court, and in the media, if the parties think it might work to advantage their cause. Alleging domestic violence and mental unfitness are part of that circus, too. This has just become part of the family-court landscape with various assessments being done to try to prove or disprove the many allegations. As with divorce generally, those who suffer the most are not the adults trying to smear each other. In fact, divorce used to carry a lot of stigma for that reason, but we have lost that moral footing socially.

She never claimed rape until the father got full custody because she took the child to visit the other man who was DNA tested in prison after the court ordered her to stop. The real story is NEVER have sex with strangers you meet in a bar no matter how old you are. I've never heard of this bar and it's employees probably didn't know her age because it's too busy to do their job if they were short staffed, this isn't a justified reason to serve a minor liquor to the point she's admitted being drunk which was a mistake in her judgment as a teenager.

I have also lived in small town in California and in 1974 I took off with my boyfriend who was 18, I was 14, and when we came back the judge tried to charge him with statutory rape! They made me go to a Dr. And he testified in court that I had never had sex, and so they charged h with taking me over county lines, and gave him the choice of 16 mos. in prison or join the military. Military it was. My parents didn't want him charged with anything, cuz they believed me and him that we had not had sex, and forgave us for taking off.

What was she doing in a bar associating with men during high school? If I was a young man partying or drinking in a bar, I would probably not be in a state of mind to slow down and make these minute calculations. The biological father/rapist was paying child support to the mother, before all these problems started and he got custody. So there he definitely knew about them and their life’s. Not sure though if he had a relationship with the girl.
The Judge, the Sheriff, the Governor and the Dad are in child s.x ring and they're abusing this child. They're drugging her and abusing her at night, she even went to the doctor and confirmed she was being abused. I wouldn't be surprised if the poor girl "goes missing" and they cover it up as a runaway in order to hide what they've done.

How many others has had to go through a wrongful custody battle. She's not the only one!
The friends of the judge have been doing a sort of spin control for him. He is being called "a good judge" who would likely have gone by hearsay to rule on the case and not intentionally sent the daughter into harms way. It was explained a trusted source would have put a word in the ear of the judge that the father/rapist was "a good man" and that the woman is "a liar" influencing the judge to rule against the woman...regardless of the evidence or testimony. The judge even made a custody decision behind close doors with zero input from the mother or her attorney. The judge also refuses to review the birth certificates of the mother or daughter or the prior police report as evidence in the custody case according her female lawyer. Good o'le boy network behavior plain and simple. Every day "justice" in the state of Louisiana.

I am glad this lady is getting the help, that I never got. When I got divorced because of domestic violence. The judge said that my daughter did not have to be around her father because of the inappropriate touching. But then ordered that my former spouse had visitation rights with my sons. My former spouse then exacted what is called parental alienation. Brainwashing them into believing that the only reason he acted horribly was because of me. I now have two sons that I haven't seen in 15 years. Even though my former spouse was proven through solid evidence to be the monster that he is.

Yes but this case is not going to go in her direction you don't get to call rape nearly seventeen years after the fact when you're losing a custody because you kept somebody's child hidden from them from a one-night stand or she should have never been and he can't say people should have just assumed that she was under-age because most people assume that everybody in a bar has been id'd by the bar staff so if you want to think about it the bar should be held accountable for not ideen people properly and putting men at risk for being interacting with underage people that they believe are legal age because one they're being told they're illegal age and two because they actually made it into the bar

Glad someone else is saying this.... She was in a bar, drinking, with a FAKE ID and she admittedly never told him how old she was. Most people would assume that you're dealing with an adult while in an all adult setting. I also heard she had him and 2 other men tested for paternity years ago.... Sounds pretty sketchy to me if you're trying to avoid your rapist getting a hold of your kid. Best way to make sure that happens is to establish legal paternity 🙄

The mother bought the daughter a cell that the father did not have access to, so the judge ruled the daughter was not allowed to have a cell phone at all. The judge then granted full custody to the father. The mother got supervised visits only. She was not allowed to see or talk to her daughter. The kicker is the daughter is now 16 and alleges sexual abuse by the father. They have evidence of it! The judge has overstepped, ignored blatant evidence of the mother having been raped by the father, and the mother is a great mom. That judge is just disgusting.
The father alleges the mom gave a phone to her despite financial records showing otherwise. Not enough grounds for removal. The r@pist father is connected politically

I'm adopted and my birth mother told me that she was raped. Alot to process afterwards & thank goodness i had an amazing family to help me through. I hope this sets precedence from this day forward. Good for this Mother!

B HIGS: I have a cousin who is the sweetest, most loving man in the world. He has a wicked sense of humor and twinkling eyes. Our late grandmother used to say that he was "full of mischief". He has known since birth that he is adopted. After his parents had passed he decided to look for his birth mother. He found out that he was the product of rape. The rapist was never caught. His birth mother was engaged at the time. Her fiance loved her and still wanted to marry her but he just couldn't raise the baby. She told my cousin that she had thought of him every, single day. She gave my family a beautiful gift. Your birth mother did the same for your family. Both families were so blessed. Thank you for sharing your story.
"Having sex with" someone implies both parties participated. Rape is Rape - it's NOT "having sex with" someone!!!
No offense, but rape has not been proven. It is alleged. And it is alleged by someone who was in a bar, drinking illegally with a fake id. That puts a wrench in her credibility. She also did not report it as rape until after he tried to get custody of the child. I’m not supporting him, I’m not supporting her, I’m waiting for all the facts. Because this is a more complicated issue than most people are making it out to be.
It sounds like this was "consensual" sex, with a child age 16, which would be rape. He may not have known for sure, but he knew she was very young. He shouldn't have touched her without knowing for sure.

Thank god this lawyer is helping her! I have been so unsettled about this case. It's like a bad nightmare that's real. I wish this story was fiction but it's sadly not. The judicial system is seriously broken for it to do this.

This story was just outrageous! And to the Judge who awarded custody to him despite the statutory incident. Not to mention the officers/detectives who failed to press charges on him. The privilege and entitlement of some people. SMH!
She agreed to joint custody when the father found out he had a daughter. She then five years later after failing to remember to mention this to the judge reports it to police but doesn't follow up with Police on pursuing it or provide any more story. Stilllllll five more years go by until he now has full custody due to her breaking the court recorded custody agreement by allowing the teen to have 18 boyfriend overnight, And unsafe conduct by having frequent men, different men overnight all the whole time getting married three different times in six years. I hope you seriously consider he has never been charged or accused of rape by anyone other than,. Oh yeah. Miss i forgot to tell you my joint custody partner raped me when i was 16! She's never going to get the court to pursue this now and with no evidence besides her obvious lies it's over and always was.
You have to wonder about the Judges sexual age preferences.
The judge's friends stated in interviews that he is a "good judge" but would take the word of a known person putting "a bug in his ear" that the rapist/father was a "good man" and the mother was "a liar." The judge would then rule in favor of the man. Good o'le boys network, plain and simple.
Until a few weeks ago the rapist/father had a law enforcement badge/shield posted on his social media but has since taken it down. It's not uncommon for pedophiles to hide behind a respectable reputation to avoid suspension or gain trust. The trial on this may get complicated. The rapist/father is already slinging quite a bit of dust.
This is good news, I remember when I saw this story a week ago, so happy to hear the daughter is out of his house, hopefully she will be reunited with her mom soon, my thoughts and prayers are with this family

No, the system failed the father. Girl goes to a bar to pick somebody up and succeeds. Gets knocked up. Now years later, when real father finds out he takes custody because " mom" is a basket case. This guy didn't " rape" her, and I'd bet dollars to doughnuts that she's "working off " her lawyer's fees.

The daughter reported rape back in FEBRUARY!!!! And now she is removed from the home. What the hell did the law do about this???? The cops, judge and child PROTECTIVE services failed this child. Shame shame on all of them.

OMG... Thank God I just seen the story when she said she lost her daughter to her rapist and had to pay him child support. Thank you to the atty that did this for her and her daughter. Thank you to everyone that helped in this case. This can't happen our children are not guinea pigs they're humans with human emotions. My heart goes out to the young lady and her mom. well, why did this mother lose custody? That's a big deal for a mother to lose custody. She says the allegations are false, but never says why the daughter was taken away. I feel so sorry for that kid.

This woman was not raped. I’m very sorry if you were, but she was not. She was in a bar with a fake ID, telling everyone that she was 21. She willingly left the bar with the 30 year old man, and went home with him, where consensual sex occurred. She did not report being raped at the time, because she wasn’t raped.

For those gaslighting the mother on the issue of third party custody of the minor. As a lawyer, let me intimate y'all on the legal implications of giving the minor to a third party. In law, when a res (a property/thing) is the subject matter of a litigation, the judge orders the parties to maintain status quo. In other words, neither party is supposed to deal with the subject matter of dispute until the court decides on it and becomes functus officio; defaulters will be guilty of contempt of court ex facie curiae.

There’s no reason why this girl shouldn’t be returned to her mother right away….but I’m glad the court removed her from this man’s house. This woman was 16 when she got pregnant by him….and that child is proof of his being with someone underage and I hope he finally gets charged and punished for it. The law never did anything about him before when they should have. This was a great job by this news agency to step in and get coverage about this story to help this mom and daughter.
