    Atty. Ang kapatid ng lola ko. Binenta saken share nya sa lupa Pero. Nasa name pa ng nanay nila titulo.. At ang lola ko is napatitulohan na nya yung share nya.. Ngayon?? Need ko pb magdeklara ng deed of partition and publication kung mismo kapatid ng nagbilhan ko ng lupa is kapatid ng lola ko na natituluhan na share nya

    Question: Nakabili ako ng lote last July 19, 2023. Tax dec only, classified as irrigated riceland, and 217 sq. meters. May deed of adjudication with sale dahil ang seller ay ang nag-iisang anak ng deceased owner.
    Pwede po bang patayuan ko na ito ng bahay kahit hindi pa ako nagbabayad ng CGT, documentary stamp tax and estate tax? Pero i will make sure na yearly ako magbayad ng amelyar. Kasi mga kaibigan ko ay ganyan po ginawa. Amelyar nalang binayaran ,tax dec lang din po sila.

    Attorney ask lang po, ipapa ammend po ang deed of sale, dahil hindi naka pirma yung anak sa deed of Sale.(co-owner) ama lang naka pirma.
    Buyer po ako, ano po pwede namin ipagawa na supplemental document para maisama ang pirma at pangalan ng anak sa deed of sale.

    Maraming salamat po Atty., ❤ very interesting topic, may problema kami ngayon way back 1940 na transfer sa mother ko ang title , ngayon nasa Amin mga 6 siblings each of us na transfer na rin sa amin ang title, pero may isang heirs sa former owner na wala naka sign, ngayon nag claim ang heirs nito. Ang question ko lang Atty., sa marami ng panahon/yrs. na lumilipas pwede pa Ba silang maka claim? All the years kami na ang nag bayad sa mga taxes...Thank you so much sir and stay safe!

    Good day atty. Ask ko lang po sana kung pwedeng i-cancel ang deed of sale kung hindi pa na full paid ng buyer yung lupa? Pumirma na po kasi ng deed of sale yung tita ko,ang problema po e hinulugan po ng buyer yung lupa at hindi pa po na full paid,ngayun wala naman na pong balak ifull paid yung lupa kasi pumirma na yung tita ko. Wala po silang usapan na hulugan yung lupa.

    Salamat po sa info. Atty. tanong ko lang po sana, ayon sa batas ang attorney's fee sa paggawa ng DOAS ay 1% at 6% sa BIR para sa CGT base sa selling price. Ito po ba ay sakop ng buong bansa? Kung gayun po, bakit po ang mga abogado sa Davao ay naniningil ng 3%-5% rate fee para sa DOAS? At ang BIR naman ay kumukuha ng 7.5% para sa CGT?

      Ang minimum notarial fee po ng abogado ay nakabase sa Schedule of Fees ng Integrated Bar of the Philippines at depende po sa chapter ng IBP. Ang capital gains tax po sy 6% at ang documentary stamps tax naman po ay 1.5%. That is why 7.5% ang binabayaran sa BIR.

The usual legal fee arrangements are: initial consultation fee, fixed retainer, time-based charging, acceptance fee, and contingent fee arrangements.
      As a legal instrument or document evidencing a sale, the Deed of Absolute Sale should be also notarized, which requires a fee of about 1% to 1.5% of the property’s selling price, but no lower than Php1,000.

    attorney, magtatanong lang ako patay na po father ko 2018. nkapangalan po s parents ko ung lupa nanay ko buhay pa. pede bang ibenta ang lupa. na hindi aasikasuhin ang estate tax muna. pakitulungan po sana ako sa pagexplain kc may black sheep samin na isa ayaw asikasuhin ang deed of donation ofw. imigrant sya. ilang taon ko ng sinabi ska pede ko ba syang kasuhan just in case kc ayaw nya ngang asikasuhin lagi ang sabi malayo ang embassy. sabi ko nman abay lalapit ba ang embassy sa kanya.

    Salamuch atty for this video explainer. I realized lang, in terms of cost, hindi kaya mas mababa or possible na wala ka pang bayarang estate tax kung ang gross estate mo ay mababa lang naman, possibly Php 5-10M. This is just considering the standard deduction and family home consideration.
    Ung proseso between capital gains vs estate is a different matter tho. Mukhang mas mabusisi at matagal ang estate tax. But still, makakabawi ka na rin nang malaki sa cost. Does this make sense po ba?

    atty, binenta po sakin yung unit ng kaibigan ko nasa abroad na.. sabi nya ipapadala nya yung deed of sale pagnadeposit ko na yung pera.. tapos po ngayon ayaw nya po magbigay ng deed of sale tapos sinabi nya wala daw po ako binayad.. pero may mga screenshot po ako ng convo namin.. pano po kaya gagawin ko

    Good morning atty. tanong ko lang bahay namin naitayo half of the parcel is titled lot under my name et al my siblings pero the other half is not titled under us pero yong owner ng lupa at papa ko meron silang deed of donation document notarized before namatay yong owner pero hindi na e process sa city assessor, bir and registry of deeds at walang donors tax yong previous owner. documento hawak ng papa ko is 15 yrs na po. ngayon gusto namin magkapatid ebenta itong titled lot at bahay gusto ng papa ko e benta as a whole pero hindi kami pumayag kasi hindi completo papeles nya ayaw namin may problema sa buyer side. Nag punta po ako sa registry of deeds pina verify ko yong documento hawak ng papa ko it turn out yong lupa donated sa kanya naka double title sa records and may kaso unresolve hangang ngayon. Tanong ko po may full rights ba papa ko sa lupa na donated sa kanya? Valid ba yong documento hawak niya? Salamat po atty.

    Good day po attorney! Buyer po ako, Mag kahiwalay po yung extra judicial settlement at yung deed of sale namin. Ask lang po, nagbayad na kami ng estate tax pero hindi kinuha ng BIR ang deed of sale. Sa pagrelease ba ng eCAR (estate tax) nasa name na po ba namin or sa name parin ng heir.
    Paano po pagdating sa RD, magkaiba po ang name ng eCAR (sa estate tax) at yung isang eCAR nasa name ko na po.
    CGT and doc stamp bayad napo (eCAR po nasa name ko na released napo).
    Please advise po. 🙏

      Kung may eCAR na po kayo sa name nyo ibig sabihin po nabayaran na po CGT ng Deed of Sale, sabay nyo po ipasok sa RD para diretso na po mapalipat sa name nyo yung property

    Atty tanong ko lang gagawa ako ng deed of donation at ang zonal value ng property ay 655, 100. Tama ba ang babayaran ko ay 14,000 + 39,306=53,306. Dahil ang computation ay 6% sa zonal value. Atty need ko ang advice mo bago ako magpagawa ng documents. Salamat

    Atty. kasi po nag aayos po kami ng estate tax, ang kaso po is yung isang tagapag mana na anak is nawawala hndi po namin makita, pero may ibibigay naman na share nya sa lupa. Ano po pedeng gawin para ma process napo ang estate tax namin. Thanks you po godbless. 😊

    Good day po Atty. Iam a widow w 3kids , when i avail my eartly retirement i was able to 380k as my benefit and lucky enought i bought a 128 sqm at town n country dasma cavite . My daughter convinced me to have the title named po sa kanilang mag asawa pra daw po pwede cla mag loan sa pagibig for the house construction but it did not materialized instead sakin narin nanggaling yun ipinang construct ng house...pano po kya dapat ko gawin pra ma isama ko pa yun dlawang anak ko sa title , would it be possible?

    IMO, kahit na same na lang ang percentage na babayaran ng estate tax at donor's tax, yung proseso ng estate taxation ang mas hassle lalo na sa pagkkumpleto ng requirements.
