The fact that they tried to make it seem like they took him in out of the goodness of their heart alone and they were responsible for him becoming an athlete is crazy. there are 3 factors working simultaneously against Oher, his memoir that states in his own words that he knew he was under conservatorship (as a shield to protect him from his cocaine addicted mother, his 11 siblings and his father that he does not know from coming to sue him), 2- why at the age of 37 yo to read the court documents? why you wait so long? 3- Oher was present with the attorney with the twoys that under conservatorship he was able to play football under the Tennessee law and it was spelled out in court documents that he SIGNED. This is the critical part is that he signed the papers and if you know the law whatever you sign you understood what you are doing, except if you're a woman claiming under duress from signing a pre-nup which is all BS but that's for another time.

    • @puidemare2337
      @puidemare2337 10 หลายเดือนก่อน

      First, you have to understand what entails to be granted a conservatorship. To be granted a conservatorship, there needs to be proof that a person is unable, whether, mental or physical, to make decisions. That is the only time a conservatorship is granted. Michael would not have qualified for either the physical or mental terms. A doctor needs to be present during the hearing to state why Michael is unable to make his own decisions. Why the judge granted it without proper protocols dodgy as heck.
      Second, a conservatorship grants the "parents" complete control over Michael's financial and health affairs. When those papers were signed, they told Michael that it's the same is adoption, only his age makes it a conservatorship. They are completely two different things. Remember, Michael trusted these people. There was no reason he would think they were lying to him. So he is led to believe he is being adopted and is part of the family. He could have been easily persuaded to sign these papers thinking it is like being adopted. Maybe he waited this long because he finally has time to look through or reflect on things. It's like when you believe in santa because that's what you are told and when you get old enough you start to question things and realize things are not as they seem. It happens to all of use. Life evolves. Btw, this is not a lawsuit. It is a filing to end his conservatorship and asking the family to release documents of all the money made using Michael's name, image, likeness. The family, as they were granted guardian of this conservatorship. by law, needs to record everything and update the courts every year. As of today, there is no such records in the court systems. If they are telling the truth, then there should be a paper trail.

      @@puidemare2337 Sorry but that's all wrong. The doctor does NOT have to be present in court... at least not in Tennessee they don't.
      Within the Tennesee family law it defines disability : _"Person with a disability" means any person eighteen (18) years of age or older determined by the court to be in need of partial or full supervision, protection, and assistance by reason of mental illness, physical illness or injury, developmental disability, or _*_other mental or physical incapacity_*_ ;_
      It is so vague. NO list of medical requirements.... NO doctor's signature... any 18 year-old who is at least *partially* in need of supervision because they have *some* mental incapacity. Hell, that wide-open definition fits MANY 18 year-olds... the "other mental incapacity" is called being young, reckless and naive. 😆
      So there is no Tennessee law mandating that the ward be *medically* incapacitated. And even if there was, all the Tuohys did was petition for this... if he didn't fit the legal description, the judge would have simply declined their petition... end of story. One look at Michael Oher's IQ test with a score of 80 and the judge is covered. The conservatorship may have been highly irregular.... but so was the reason they were petitioning for it. How often do people need legal guardianship over a NON-medically incapacitated 18 year-old in order to satisfy the NCAA and keep their college options open? As long as it was in Michael's best interest (and it clearly was), combined with the fact that his birth mother signed off on it.... the judge probably considered it a no-brainer. "Conservatorship" wasn't the dirty word it is now back in 2004.
      And the type of conservatorship the Tuohys created with Oher was what Tennessee calls a "Conservatorship of the Person". They did not pick the "Conservatorship of the Estate" so they never had control over his finances.
      Money they made using Michael's name, image, likeness? As long as they are telling stories about the years they spent with him and their relationship, they can sell books, have speaking engagements, etc. and not owe him a dime. They are talking about their *OWN first-hand experiences* .
