  • This case is a heartbreaking one. It involves the passing of a very young child, and discussion of serious harm against children.     I'm a foster parent to a little girl that was parentified and was originally placed with her siblings but then moved due to sibling on sibling violence. It has been the best thing for her. For the first time in her life she's just a kid. She doesn't have to care for anyone but herself and is a only child for the first time since she was an infant. She is thriving. Separating kids isn't optimal but sometimes it is the best thing especially for parentified children.

      As a family therapist, I want to say that, it is possible much of the time for work to be done with children like that. They don’t have to lose their siblings. The parentification (and some other issues) can be worked on successfully with therapy and with the help of the foster parents as well. Of course, it’s a case by case basis. But separation is not the only answer to situations like this.

      As a foster parent I find the state wants siblings kept together so much of the time that they ignore warning signs of trouble between siblings .

      As someone who was parentified to five other kids, it really affects development and relationships. No hobbies, no friendships, no extracurriculars, no weekends, no time for homework. It made me tough, decisive, hard-working, selfless, and responsible - but also lonely, bossy, restless, self-neglectful, and exploitable. Most of us are adults now; my siblings are close, but not to me. It's awkward when I'm around because I'm not Mom or Dad, but I've never been one of them. That's what hurts the most.

    I was impressed when she asked, “Did you feel the child was coached?” and then followed it up with, “Do you agree that the person who coached the child couldn’t have been the father?” (Because the father is in prison). That was a deliberate and damning condemnation of the mother… on the record. I assure you that’s going to be used by the prosecution during the mother’s trial.

    I haven’t finished watching this hearing yet but I just have to say this: the lawyer for CPS here was awesome. I like the way she was kind but stern with the father and explained things very well and made sure he understood what was happening. I applaud her for doing that.

      I also appreciated that he was included in the proceedings in the first place. The fact that they're treating a convicted prisoner with respect and allowing him to have input for his daughter's placement was a pleasant surprise!

    Special Investigator Parker comes across as a smart, humble and kind grandfather figure. Can’t imagine the things he has seen.

      Plus stated that while he ran the archery shop he was in the police dept, so my assumption is (And was as soon as he opened his mouth) that he is a retired police officer as well.
      A lot of retired officers take casual or part-time jobs like this after they leave the force.

      I'm just starting to watch, but I'm already impressed with how he made a point to make the draw weight of the bow an issue of experience rather than gender (like the attorney was trying to do).

    This case is a great illustration that we can't assume that keeping siblings together is always in the best interests of the children. Kids who are abused often take their anger and frustration out on 'weaker' children, including siblings. Just because siblings don't want to be separated, doesn't mean they shouldn't be in some cases.
    Kids also very often want to stay with their abusive parents and feel punished when removed, but we don't allow them to make that call either. Even the kids who are being violent can benefit from separation from the victim-sibling, in conjunction with therapy to understand why they are hurting someone they love. This behavior has probably been learned from adult caregivers, and it takes time and space to change long-term attitudes and habits.

      Exactly, sometimes siblings have to be separated and it doesn't mean always. It means they need to be able to work through their trauma, receive therapy and other services as needed. IF they don't separate kids acting out, it can be very dangerous and just opens up the possibility of another tragedy. Bless these kids, I pray they are able to heal from this and have the best life they deserve to have. NO child should have to go through this

      I imagine that the younger girls beating up on the older child might be what they saw haw their father treated the child that wasn't his.

      I adopted a large sibling group out of foster care, and am a coach / consultant for those wanting to adopt through foster care. I can fully agree that are situations where it is NOT in the children's best interests to keep sibings together in either a foster care placement or for adoption / permanency.

    This is so awful. Happened 2 weeks ago, and I do give major kudos to family services getting things together for those children so quickly. I hope Mr Robinson realizes his life choices need to change pronto for the safety and well being of his daughter. Hope the other parents rot in hell. Poor baby Yana she was only about 9 months old. RIP Baby Girl.

      You know what's weird, I think the father will probably do just that. He seems to understand the magnitude of the situation and he seems to be ready and willing to help and comply in any way he can. I think he's learned his lesson with this stint in prison and is ready to be a father. He didn't say much, and I don't know anything about him, but just based on his reactions to the questions and his demeanor, my gut tells me he's going to do well. I hope I'm right.

      All of her kids are so cute. Even the ones she gave up for adoption. She is also pregnant again. So many kids in this situation they aren't even speaking about. Her bf has some kids he and his ex don't have custody of either.

    So much respect for the GAL’s, the other attorneys, CPS caseworkers, the Judge, & all involved for the work they do. I’m so glad we get an inside view of this process, so very interesting but also at times, devastating. Happy the kiddos are in therapy & there’re many adults (even within the system) who are looking out for them! ❤

    As someone in child welfare: dad is NOT being selfish at ALL for wanting his daughter to be with family. He wants her to be safe with people he feels he can trust. She’s also the oldest and is likely being put in a mothering position and been parentified, which is not healthy, especially not during traumatic grief. She would still be allowed contact with her siblings. Placing with family is actually preferred and while it does often mean separation, the court and dcbs usually work pretty hard to ensure kids have visits and time with their siblings.

      I’m a foster mom and placing her with “family” she’s never known isn’t any different than placing her with complete strangers. It would be traumatic to separate her from other siblings even if she was playing a parental role. If she is in a good foster home that burden would be lifted while staying connected to the only family she knows right now. Plus she’s old enough to voice where she wants to be. Dad hasn’t been involved for many years and is now incarcerated. Who’s to say he’s looking out for his child’s best interest. He knows nothing about his daughter and what she may want nor is he considering it.

      ​@@alys4570 as a guy who watches probably hundreds of hours of court a week, dad was being selfish....I'm not saying if it's wrong or right.. he may just want to be with his kid but that poor girl will feel like it's her fault and she is being punished of she is seperated

      @@alys4570 dad’s testimony said he was involved for the first four years so half her life and that his mom still had some contact. So even though she’s estranged from dad she may have family contact. He also said the lack of contact was not by his choice so we don’t know if parental alienation is a factor in which case it is best she get acclimated to his side of the family if his rights are to remain intact. If it is decided termination is in her best interest that is fine, but in a situation where there are different fathers, children are almost always going to be split up.

    The fact this baby's family was also involved in domestic abuse and a standoff (her paternal relative did the abusing & died in standoff as far as I can tell from web search) tells me perhaps there's dysfunction aplenty with the family as a whole.

    The big question here is with an “extensive history with CPS,” why would those children even be in the custody of these parents? Clearly, some balls were dropped here and the result is not only some very screwed up children, but a dead child.

      That's why the mother kept moving. CPS was only 1 step behind and why they were ABEL to act so quickly w/o a court order as they were in pursuit of finding her for placement of all the children was already in place until the death of the child as the family they were to be placed with wanted no part of a murder investigation and everything that led up to it, the kids experienced it all and they are adversely affected as any young children would be unless they're the boy Jesus but Mary and Joseph were GOoD parents, right? so we need to make sure all children have GOoD parents and who better to tell us than CPS ...right? wrong .... but sometimes, they children do turn out to be good citizens as all gOVERnMEnt employees are not equal in education, experience, intentions, personal issues, etc. they're only human and we take the good with the bad

      SHE screwed up and one of her kids is dead because of decisions _she_ made.

    This child doesn't know her adult cousin but she also didn't know her foster parents. Also, maybe a little time separated might be good for her seeing Shes being beat up by others.

    The “parents” are absolutely disgusting and karma is a B.
    I hope the father gets his crap together.

    49:22 dEFINITELY sounds like it would not be the WORST scenario to separate the child WITHOUT behavioral issues, so she no longer has to be the peacemaker. Wow.

      Yes, separation in conjunction with therapy could help to break these violent patterns and help *all* the children to be safe while learning how to engage with each other in a healthy way. It's odd how they remove kids when they know their parents are violent, but they don't react with the same level of protectiveness when they know siblings are violent with each other. It can be just as damaging to be abused by any family member.

      @@ChristaMichelle1991 I don’t know any cps jurisdiction that gives 72 hours to drug test. Here it is before the end of the day. If you’re told to test at 2 pm you best get there before 5. And this court hearing is BECAUSE of her child that died. How anyone can play bingo on their phone but not log in to court is beyond me. It sounds like y’all are enabling this tragic behavior making excuses for her and the conditions she raised those kids in

    In the smaller counties of Texas, the Texas Rangers are always called in on murder cases. The larger counties with metropolitan cities have the resources to investigate on their own.
    This is a horrible, horrible case. The older girl obviously knows what happened to the baby. I don’t blame Dad for wanting her to be with his family. I understand for advocating keeping them together, but not at the cost of the older child.

      Yet, he has gone for YEARS with no contact with his daughter, no contact of his family with his daughter and she wasn’t important enough for him to bother checking on her for years. His concern now is way too late. I feel no sympathy for him at all. That poor child has been through hell and no one on her father’s side, including the father, made any effort to check on her until another child died.

      ​@@tarabeard he's been in prison for the last 5 years and the Mom has moved around and has had SEVERAL CPS removals, therefore no one is going to be getting him information, he's not the one who has a case against him for ⚰️a child like the degenerate mother, at least he has a chance to start over

      Her sisters are her family... A cousin she's never met would be traumatic as well with everything she's going through. Blood isn't always thicker in my opinion

      @@Getlostandwander I'm not biased, I never said I think strongly one way or the other in this case, and I even said in the video later on that it may be necessary. However, this father who hasn't seen her or spoken to her and doesn't even know her, because of HIS choice to harm people, is selfish. He isn't even aware of what she wants or is best for her. He certainly didn't help her to be in a good spot the last several years. Like I said, sometimes it may be necessary. That doesn't make it any less sad

      From the sounds of it only the one child is his? And it’s very reasonable for a child to be placed with their family. The other children could go to someone who they’re related to as well if they were able to take them in, it’s not on people who aren’t related to them to take on extra mouths with no legal bond. In cases of child abuse depending on the circumstances it may be that the only way they can in fact heal their trauma is to be taken to a completely different situation for therapy, away from other abusers or victims. They stated the other children were violent so why would you consider leaving her with the other children who likely caused her harm? She deserves better and to heal with her families help who can show her love in a long term and meaningful way.

    I know that when my cousin's children were emergency removed I told the cps worker to remove the girls from the boys. The girls were caring for the boys as if they were the parents, and I told cps they needed to be kids. I had all five of them with us for three months, and I struggled to keep them from "parenting" each other. They have been adopted now into seperate houses. The girls are being kids again, and doing great. The boys are growing up well, too. All are safe. A sibling violence or "parenting" behavior is so sad. She probably is blaming herself for the baby's death, and it would not be her fault. 😢

    Dad is not being selfish. He is asking questions as they popped in his mind. Because he is incarcerated, it going to be hard for him to get info or have control of anything.

      He didn’t try to push any agenda on the court, his ONLY questions were regarding him not losing his daughter… and hopefully being able to contact her. Clearly the mother is a monster and has not done anything to benefit her children.

      Atleast the Dad on the phone cares enough to try and get the children placed. I pray that this will make him stop and rethink situations, get his life in order and be the Dad that his daughter desperately needs.

    The father, in jail, yet is more concerned than the mother. His question about not losing rights to the child sounded like a desperate father trying to make sense of a senseless situation. The mother and husband should never be able to be near these kids. It would be nice to keep the girls together but what if in the future the mother gets custody? What if she tries to kidnap them? It has happened before in cases. The fact that the father is in prison does not mean he's not concerned or doesn't want the best for his child. Already the younger girls are bullying the girl.

    I and many other women have went thru absolute hell trying to convince and you have sorry excuse for mommas like this having these gifts left and right, and not appreciate the beauty of being a momma or the joy, MAKES ME SICK AND INFURIATED. I was lucky enough to be called momma and blessed twice, by the grace of God and I would never take that for granted. I hope these babies get the love, structure and family they truly deserve.     Yes, whether a bow is a woman's or man's bow is VERY easy for a knowledgeable person to determine. Draw length & weight are very important as to whether a person can properly use a bow.

    Seems like the comments were a little rough on the guy who actually did show up even though he is in prison…. Don’t know the whole story but looks like it’s his kid getting the crap beat out of her by the two other siblings … at least he tried to find a place for her to go… not sure he wants to be a dad or not, but from this video I don’t see him as the “bad person” in this case from this video….

      I agree. I caught the emotion in his voice. He sounded alarmed when he asked if they were going to terminate his rights, and I have watched many other videos on this channel where a father who is incarcerated just doesnt have that emotion and concern even WHEN they are being terminated.

    Yana was the 6th child of Jasmine. There are 4 girls & 1 boy living, but I would've sworn they were only talking about 3 kids in placement? I could've missed somethin', though. Shoot! I'm a pretty darn good "Googler" but I can not find any news at all related to this case! The entire county has less than 8500 residents, but I'd have thought there'd be news stories. I found the obituary & memorial page. Heartbreaking, just heartbreaking

      Yes, there was one child by the father calling from jail and two living girls by the same father of the deceased baby. They did say that baby mama had a long extensive history with CPS.

      OPD Chief Dan Birbeck and Detective Dustin Hudson “were suspicious of the circumstances and called the Texas Rangers to assist,” the release said. A Young County Grand Jury reviewed the case and returned an indictment against Jasmin Alexis Kay Smith for criminally negligent homicide on Nov. 20, the statement said.

    It is interesting reading the comments about the cousin vs Foster Care placement situation, I am a little torn myself.
    I can see how Davian may interalize being away from her siblings, and she may insist she doesn't want to be separated, however childern do not always know what is best for them, which is why we do not place them in the types of positions where they are making life altering decisions.
    My instinct is telling me that Davian only has one childhood that is slipping by, she should be given the opportunity to be a child, not be Mother Hen to her siblings, and be abused at their hands.
    Give the cousin a chance, with close supervision.

    A judge can certainly decode in a custody hearing that either parent cannot live with another adult, and if one parents new significant other has a history of violence that person can be specifically excluded from living or being with the children.

    I find it VERY SUSPICIOUS that the video footage of her trailer was unavailable because the cameras weren't functioning. I bet Mr. Massengill paid off the owner of the trailer park.

    As for the bow and arrow...there are different bows that women use because they're not as physically strong as men. It's REALLY difficult...there's no way that woman was using that bow.

      My husband and son are both archers and when he mentioned the weight draw he estimated on that bow, he's correct, no woman would be drawing back that weight.

      I grew up around archery equipment and my parents had very different bows. Now the expert couldn't say for sure who owned it based solely on the size, but they can say who wouldn't use it. The witness wasn't making any big assumptions and I get so annoyed when creators doubt someone who was qualified as an expert without providing any information that they think the expert wasn't taking into account.

    When I just heard about how the 2 were beating up on that one child I just started crying. These kids are so hurt and angry….it’s unbelievable how much hurt and anger they must be feeling. If these kids are not helped in an extensive way now I’m afraid they will grow up with the same feelings and treat their own kids same way if they have any. It’s so beyond sad these kids have to live this life….for any child to live it.

      Absolutely the cycle will just continue if this behavior is not addressed, though it sounds like it is as the girls are in therapy.
      I was wondering how they interact with children outside the home? Like friends they may have had for example, I hope their are plenty of qualified counselors at that summer camp, so there aren't issues with other children.

    Yana Michelle Massengale the sweet baby who passed , I couldn’t find in any investigation going on after the baby died . Not one article nothing :/ so sad .

    I didn't catch the date that the child passed. This is a horrible tragedy in many ways. Obviously the children are so much better off without their mother and the other monster that lived with them. As these kids get older they will realize that their baby siblings life was taken by mom or dad or both. This is so sad.

    Re archery - it is something he’d be able to estimate. A 50lb draw on your finger tips is incredibly heavy, and it’s really unlikely that someone with no experience could use it on a long bow. 25lb is a good starting weight for women. That weight is what they require for moose and bears.

    For goodness sake. The man is in prison. When he gets out his work selections aren’t going to be great. He has one child and she may have behavioral issues. The other two kids definitely have behavioral problems. This guy has sketchy self control in the first place. He should have to carry the burden of his exes children

    Bows have settings that are set based on age, strength, etc. Thats why the investigator can say with some confidence that the bow in the home is not likely to belong to a female.

    This was heartbreaking to hear, not only of the passing of a precious baby girl but what those sweet girls have had to endure. All because their loser of a “so called mother” chose a loser and monster “boy” (he isn’t a man!) over her little girls! I truly hope and pray that the father of the oldest girl is able to turn his life around, step up, and be the best father and parent he can be. It’s time for her to be a little girl and not a babysitter/mother at her age, let alone be beat up repeatedly by her younger sisters! I hope and pray these little girls can all heal from the trauma their abusive parents put them through and allowed them to see. God bless them

    Some of the questions these people have to ask blow my mind!!! “Do you agree the child should not be placed with the father in prison?” I want to see the father disagree and tell them “As the biological parent, the child needs to bunk with me in prison.”

    I realize that no 'cause of death' has been released yet, but I can only imagine... Was this baby 'shot with an arrow'? (either accidentally or intentionally)... The start of this case, focusing on the long bow & whether or not mom was strong enough to shoot one... Horrible case, no matter what, both mom & dad of deceased baby need to be held accountable. PERIOD.

      I think that bit about the bow and arrow was to point to the fact that a male was around and living at the home at the time of the baby's death. Given the CPS history, and the father of the last three children's criminal history, it could be that the only reason mom had custody back was that the baby daddy had to stay away. I think they were trying to prove that along with the video footage etc.

    What made the biological father an a hole. Unless you have been in his position u got no right to say that in such a crazy situation what are u supposed to do what is a parent supposed 2 choose yes being with siblings isnt always better and what if the father firmly believes the child is safer with his family whats the best decision a question your child is safe or be with a sibling? You get to make judgements on a pedestal calling that guy an a hole looking down on him sure ur opinion is understandable until you call that guy a selfish a hole in front of millions of people and a lot will feel they know more about a situation getting a glimpse through a 15 minute video and on top of that you get siblings attacking one another love your channel and appreciate your work please dont stop its just a criticism another perspective

      He failed his kid by being unavailable because of his decisions. He gets to make decisions from a cell that will separate her from everyone she knows and loves? He should be taking care of her, so yes I think he's selfish.
      That said, there are times when separation is better.. very few times, but they do exist. My opinion is he doesn't get to choose for a kid he completely failed

    I’m very confused. Obituary says father is Lewis Massengale of Jacksboro Texas. But on October 16, 2021 there was a standoff in Jacksboro Texas where a man named Lewis Massengale was found dead after he assaulted 2 women, one needing to be airlifted to another hospital. Is the father a jr?
