    Ang paksa pong ito Atty. ay kadalasang sitwasyon dito sa amin sa probinsya. Halos lahat ng lupa dito sa amin nakapangalan pa ang titulo sa great grand mother/father tapos hindi na-i.transfer ng mga heirs. Then yung mga heirs verbal lang yung pagpartition kunwari "sayo dyan, akin doon banda, siya naman dito". May mga assesor ding nakiki.alam sa pag.subdivide imbes na geodetic engr. ang nag.aasikaso. So nangyayari, magkakaiba ang mga tax declarations ng mga occupants sa isang lote pero iisa yung titulo na nakapangalan pa sa great grand mother.

      Dapat ung mga concerned heirs ay mag sikilos upang ma-itama ang mga errors at pagkabuholbuhol ng kanilang mga properties lalo kung ang mga ito ay walang survey at approved technical descriptions ang partihan ng mga heirs at turo-turo na lang.

    Steps Bago Bumili Ng Portion Lot Na Naka Mother Title or Tax Dec Pa:
    1) Execute EJS of Estate
    2) Pay Estate Tax (if deads na naka name sa title)
    3) Pay Amilyar or Buwis
    4) Hire Geodetic for Initial Plotting, Relocation & Subdivision Survey with LOT PLAN (be approved in LMA of DENR)
    5) Execute Deed of Partition
    6) Prepare Death Certs, Tin Numbers of Sellers & Gov. Issued ID's
    7) Execute Deed of Absolute Sale
    8) Within 30 Days pay the gains tax & stamp tax in BIR, get TAX Clearance in Assesors Office & submit other requirements for the issuance of CARP
    9) Borrow the Original Mother Title & go to ROD for the registration ,annotation & to process the issuance of title on your purchased lot portion.
    10) Wait for your Title to be Released

      Atty.yong lote na nabili ko ay Absolute sale with extra judicial partition po. Lahat na ko owners naka signed sa sale. Na bili ko
      . na wala pang survey..nang gusto ko na mag pagawa nang title, Nag pa survey ako . After the survey I found it that somebody had encroach the property ko nabili ko. At mas malaki pa ang na encroach nia. Ang deed of sale nila is papel lang and not notarized . Ano po ang laban ko doon para ma kuha ko ang portion na na encroach nila.. I'm asking your advise Atty.

    Can we transfer the title using a certified true copy of the title from ROD and affidavit of lost from the owner and the Deed of Absolute sale because the owner lost her title?And, anyway, a new title will be given to the buyer so no need to reconstitue the title of the owner for faster process?

      You can ask the surveyor po tapos bibigyan ka nila nang estimation. Nong nagpasukat kami nang lupa last 2019 sa amin sa cebu it cost 8k

      Depende po sa sa presyo ng pagka bili. Ex: 200sq.m from mother title na 1.8sq.m. @₱300K is ₱7.5k ang pa survey. Bale dalawang sukat @₱7.5k X 2= ₱15k po. Sukat lang po.

    Gud eveninh sir..This is roxan ofw..Naka bili po ako nh lupa..Kaso sabi ng benilhan ko ..Sketch plam lang po ibinigay..Niya..Hahantayin ko daw maKa tapos mag bayad yung ibang bumili ng lupa..So antay pa daw ako..Wala pa ring deed of sell.Binigay

      Naku! Dapat hindi ka muna nag bigay ng bayad. Kung walang deed of sale na pinirmahan ninyong ng seller at ikaw bilang buyer ay walang bilihan ang nangyari. Hindi pwede ung sketch plan lang. At tiyakin mo rin na ang nag benta sa iyo ay ung may-ari talaga. Kung ahente ay hingian mo ng SPA at mga ID's ng may-ari na magpapatunay na ang nakalagay sa titulo o dokomento ng kanyang binebenta sa iyo ay siya talaga. Dapat kaliwaan sa deed of sale, bayad, ay pag turnover din ng original na titulo, tax declaration certificate, tax clearance, certified true copy ng titutlo galing sa Register of Deeds(RD0. etc.. Exercise due diligence.

    Good day Atty. napakaganda po ng mga videos nyo kasi klaro at madaling ma intendi ang paliwanag nyo. Tanong ko lang po, sabi nila sa assessor's office daw ay mura bumili ng lupa kong available. Paki paliwanag lang po, salamat at mabuhay po kayo.
