    Hi! Sir Atty.Raymond Batu! Maraming salamat sa pagtalakay tungkol dito sa deed of sale. Marami po akong natutunan. Ganito po ako nakabili thru deed of sale. Ngayon po ay na assign na po sakin Ang tax declaration thru in good faith ng City Hall. Ako po ang magbayad Ng tax na d binayaran ng 17 years. Dahil wala po akong alam sa mga kailangan na bayaran tungkol dito. Bumaba lang ang taga City Hall at at Binigyan na lang po kami ng 4 days para mabayaran ang property. At naka utang Ako dahil napakalaki Ng kilangang bayaran. Kapital tax at gain tax, kaya nalagay na sa pangalan ko Ang tax declaration.

    Gud after noon Atty Batu, 1972 pa ang lupa na nka name sa tax dec ang ttay ko, since then yearly na po kme nagbabayad ng taxes up to now, meron kme Zoning cert. Court cert at sketch plan, pro wla po titulo kc marami may interest sa lupa . Ang DENR po binigyan kme ng less than 2 hectars at ang less than 5 hectars ay timberland dw po.

    Maganda yung content niu sir andaming details completo kaso yung specific sana na details na hinahanap ko medjo pa hapyaw yung explanation yung regarding sa tax declaration lamang ang hawak ng seller na proof of ownership napaka short ng discussion, may plano kasi akong bilhin na house and lot pero bukid yung area at walang title tax declaration at survey lang naipakita ng seller tapos yung tax declaration eh hahatihatiin pa

    Napakahirap po s amin na bumili ng properties dahil wala namng information dissemination ang gov't para matutunan nsmin, unless.we consult a lawyer and we still have to afford him yet everything thst you explained wont be completely learned from them. Opportunists out there, victimizing us. Dreaming thst a local govt will spare us its time for a lecture knowing we're ignorant and that money is hard earned.

    Atty..matanong poh.. Halimbawa po bangin nyung boundaries ninyo.. Tapos ung bangin natubuan ng mga punot kahoy.. Sino po bha ang may rights sa bangin nayon.. Ung nasababa bha na may ari ng lupa o ung nasa taas.. Salmat po..

    Atty. Batu marami pong salamat sa kaalaman na naishare po ninyo. God bless po. Pero papaano naman po kasi ganito yung case. May ibinibentang lupa yung Title is under Developer pa po kasi si Juana Dela Cruz hindi pa po fully paid. Pero gustong ibenta na ni Juana Dela Cruz yung lupa. According sa agent po kung bibilhin namin yung lupa eh mag eexecute ng Transfer of Rights si Juana to the buyer po. Kaso po Single si Juana nung kinuha niya po ang lupa. Gusto po sana ni buyer na may consent yung husband and dapat mag reflect sa Transer of Rights na married siya kasi ngayon married naman na si Juana. Pero sabi ni agent hindi na ina allow ni Developer na echange pa po yung status at ang surname kasi mag iiba sa records nila. Wala po bang legal constraints kapag single pa din siya sa Transfer or Rights po? Ano po kaya ang ibang legal remedy na may consent si Husband sa pag Transfer ng Rights po? Nawa'y matugunan po yong concern ko po. Thank you in advance.

    Pwde po bng malaman yun loc.Nio sir? kc po ko sna humingi ng legal advice pra sa rights ng lupa ng mother ko po. Binakuran po kasi ng ibang tao yun pinaka rghts ng mother ko. Pra malaman din po nmin kung may laban po ba kami.

    May question lang po ako. Meron pong 100 hectares ang kaibigan ko sa Bicol. Tax declaration lang po ang hawak nya. Gusto niyang ibenta pero ang sabi ng bibili ay ang may-ari ang mag-asikaso ng transfer ng tax declaration.
    Nagtanong kami sa DAR. Kailangan daw po ng Land Transfer Clearance. Maibebenta pa ba namin ito dahil lagpas sa retention limit na 5 hectares. Salamat po and more power!

      ang alam ko kung first time application for land title patent ng alienable at disposable land, ang maari lang ma angkin ay 12 hectares. "Under Section 3, Article XII of the Constitution, Filipino citizens may acquire no more than 12 hectares of alienable public land, whether by purchase, homestead or grant. More than that, but not exceeding 500 hectares, they may hold by lease only."

    Tanong ko ang absolute sales ho ba halimbawa na saad duon 1967 pa ang bilihan tapos ngayon ng discover na may bilihan na nangyari e gina claim ng apo yong binili ng lola nya e sya daw na may ari mga patay na po yong binilhan at yong bumili ano po ba poseble ba po na sa kanila yon lupa?     Please atorne tulungan mo po kme kung pano nmin na solve itong problema, total area ng lupa po is 60,576 meron po kme cadastral card nung 2015 nag issue po ang DENR ng A&D Cert sa whole area na 60,576 but lately pinadalhan kme ng DENR Ilo2 na ito ay timberland .pki explain po kung ano dpat namin gawin.     Attorney sana po mapansin niyo itong aking katanungan. Paano po kung ang isang lupa ay may rights ngunit nakapangalan ito sa tatlong magkakapatid. Yung isa po sa tatlong magkakapatid ay ibinenta ang lampas kalahati ng nasabing lupa at ito pa ay nagpatayo ng bahay bukod sa lupa na kanyang ibinenta. May habol po ba yung dalawang kapatid nya sa ginawa ng nagbenta? Ang nakapagtataka po naibenta ang rights ng walang pirma ng tatlong magkakapatid. Salamat po and more power

    may anong po ako Sir, may tax declaration pong hawak ang nanay ko sa lupa namin sa probinsiya na inangkin ng isang tao na mayroon daw pong nagsanla ng lupang yaon sa kanya at may pinakita po siyang deed of sale na nandoon po ang pangalan ng aking Lolo na katunayan na sa amin ang lupa, at ang mga nakatira sa paligid ng aming lupa doon ay alam na pagmamay ari ng lolo ko ang lupa, sa kapatid po kase ng lolo ko ang lupang yaon at ibinigay po sa aking lolo, noong mga panahon ppo kaseng yon ay tiwala po masyado ang aking lolo na walang mang aagkin ng aming lupa dahil kapatid nya naman ang may ari at nagbigay nito sa kanya kay hindi na po siya nagpagawa pa ng titulo. Ang aking tanong po Sir ay kung sapat po bang katibayan ang aking mga nabanggit sa itaas upang gawing katibayan na pagmamay ari ng pamilya ng aking ina ang lupang yaon at hindi po sa pinagsanlaan? sa akin lang po kaseng palagay Sir wala po silang karapatang paupahan ang aming lupa at angkinin ito ng walang abiso mula sa aking pamilya. Ano po kaya ang maari naming gawin. kailangan po sana namin ng attorny na makakatulong sa aming kaso at maipapangako po namin na amin po siyang mababayaran pag napasaamin na po ito at maibenta sa karampatang halaga. marami pop kaseng gustong bumili nito dahil po ito ay nasa commercial na lugar tabing kalsa ng national road may gasolinahang gustong bilhin ito.

    Atty.yong case po ng lote ng 3 owners dati..tax declaration lang po ang hawak ng original owner.Puwede po bang maging witness yong original lot owner para ideclare yong original measurements ng kanyang lote at buhay pa naman atty.When I suggested na kausapin namin through video call at nasa North Carolina..bakit pa nasa malayo naman sagot niya atty.

    Ano po ba ang batas ngayon sa pagsusukat ng lupa.nagpasukat po kami ng lupa ang ginamit ng geodetic engineer ay yong natural boudary ngayon po magpasukat ang katapat naming lupa na may boundary buhay na creek .kiniclaim po nila yong more than 400 meters ng aming lupa ay boundary po ay creek.     Atty, magtatanong lang sana Ako kasi yong seller na binibilhan Ng parents ko title kasi yong pero Hindi napatransfer Ng parents ko yong title Ng lot kasi walang record sa registry of deeds. Ngayon wala na Ang parents namin Po Atty yong pangalan sa ax declaration nakapangalan na sa among dalawang magkakapatid. Ngayon Atty.     Hi Sir, I have sold a house and lot with DBP loan with assumption of mortgage and gave the buyer two documents: one conditional deed of sales and two absolute deed of sale duly signed by me once the loan is paid. Fast forward, lately this year I was surprised the tax declaration of that said house still on my name and upon inquiry to my buyer, I learned that although the DBP loan was duly paid, the owner did not able to transfer TCT of the land to their name due to negligence and still on my name, henceforth, the tax declaration is not paid since that year. Thus the survival wife would like to sell it back to me which I have no problem yet I have no legal procedure what’s the best manner to undertake it back.     Paano po malalaman na ang lupa na binibile ay do nakasanla ng dalawang beses. May karapatan po ba na idemanda ang may ari ng fraud or scam sa hindi pagsasabi na ang bineventa nilang lupa ay nakasanla pa. Tax declaration lang ang pinakita. Legit ang may ari ng lupa pero nakasanla sya. It's a agricultural land. Ano po ang magiging status ng bumile na fully paid na.

    Atty , dami kung natutunan sa u buti nalang pina nuod ko ito kasi balak ko po bumili bahay at lupa na galing sa Association ,tanung ko lang po anong mga documents dapat prepare bago mag bayaran aside sa transfer of rights po na documents , at kelan ko po dpat magbayad o ibigay na ang pera sa seller . San po pwd sade na magbayad sa bangko or sa bahay lang po. Slamat po Atty.

      Ibig sabihin binili nio ang bahay na nakatirik sa isang lupa na pag mamay-ari ng gobyerno (in this case, ng barangay), am i correct? If yes, yung sale ng bahay ay ganap na between your mama at nung dating may-ari

    Thank you po sa video na to, malaking tulong, ask q lng po, Safe po ba bilhin at itransfer ung title na may kondisyon sa last page na : “that such land shall not be sold or in any manner transfered except by hereditary succession or to the government.
    Bale po ung original owner na transfer sa anak thru deeds of absoulete sale then si anak bininenta sa akin, hindi po kmi magkamag anak. Thank you po in advance sa advice.

    Good day po atty, Sir may tanong ako about sa rights lang na lupa... Ano po ba ang basihan sa rights na lupa ?? Yung actual occupancy po ba o yung papel na may survey ang pagbabasihan??. May kapit bahay kasi kami na kukuha sila ng 2 meters sa area namin kasi kulang daw ang nabili nila na lupa... Eeh ang problema may fence na po ang area ng lupa namin... Sana po mapansin..

      splitting of title, ibig po sabihin bibikain ang buong parte ng lupa sa pira piraso or portions. so kung 1000 square meter at bibiakin into 4 portions equally, mangyari nian 250sqm kada isa. ang may karapatan po mag splitting ay ang may ari ng lupa
