NO. 27; AND PROVIDING FOR THE MANNER OF PAYMENT BY THE FARMER BENEFICIARY AND MODE OF COMPENSATION TO THE LANDOWNER

    PRESIDENTIAL DECREE No. 27 (PD 27)
    October 21, 1972
    DECREEING THE EMANCIPATION OF TENANTS FROM THE BONDAGE OF THE SOIL, TRANSFERRING TO THEM THE OWNERSHIP OF THE LAND THEY TILL AND PROVIDING THE INSTRUMENTS AND MECHANISM THEREFOR
    In as much as the old concept of land ownership by a few has spawned valid and legitimate grievances that gave rise to violent conflict and social tension,
    The redress of such legitimate grievances being one of the fundamental objectives of the New Society,
    Since Reformation must start with the emancipation of the tiller of the soil from his bondage,
    NOW, THEREFORE, I, FERDINAND E. MARCOS, President of the Philippines, by virtue of the powers vested in me by the Constitution as Commander-in-Chief of all the Armed Forces of the Philippines, and pursuant to Proclamation No. 1081, dated September 21, 1972, and General Order No. 1 dated September 22, 1972, as amended do hereby decree and order the emancipation of all tenant farmers as of this day, October 21, 1972:
    This shall apply to tenant farmers of private agricultural lands primarily devoted to rice and corn under a system of sharecrop or lease-tenancy, whether classified as landed estate or not;
    The tenant farmer, whether in land classified as landed estate or not, shall be deemed owner of a portion constituting a family-size farm of five (5) hectares if not irrigated and three (3) hectares if irrigated;
    In all cases, the landowner may retain an area of not more than seven (7) hectares if such landowner is cultivating such area or will now cultivate it;
    For the purpose of determining the cost of the land to be transferred to the tenant-farmer pursuant to this Decree, the value of the land shall be equivalent to two and one-half (2 1/2) times the average harvest of three normal crop years immediately preceding the promulgation of this Decree;
    The total cost of the land, including interest at the rate of six (6) per centum per annum, shall be paid by the tenant in fifteen (15) years of fifteen (15) equal annual amortizations;
    In case of default, the amortization due shall be paid by the farmers' cooperative in which the defaulting tenant-farmer is a member, with the cooperative having a right of recourse against him;
    The government shall guaranty such amortizations with shares of stock in government-owned and government-controlled corporations;
    No title to the land owned by the tenant-farmers under this Decree shall be actually issued to a tenant-farmer unless and until the tenant-farmer has become a full-fledged member of a duly recognized farmer's cooperative;
    Title to land acquired pursuant to this Decree or the Land Reform Program of the Government shall not be transferable except by hereditary succession or to the Government in accordance with the provisions of this Decree, the Code of Agrarian Reforms and other existing laws and regulations;
    The Department of Agrarian Reform through its Secretary is hereby empowered to promulgate rules and regulations for the implementation of this Decree.
    All laws, executive orders, decrees and rules and regulations, or parts thereof, inconsistent with this Decree are hereby repealed and or modified accordingly.
    Done in the City of Manila, this 21st day of October, in the year of Our Lord, nineteen hundred and seventy-two.

    Attorney, salamat po sa Video ninyo, sa tatlong requirement po to transfer the title to the new owner, kung gagawin ko pong residential ung part ng original na lupa. maibibigay po ba ng DAR ang clearance? Kase may nag aalok lang po sa akin portion lang po ng lot ang binebenta thru EJS ng anak po nung nakapangalan sa title.

    Hahaha yari ang Maro dito ng Coron Palawan.. nagbenta na cla ng cloa wala pa 10years 2012 na award 2019 benta na nila.. d pa bayad sa Landbank pinayagan na ng DAR wala din tanim ngaun mayayaman na ang nagmay ari.. maraming salamat atty

    Good day po atty ,meron pong binibinta na farm sa akin.May cloa title po siya na dalawa silang nakapangangan na nakaregister sa ROD noong 1996.At noong 2017 nagkaroon siya ng cloa title na siya na lamang mag isa sa title,ito ay nakarehistro sa ROD ng 2017.Saan po dito ang basihan ng 10 yrs prohibition?yong naunang cloa title po ba o yong bago?Salamat po.Godbless

    Napaka-ganda po ng batas na ito para sa mga walang sariling sakahan ,ngunit hindi nasusunod ang batas na ito dahil sa mga tiwaling tauhan ng nasabing kagawaran.Ito po ang dapat busisiin ng kina-uukulan upang maging patas ang batas sa panig ng mga maralita.Tauhan mismo ng DAR ang mga tiwali.Sino ang dapat lapitan ng mamamayan?

    Atty. Good morning. May opisina ba kayo sa Bacolod City? First buyer ako ng EP land title . Nabili ko sa Ama na naka pangalan sa kanya noong year 2000 may dead of sell at notaryado . Patay na ang Ama na bilhan ko at cla parin nag cultivate ng lupa sa utos ko na hinde ko manlang kinunan ng share. Ako din ang nag bayad sa land bank noon 2013. Ibenenta nla sa second buyer at may roon na clean title ang second buyer.

    Gd eve po atty. ask ko lng po kung may karapatan na ba na angkinin ang lupa na isinanla daw ng mga magulang nmin sa mga tiyuhin nmin way back 40yrs na po at sila na ang sumasaka? Nakapangalan po ito sa father nmin ang titulo at kami po ang tagapagmana.Kami din po ang nagbabayad ng amiliar sa munisipio at may tax declaration kami at gayundin ang tax clearance.May ipinapakita sila na kasulatan ngunit ayaw nila akong bigyan ng kopia para mapagaralan nmin sapagkat ayon sa kanila ay na waive na daw karapatan ng aming mga magulang.Ano po gagawin nmin atty? pls reply po sana.     Attorney tanong ko lang. Meron Kasi kaming lupa CLOA award sya ng government samin Bali na award samin ito noong 2009 pa doon sa titulo may nakalagay na parang nakasanla sa Isang insurance company noong 1975 pa iba pa yung sa land bank pero hindi naman po kami nag sanla yung dati pong may ari ang satingin namin na nag loan. Babayaran ba namin ito para mapa cancel sa titulo Yung anotation na ito. Salamat po

    Atty gud evening. Legal po ba na ipagbili ng mga beneficiaries or heirs ng lupa under emancipation patent. Kahit walang deed of judicial partition dahil namAtay na ang tunay na ang kanilang magulang.

    Gd pm po ang amin pong lupa dito sa calaca ay covered ng CLOA kami po ay 18 years na hindi nakakapag bayad sa landbank pero na ibenta ng 1.5 million ang 1/2 hectares ano po ba ang basehan bakit napabenta ng ganoon pong kalaking halaga , kung magkaproblema sino po ba ang dapat managot ,, yung bumili po ng lupa O yung nag benta/ahente ng lupa

    Hi Atty, pano po kapag aside po sa Landbank na anotations na dapat nasa likod ng cloa title ay may other anotations pa po nakalagay ay ibang bank, for example ay DBP po. Bale kinuha po ng Gobyerno ang lupa galing sa mayaman/tao, nag karoon na po ng titulo ang gobyerno, then nung inaward sa mga farmers, nag karoon din po mga farmers ng kani kanipang titulo na cloa, pero yung anotations/mortgage na galing po sa mayaman/tao ay naka anotate parin po sa likod ng mga cloa title, it's like hindi po na cancelled ung mortgage, dapat po ay Landbank lang po, pero may iba pang anotations na sobrang tagal na po yung loan. Hindi po inalis nung kinuha ng Gobyerno po at bago iaward sa farmers. Maraming Salamat po sa inyong magiging sagot Atty. Malaking tulong po

    atty. may katanongan lang po.. may kilala po kasi ako grupo o mga tao na ngbebenta ng lupa kung saan nkatirik ang up diliman.. particular ung kahabaan ng philcoa market at lupang bakante doon kung saan UP daw ang may ari.. ang grupo na eto ay may hawak na certified true copy at sila daw ang orihinal na may ari ng lupa na iyon.. katunayan eh nghahanap sila n mgsponsor upang mabayaran ung taxes at penalties nto.. may kausap silang judge at mga buyer para mabenta eto.. possible po ba eto? sna mapanagot ang mga sindikatong eto. sana po mbigyan nyo po ng linaw atty dami pong naloloko ntong grupong ito

    Mabuting araw po Atty! OFW at new subs here. May nabili po akong matured cloa land issued 2007 at nabili ko 2018. Bayad na po ako ng mga taxes at may BIR-CAR na po ako. At problema ko ngayon kasi nawala yong Original Owner's Copy na dapat i-surrender ko na sa ROD to file TCT under my name. Di na po nakita ang OCT-owner's copy ng mga heirs na nagbenta sa akin.     Attorney, pwede paba mag claim ng Retention ang may ari ng lupa kung na award na sa mga tenant ang lahat ng lupa 16 years ago? Paano po kung after 16 years at na approve ang retention, paano mangyayari sa tenant na nasakop ng retention? Pwede ba sya bumawas sa iba benificiary?

    Hello po sir, maraming salamat po sa episode na ito. Sa sitwasyon ko po sir na nakabili po ako ng lupa under CLOA po, ano po ang kailangan ko gawin para po mavalidate ang pagbili ko. Naka lampas napo sa 10 years ito, kaso di ako nakakuha ng clearance from DAR, at saka diko pa na verify ito sa Landbank, nanghihinayang po ako sa pera na pinaghirapan ko po bilang OFW. Napanotarize po ang deed of absolute sale, capital gain tax, at real property tax. Maraming salamat po ulit.

      Kunin nyo po yung Certificate of Full Payment from the Land Bank as proof na fully paid na po nung nagbenta yung amortization ng lupa sa Land Bank.

      @@YourLawyer Maraming salamat po Atty. kakausapin ko po sila (yong nagbenta sakin) kasalukuyan po kasing nasa Riyadh ako. Meron napo kasi mother title ito tapos hinati sa tatlong bahagi sa magkapatid...then yong isang bahagi nito ang benenta po sakin.
      Pwde rin po ba kaya Atty. na yong kamaganak ko ang mag verify sa Landbank at humingi ng certificate of full payment. At kong malaman kon magkano pa kulang kasi 30 years amortization pala yan. God bless you po always at sa inyong channel na malaking tulong po.
