      @@BatasPinoyOnline magandang araw po sir.. Sana po makagawa kayo ng video tungkol sa pagpapaupa ng bahay. Ako po ay isang ofw at plano ko po magpagawa ng Residential duplex house on my retirement. Ang tanong ko po Pede ko po ba paupahan muna ang residential house ko? Paano po ba ang gagawin ko para hindi ako magka problema sa tenant ko? Gusto ko sana magkaron ng kontrata na kung kakailanganin ko na ang bahay ko maari ko na makuha na may 6 na buwan abiso. At gusto ko sana ilagay sa kontrata na kung ano man masira ( dahil bago ang bahay at sila ang nagamit) ang tenant ang magpapagawa. At paano po ako mag iisyu ng resibo sa kanila sa monthly payment nila? dahil residential nga po.

May nabili kasi akong lupa na medyo nagka.problema dahil nag.double title. Nag.issue ang DENR ng Residential Free Patent pero mayroon palang OCT dated 1965 pa. Pero somehow na.solve ko rin naman Atty.

What is the repurcussion if any being a public officer (intentionally or wrongfully commit an act to mislead the rightful owner of his boundary lines. I know it aggravated the acts.       Base sa kwento mo, ay dapat kailangan ninyo ang professional assistance ng lawyer. Upang masuri at mapag aralan ang mga kaakibat na dokomento at upang mag karoon kayo ng definite cause of action na either ma recover ang full possession and ownership sa nasabing lupa.       Kung kayo ay nakatira sa nasabing lupa since 1968 pa bilang nag mamay-ari or in open, adverse, continuous possession in the concept of an owner, at hindi bilang tenant lang or umuupa o tagapamaha lang, at pinagbabayad ninyo ang amilyar ang lupa sa inyong munisipyo, ay panindigan ninyo ang inyong karapatan. Ipag laban nito sa korte. Makipag ugnayan kayo sa lawyer for further assistance .

    Hello po attorney! Napakalaking tulong po ang program niyo. May problema din po ako tungkol sa aking nabili na lupa mula sa tito ko po. Mana niya sa lolo ko. Nakapangalan sa lolo ko po ang Tax Dec noon pa po. Nabili ko po ang nasabing lupa noong 2005 pero hindi ko po kaagad naipa title kasi busy po ako palagi at panatag din dahil kay uncle ko lang naman nabili. May naglilibing po sa bandang itaas noong bata pa po kmi pero bumaba sila. Ipinagbabawal ni tatay pero sige parin sila. Kahit anong gawin naming pagbabawal hindi po sila nakikinig. Alam po nila ang mga bounderies pero nagmamaang maangan po sila.

      Maaring makasuhan ang sino mang nag alter o nag lipat ng muhon na hindi naman sila authorized sa ilalim ng Criminal offense sa ilalim ng Art.313 ng Revised Penal Code. May kulong at multa ito hanggang P20K.

    What about atty. , the land has a title. Sa titulo sampung may-ari ang nakasulat. Merong kasulatan sa nagbigay ng lupa na bawat isa ay tatanggap ng 60 square meter each. Pero may ibang nakapangalan sa titulo na inilipat ang mohon para maging malaki ang share nila. May iba na naging 100 square meter na ang lupa nila instead of 60 square meters. Yung iba lumiit at naging 45 square meter nalang instead of 60. Pwede pa bang mabawi? May titulo na bawat isa ngayon. Hinahati-hati na pero hindi na tag 60 square meters each. Meron nang may 100 square at ang iba 45 square meter nalang. Parang ninakaw ng ibang owners ng lot kasi inilipat nila ang mohon. Pwede pa bang ereklamo para makuha ang exact square meters which is 60 square meters each?

    We have the same problem. Our neighbor moved the boundary. Hinukay nya tapos nagbakod.. Medyo matatapang ang pamilya kaya hindi makausap ng maayos.
    May title po kami. Nagbigay na lang po kami ng kaunti pero ayaw pa rin nila at gusto malaki ang kunin, hanggang namatay na 'yung nagbakod. Stuck pa rin kami na may bakod yung lupa namin. 😔

      Tulad ng natalakay sa video, maari kayong mag file ng criminal complaint laban sa taong nag alter ng boundaries o mujon ng property at ayon sa Article 313 ng Revised Penal Code as amended, provides: "Art. 313. Altering boundaries or landmarks. - Any person who shall alter the boundary marks or monuments of towns, provinces, or estates, or any other marks intended to designate the boundaries of the same, shall be punished by arresto menor or a fine not exceeding Twenty thousand pesos (₱20,000), or both."

    Good afternoon Atty. Magtananong lang sana ako tungkol sa Señor Citizens Act. Kasi atty. Ang mother namin mag84yrs old na sya this July 26, 2023 pero hangang ngayon wala pa syang pension . At noong pandemic hindi rin nabigyan nang ASAP.

      Hindi maliwanag sa kwento at tanong mo, kuing anong klaseng, nature or purpose ng nasabing award ng lupa ang tinutukoy mo at anong ahensya ng pamahalaan ng ang award nito. Magkaganoon pa man kung ang ultimate end ng pag ka award ng lupa ay full ownership ng lupa after the compliance of the terms and conditions nito sa hinaharap, ay maari naman ninyong ipa survey ito dahil mayroon na kayong rights or interest sa nasabing lupa, for titiling purposes in the future.

      Baka ang ibig mong sabihin sa BOS ay VOS, or Voluntary offer to Sell na kung saan ay ung private land na agricultural land ay nasakop ng CARP or Comprehensive Agrarian Reform Law(CARL) ay maaring mag makipag kontrata sa DAR na kusang loob niyang pinag bibili ang kanyang lupa base sa fairmarket value nito. For more details sa usaping ito ay makipag ugnayan kayo sa DAR na nakakasakop ng inyong lupa for more information at mga kakailanganing mga requirements.

    Atty. Magandang Gabi Po npapanood ko mga video s niyo tungkol SA usapin Ng lupa.. Ang problem ko pinapaalis na kami Ng may Ari Ng lupa Kono saloob Ng 1 month na palugit. Samantala kami Ng babayad Ng tax declaration SA loob ng mahigit 50 yrs. Pinapabayaran sa Amin Ang lote SA halaga Ng 350 o 500k Isang bagsakan lng Po. SA sukat na 110.42 square meters lng SA probensiya. Ngkataon Po na Wala PO kaming ganoon halaga.. Kaya naibinta Niya SA Iba . Ora orada pagpaalis samin. Ang Tanong ko Po Kung may karapatan pa ba kami pabayaran Ang Bahay naitayo nmin . Kasi ayaw Niya bayaran. Wala manlng relocation.. maraming salamat Po SA iyong pagtugon atty. God bless PO.

      Kung kayo ay pinayags ng may ari na mag patayo ng bahay at kung mapapatunayan na kayo ay builder na faith, may option ang landowner na bayaran o bilhn ang bahay pero ung ang halaga ng bahay ay mas malaki ang halaga sa lupa ay maaring bilhin ang lupa o magbabayadng rental ang may ari ng bahay. Kung di magkaka sundo ang korte ang mag fix ng upa.For now, manatili kayo sa bahay . Maari lang kayong mapapaalis kung mayroong final at executory order ang korte matapos ang gagawing pag lilitis sa inyong kaso. Maki pag ugnayan kayo sa lawyer for professional assistance.
