      Sir, I have a problem. Yung lupa po namin may titulo po. Nung binili po namin yung lupa andoon po nakatayo yung waitingshed na gawa ng brgy. Ngayon, po for after how many years gusto na po namin ipatanggal yung waitingshed kase gagamitin na po namin yung space. Yung pinagtayun po nung waiting shed ay lupa po namin may titulo na po.

      Tama kayo. Kung walang maipakita ay presumed na hindi siya ang may-ari dahil wala siyang ebidensya. Pero hindi na lang dyan nag tatapos. Hindi ibig sabihin na may titulong hawak at subsisting pa yan. Kaya dapat i-check muna sa Register of deeds(RD) kung titulong hawak ay legit at hindi peke, o maaring naka-cancel na ung titulo hawak at napalitan ng bagong titulo na iba na ang may-ari dahil nagkaroon ng either volunary o involuntary transfer ang titulo at hindi na-surrender ng nasabing titulo o nawala ito at nagkaroon ng Reconstitution ng titulo.

    Atty, May tax Dec. Po sila pero 3 meters LNG ang lupa nila at sa 3meters nila nakakuha po sila sa lupa namin. Ngaun po nagwiddining na po kong saan nabawasan . Kong Yong 10 meters po ay nasunod sa widdining , open na po po sa.lupa namin. Ayaw nilang pumayag kasi May tax Dec sila.
    Ang tax Dec. Po nila na lupa na lot # nila Y 52 41 na tinanong namin sa DENR ay no claimant at kumuha po kami sa main office assessor ang lumabas din po no claimant .at ang lot area po LNG nila nasa tax Dec ay 12.54 square meter.

    Hello attorney gd day may nabili akong lupa almost 12 hectares apat na portion ito magkatabi yung dalawang portion tig 2 hectare may tax declaration yung walong hectares nasa gitna walang tax declaration pero sila ang may ari at nagsaka sa matagal na panahon.may tenant pa sila..maraming niyog sila ang namahala for almost 50 years panahon pa sa kanilang magulang ngayon bininta sa akin tapos ang tenant binayaran surendet yung pagkatenant notaryado..yung portion na walang tax declaration binili ko rin ang right yung pinagbasihan namin yung mga skicht plan sa survey. Tapos yun ang pinagkunan sa technical descreption..para sa deed of sale tapos yung mga skicth plan pinaperma at thumbmark ko yung nagbinta tapos notaryado...ang nagbinta sa akin anak na .pero yung nalalagay sa tax declaration sa kanila pang magulang.....tapos nagtanong ako sa tenant kung wala bang problima ang lupa sabi nya wala matagal na silang tenant mula pa sa kanilang magulang....ang tanong ko attorney safe ba ako sa pagbili notaryado ang deeeds of sale..

      Sad to hear your situation. Sana maging lesson natin na huwag basta basta na lang pumasok sa mga masilang na transaction ng walang ibayong pag iingat o due diligence upang hindi mauwi sa wala ang pag asa at ang perang pinag hirapan ng pinang bayad ay mauwi rin sa wala.

    Hi po atty. Question lang po regarding lang po sa nabili naming lupa, rights lang din po siya and portion lang po yung nabili namin. Ngayon po yung mother po nila ang nakapangalan sa deed of sale and siya din po yung nagbenta samin then yung mga anak po nung nagbenta samin hinarang po kami na magtayo ng bahay sa nabili namin lupa, dahil gusto nila iurong kami or ilipat ng pwesto, may karapatan po ba kami na mag disagree sa gusto nila, kasi ayaw po namin dun sa lilipatan na pwesto. 2yrs na po namin nabili yung lupa and ngayon lang po namin gagamitin.ty po sa pag sagot.

    Gud day po atty may nbili.po akong lupa 127 sqm yung salvage zone or forshore malaki 566 sqm so lumagpas yung salvage zone or forahore sa kabilang titulado iba may ari ngayon po kunin nya yong lagpas n tapat po sa kanila 27 years n sa amin ang lupa ngayon lang kunin nya ang lagpas na slvage zone or forahore na area pwede ba yon

    30 yrs na po kaming nakatira sa ilalim po ng NGPC.Nabili po naming lupa ay rights lng at kami na po ang nagpagawa ng bahay .Pwedi po bang maging amin ito atty

      Naku! Bawal pa ang pag patayo ng bahay sa ilalim ng power tower. At maaring hindi rin valid ang binili ninyong right sa nasabing lupa.Take note further na sa Ilalim ng R.A. No.11361, otherwise known as the Anti-Obstruction of Power Lines Act, which was passed by Congress on Aug 8,2019, ay maituturing na criminal act ang pag labag nito, sa pagpapaytayo ng ano mang straktora sa lupa, beneath, air space, surrounding and the area including its horizontal, vertical and similar clearances requirements , ay maituturing na mga prohibited acts ang sino mang mag tayo, occupy, plants, or install any improvement within 3 METERS from the ground. (Sec.4(t) R.A. No.11361). Ang power line operators, law enforcement agencies at ang local government or concerned citizen may file the necessary complaints the perpetrators.

    Good evening po atty, tanong ko lang po matagal napo kaming nakatira dito sa tirahan namin,kaya lang meron pa pong bakanteng maliit na lupa dito sa harap ng pintuan at bintana po namin,kaya lang ung pinsan namin inaangkin nya ang harap na bakanteng lupa namin,kaya po ang ginawa nya ngdala na sya ng buhangin at hallow blocks dito sa tapat po ng bahay namin eh wala pa po kaming napagtapos na usapan sa barangay

    Good morning Po, may karapatan Po ba Akong iclaim yong award na lupa Ng DAR sa father ko na dati Siya ay tenant at Meron Po siyang Dar certificate na katibayan ngunit Ang father ko Po ay Patay at aq Ang pumalit na tenant sa lupang sinasaka niya noon.     Hello po attorney,
    Papatulong sana ako about sa lupa na tinitirikan ng bahay ng parents ko since 1959 if im not mistaken.
    Wala po sila land title since ibinigay o pinahintulutan lang ng may ari ng lupa noon. Ngayon po wala na sila at need na namin i repair yong bahay at kailangan kumuha ng building permit. Ano po ang gagawin namin para makakuha ng permit.
    Sana po attorney mabigyan mo ako ng advise.

    Tapos ngayon my Asawa na Yung Lolo ko nagpakasal Siya ulit my karapatan ba Yung pangalawang Asawa Ng Lolo ko maghabol sa Bahay o sa as Ng Lolo ko sana masagot ..
