Nintendo owned the ad and it was their ad. Plus they should as a major company make sure that company didn’t steal anything for it. So it was Nintendo that would be sued if it was liable. Except it wasn’t.

Copyright is so dodgy for music. There are only so many combinations of notes, rhythms and chord progressions that you can put together that will sound good.

Hansen Zimmer was one of my top three favorite composers when I was still in hand. We played a lot of his songs throughout high school.
It's pretty easy to see that they heard the song, checked their licences and couldn't find Nintendo, so they assumed Nintendo didn't have a license so decided to sue, then they found out it was the ad firm that actually licensed it.

I've said this before but I'm always impressed by your ability to pull out super obscure events like this and make interesting videos about them. You're already better at this than most other gaming channels I've watched, and yet you're a lot younger than most of them! Just imagine how good you could get with even more practice and experience. I was a massive Nintendo nerd around the time this happened and I had absolutely no idea it happened.
