    Thank you atty right now nagprocess ako para mapa anotation mother title tama kayo madami gastos mahal magpasukat pero hati kami seller gawa mas malki kanila 822sqm portion ko 50sqm nasa akin mother title habang inaayos ko gawa sinasangla nila title ako tumubos yun risk kaya sabi ko ako muna hahawak habang pinapatitle ko akin portion issue pa nagbenta na sila iba portion kawawa bumili kasulatan lng hawak 5yrs mga anak may ari madmi pero now alam nya na tama proseso gawa nakita nya na sinusukat sabi ko pagipunan nya habang buhay pa may ari natanda n din malaki problema yun sa huli ,una ko ginawa kuha sa RD malinis naman mother title importante hawak ko orig now waiting sa CAR gawa kabayad lahat tax para ma annotate ng RD matagal aproval sukat denr 3-6months .

      Hello po , tanong ko lang po ano po yung ibig sabihin ng CAR, bumibili po din kasi ako ng mother title , ngayon pinapa check ko po sa registry of deeds Kong ok yung bibilhin ko .

      @@ronaldfrancisco2394 hello po sa BIR yun pag nakabayad na kayo cgt tax ecar Electronic Certificate Authorizing Registration yan ipapasa sa RD WAITING po ako mag 1month na approval ng annotation sana lumabas na gawa 6 months pa labas ng aproval sa denr para magpatitle portion naiinip na seller panay ask sa mother title andon na sa RD

    This is very informative. I used to take an mba class and had a disagreement with a professor about this. The professor was an mtcc judge and I felt that she was not able to explain the risks associated with buying a portion of land from a mother title. As a bank loan officer, I found her answers were somehow insufficient and I was severely discouraged to pursue the mba because of that. You explained it perfectly though. So, thanks.

    Thanks Atty. Sabi ni seller, after daw ng bayaran ay bibgyan kami ng documents ng Deed of Sale, at photocopy ng mother title. Hindi pa daw ma-transfer sa pangalan namin yung property until matapos yung subdivision development plan. Sa subdivision plan po ba, nakalagay na kung sino yung bumili ng portion na lot?

    Hi Atty. Very informative po. Paano po if deed of sale lang ang hawak ni seller at hindi pa nakapangalan kay seller yung lupa. Then ang bibilhin namin is portion lang din nung kabuuan? Legit din po ba ang ganung transaction or kelangan po na nakapangalan muna kay seller yung title bago kami bumili nung portion land? Salamat po.

    Atty pede nyo po ba maexplain tong annotation sa bibilhin kong lupa "The property described in this title is subject to the claims of the creditors and of thw heirs of the deceased sps. Xxx and xxx, within two years from dec 1999."
    ibig sabihin ba safe na bilhin to kasi lagpas na ng 2 year naman. Salamat po

    In regards to forming a Corporation. Is there an existing service where by a Corporation can be set up 40% Foreigner, and 60% Filipino? In some instances it is difficult to find persons. Can the Foreigner join a Corporation with the intent of purchasing land.
    In regards to subdivision of a property. If the engineers have submitted the subdivision to the LMB / Land Titles Office, how long will it take to process the new title? is there an easy step process you can share

    Atty, valid po ba ang Deed of Sale since 1950 na hindi kompleto ng pirma ng co-owners na seller? Wala din pong notaryo yung deed of sale nung buyer. Pwede pa po ba mabawi ng heirs ng seller mula sa buyer ang agricultural land na naka-pangalan pa sa grandfather ng seller?

    Hello attorney salamat po sa ganitong educational blog nyo kasi I’m facing this similar issue right now…ganito po kasi to make the long story short merun na Kami waiver at ung kabila merun order to demolition in couple days sa bahay namin sa Baguio…problema po kasi nalagpasan ng biyenan ko pag tayo ng bahay sa jurisdiction ng claimant sa portion ng lupa Kaya sabi Nya magbayad daw Kami 300K asap para ma wala bisa ng demolition pero wala po Kami ganun halaga pera…at the same we have rights naman din kasi May waiver Kami pero wala pa titulo…ancestral land po sya…is it still possible na overcome etong demolition order ng judge by the means of what we have ung waiver lang ? Pls respond asap po kasi May 3 anak ako mga bata pa nakatira doon at ung ng iisa lolo nila…I have been thinking going to tulfo asap po sa Manila

    Paanu po kung na subdivide na yung land. May mohon na din. Transfer of title n lng ang shoulder nmin. Safe po ba yun. O need pa iverify sa assesors office bago magfully paid. . May chance po ba n marami p kami kailangan ayusin gaya ng sa capital gain tax. Salamat po

    Pano po Atty. kung ung lupang minana namin sa aming mga magulang ay ibinenta at pinatayuan ng mga bahay ng mga kamag-anak namin at pinagbebenta nila gamit ang pinekeng deed of sale and deed of cancellation of adverse claim ng tatay ko at naipalipat na ung titulo sa mga nabili nito? Wala din po clang pre-conversion clearance sa DAR dahil noon pa man ay d namin nasaka ung lupa dahil binahayan na nila ito at ngayon ay naging isa na itong maliit na community.

    Just to add attorney, Tama po ba na hindi lang sa DENR pwede ipa- approve ang subdivision plan , pwede rin po ba na sa LRA ?. In this case can you discuss it as an addition to this topic to make us aware of theprocess.

      Ang DENR po ang may authority to approve subdivision plans. But ultimately, once approved, you will need to submit it to the LRA/ROD for the issuance of new titles.

    Hi Atty. New subs here. Nakabili po ako ng lot sa 1 subd sa Cavite 2.25M fully paid ko na, then need ko daw bayaran 10% of value ng lot amtg to P225k for processing ng transfer and all other taxes. Hindi po ba sobrang mahal iyon, baka po kasi pati CGT ay kasama sa babayaran. Di ba po dpat seller ang mag shoulder non? Thanks in advance po and more power to your vlog. God bless 💖

    Sir, Good morning po. I hope mapansin padin po itong comment ko po ngayon.
    Meron po kasi akong nabili na portion lang po ng lupa, tapos yong binilhan ko po ng lupa ay portion lang din po ang nabili niya sa kabuoang lupa ng first owner po nito. And then kalaunan late ko na pong nalaman na yong binilhan ko po ng lupa ay hendi pa po pala nkapagpa transfer ng ownership sa kanyang lupa dahil yong mga requirements po nito ay deed of sale lang. Though, nag execute nman din po ng deed of sale sakin but i dont think so na sapat na po ito para mkapagpa tranfer po ako ng ownership para sa portion ng lupa na aking nabili.
    Kaya po ako nag comment po dito sir para po magpatulong po sa inyo kong ano po yong mga tamang hakbang na dapat ko pong gawin para makapag process po ako ng ownership ng lupa. salamat po sir and sana po mapansin. God bless po and more power.

    From mother title po ,pwede napo bang transfer agad nun sa portion lang na binili namin? Kasi yung iba naka subdivide na Miata kaya pwede na transfer agad pero kong mother title pa , Tru deed of sale maaring paglabas ng title samin na agad? Diba ma double nun ang transfer

    Atty ask ko lang po what if isecure ko lang muna yung annotation dun sa Mother Title tapos next year na lang po ako magpapagawa ng land title ko kasi wala pa po kami nung land survey from Geodetic Engineer... magkakaron po ba ako ng penalty if hindi ko itutuloy ang pagkuha ng land title matapos ko maipa annotate yung main title ng land... please help po gulong gulo na po ako 😞

Bali ang hawak Lang nya ay kasulatan nila Ng kapatid Ng mama KO na ngbenta Ng kanyang portion and sya, private document Lang po hawak nya at Hindi pa pirmado SA LAHAT Ng kapatid which is the co owner ng buong lupain. At itong kapatid nila maman na ngbenta Ng kanyang portion patay na din po. Pangalawang tanong po, pwede po ba ma redeem Yung portion na Yun from that first buyer if magiging void po Yung kasulatan na hawak nya?

    Paano po kung nakabili ako ng lupa sa isang heirs nakasubdivide nadin po ito tittle at blueprint approved na my certificate of partition na din ung nabili kopo ay 600sqm lang sa 4004sqm na parte nya ung parte nya po ay hindi pa nya napapaself tittle ano po ang dapat kong gawin pwede kopo ba iti mapatituluhan

      Hi. Kailangan po yung seller ay ipa survey yung lupa, then yung mother title (4004 sqm) ay ipa divide sa daughter titles - yung sa inyo na 600 at yung 3404 sqm. Pag meron na title yung 600, kailangan nyo po yung title non, tas kailangan nyo i-transfer yung title sa inyo. Kailangan nyo rin po magbayad ng mga tax. Yung tax sa munisipyo/ city hall, yung transfer of title ay sa Registry of Deeds sa province nyo.

Xerox ng deed of absolute sale lamang po hawak ko..nawawala po ang original at wala po record ng notaryo sa ooc ng trc..at wala din po sa archive na record..at ung original title po na hawak ko ay nawala na din po xerox na lang po ng title meron sakin.ano po ba pwede ko gawin para maging legit ang papel na hawak ko po atty..       Naku wag mung bilhin yan pag deed of sale lang hawak nya. Ask nyu po ang original title nyan. If meron pwd kau pmunta ng abogado magpagawa ng bago deed of sale by under your name. Need yan signature ng seller at ikaw.tas mga I'd nila

      You need to check the title of the land. Ask for a copy from the seller. And verify it with the Register of Deeds. If you have DENR approved subdivision plan, process and pay all the taxes so that you can have the separate title issued under your name. Or at least, have your deed of sale annotated on the mother title.
