Welcome to the interesting concept of sovereign immunity! Basically, unless a government has stipulated that they can be held liable for breaking some law, they can't, because no one can force a government to enforce its laws on itself - there is no higher instance for those laws.
That being said, copyright is one of those laws that usually have a stipulation that lets you sue the government, because a lot of it is regulated in international treaties, so letting it go because the state did it would break those treaties.

The Chinese video has so many problems.
I recognize the exact renders they traced into pixelized forms for the video. They switch to generic video game assets part-way through and it just looks super tacky. The mix and match of assets, and the poorly traced artwork into sprites is abysmal.
By Chinese standards it's a masterpiece!

That doesn't sound like an admission of guilt to me, that sounds like doing the thing that they're supposed to do. They didn't know it was copied music before, but they know now, and they don't know if they have the legal right to use it, so they took it down until they could confirm it.

I think what explains the Chinese Mario bootleg is that all across the world, different companies have different copyright laws. China is a bit more laid back in terms of copyright laws. It is hard for companies from other countries to get justice. So a lot of bootlegs from China exist because they can get away with it.
