      Mali na sabihin na grabe ang gobyerno dahil power of the state yang expropriation as last resort. At isipin mo rin na ang government ay mag dedeposit sa court ng 100 percent ng zonal value. Kaya nga ang suggestion ni attorney ay negotiated sale.

      Lahat ng kalupaan ilog, dagat at bundok ay pagaari ng gobyerno. Ang sa mamamayan ay karapatan lang na gamitin ito, sa pahintulot ng batas. Dapat nga ang value ng property mo ay ibase doon sa halaga na ipinagbabayad mo ng buwis.

      God ang nag create ng land , sea at iba pa hindi ang gobyerno (God is the true owner at ang tao) Ginawa ni God yan para sa tao. Ang gobyerno binuo at pinagtibay ng tao para magkaisa at maiwasan ang kaguluhan sa isang bansa para may peace and order at mamumuno. Ang prublema ang tiwaling mambabatas at namumuno. Di ba nitong 2016 lang isina batas yang right of way para di maantala ang mga proyekto. Sana ang ginawang batas ay pabor sa naargabyadong land owner. Binayaran nila ang tax ng maraming taon at bigla nlang kukunin ng gubyerno sa kaunting halaga . Kung sa inyo mangyari yan matutuwa ba kayo? Kung ang ginawang batas ay babayaran ng tamang presyo maiiwasan ang prublema. Sana binawasan nlang ang pondo ng mga mambabatas at idinagdag sa mga apektadong mamamayan mas ok pa siguro. Alam nman natin maraming katiwalian at marami rin ang nagbubulag bulagang namumuno dahil sa personal na interest at kapangyarihan . Sana nung pinagtibay nila ang batas na yan ay sana inisip nila na sila yung land owner para naging tama ang kanilang panukala.

      Ang mga puno ng kahoy na nakatamin ng private na lupain pag ito ay pintutol ng walang permit ay pinagbabahal ito at maaring na-confiscate or pina ilalim sa custody ng DENR. Kung wala naman kayong kasalan at walang kinalaman sa pag putol ng inyong puno , ay maari kayong makipag ugnanayan sa DENR upang mag-request na mapa sa inyo ung mga puno. Assuming na hindi ito mai-turn-over sa inyo, ay maari pa rin kayong mabayaran sa mga nasirang mga puno(replacement costs) at iba pang straktora na tinamaan ng road widening ng implementing agency(DPWH) sa ilalim ng Right of way Act or R.A. No. 10752.

    Good afternoon po attorney un nabili ko pong mga bukid ginawa pong kalsada sa tabi malaki po ang nakuha NG gobyerno na parte NG lupain ko pero dpo kmi nakatanggap NG anuman compensation. tama po un na ganun na lng po. basta na lng inakupahan ang lupain ko? maraming salamat po

      Atty.tanung po.meron akung commercial.unit.pina upahan ng misis ko.ng 5year. Pero hindi pina alam sakin na 5year.ang pinagkasundoon .nila sa ng rent.sa unit ko .kasi sa abroad ako.ngayun gusto ko .baguhin ang contrata .kahit 3year nlang.kasi gamitin ko ang unit.tanung ko po atty .maykarapatan ba ako.baguhin ang contrata .ilagay 3year nlang .salamat.po.

Saan po kami pwedeng lumapit na ahensya ng gobyerno para ma-update ang aming original title? Ano pong implikasyon nito sa pagbabayad ng property tax? Salamat po ng marami!

    Atty..may katanungan po ako sa inyo. Nakabili po ako nang lupa na may sketch plan na at mother title palang po ang meron. Nabili ko po ang portion nang lupa na may sketch plan na at deed of sale.     Attorney, tanong lang po nakabili kasi ako ng lote may titolo naman ang kabuuan bali binili po namin yung 100 square meter bumawas sa isa kabuuan ng lupa, naipa survey ko na po at nabayaran ko na dahil kailangan ko ang lote, tanung po bakit po ang tagal dumating ng approval ng survey, 20k po binayad namin dahil daw po sa pandemik 1 year na po wala parin ang approval

      Maki pag ugnayan kayo sa City Government at alamin kung anong basihan nila sa pag sakop ng inyong lupa at sa anong paraan nila itong naisagawa. Naisagawa man ito base sa power of eminent domain, ay entitled kayo ng Just Compensation, whether the project is undertaken by the national or local government. Ito ay guaranteed ng saligang batas at mga kaakibat na mga implementing laws and regulations hinggil sa pag take over ng pamahalaan ng private property for public use and purpose.

    Good evening po Attorney, pasensya na po at narito na nman po ako upang magtanong.Tungkol po ito sa ROW PROJECT ng National govt. Kung tinanggap na po nmin ang kabayaran sa masisirang bahay namin mula sa implementing agency -DPWH. Kanino po mapupunta ang mga MASISIRANG gamit ( after na binagbag o giniba) tulad po ng yero, bakal, kahoy, puno at iba pa? Sa amin po ba oh sa DPWH o CONTRACTOR???

Ang problema lamang po ay walang pinapakitang legal assessment o anumang papers (document) sa properties po nmin (structure/ improvement). Basta na lamang po nilang sasabihin na " Heto ang ibabayad namin" na malayo po sa halaga nang masisira. At isa pa po forman na po ng contractor ang nagsasabi ng presyo. Makatarungan po ba ito Sir? Kung sakali po na aabonohan ng contractor ang kabayaran di po ba dapat ipakita muna ng IA /DPWH kung magkano ang assess value po nila??? At muli maraming salamat po Attorney

      Dapat sa kinatawan or authorized officer ng DWPH higjways kayo makipag usap tuland Provincial or District Engineer at hindi sa contractor. At tulad ng natalakay sa video ay dapat may offer at kaakibat nito ay ung independent appraisal report ng value ng inyong property na galing sa Land Bank upang mag karoon kayo ng well-informed na basihan sa inyong decison whether nasa "Just Compensation" na presyo ung offer ng Implementing Agency(DWPH). Makipag ugnayan kayo sa mga nasabing Provincial/District Engineers/Officers ng DPWH upang maitama kung mayroon mang kamalian ang nagawa sa inyo sa ilalim ng "Right of way Act or R.A. No. 10752.

      Good pm po. Paano po kung matagal ng kinuha na po ng government ng right of way sa portion ng lupa pero hanggang ngayon wala pa pong ibinabayad sa owner? Ginawa pong kalsada yung portion. Ano po ang dapat gswin at kanino dudulog? Ang kaibigan ko po kasi ay 84 yrs old na at nahirapan na ring mag follow up. Nakapangalan po ang lupa sa mga magulang po nya.       @@evangelinefairyrosimo8032 Ma'am basi po sa nasasaksihan ko, once po na "NAKADAAN"( Already built) na cla sa private property na wala pang naibayad eh may kalabuan na pong makapag claim.
      Sa dami po nmin na dinaanan ng road widening, dalawa lang po kming natira na hindi ginalaw dahil hindi kmi pumayag na walang documents (Katunayan na sa ganoong halaga lamang ang kabayaran) sa gagawin nilang pagbabayad sa masisirang structures (land is not included dahil hindi sa amin dahil sa mga ninuno pa nmin but sabi nga po ni Sir BATAS PINOY ay obligadong bayaran ang masisirang structures oh bahay at pananim).Ayaw po nilang magbigay ng legal documents kya di po nagkasundo so nilihisan na lang po kmi.

      Kung mayroong umangkin sa inyong lupa, at mayroon naman kayong proof of ownership, tulad ng titulo or tax declaration certificate or dokomentong nagkaloob sa inyo ng real rights sa nasabing lupa ay manindigan kayo. Sino ba ang nag issue sa inyong ng " OC", owner cultivator"?? Kung ung OC ninyo ay hindi naman galing sa legit na may-ari or ahensya ng pamahalaan ay maaring wala kyong "real right" na maituturing ng pag aari ng nasabing lupa. Alamin na rin ninyo kung anong basihan na dokomento ung nag claim or gustong angkini ang inyong lupa? I-check ninyo sa Assessor's office or Register of deed(RD) kung legit ba ung mga dokomento ng claimants.

    Sir good eve. Ask ko lang about sa lupa namin, pinatayuan ng brgy ng water reservoir,. Ano po ang right namin or karapatan ? Gusto ng brgy na e donate lang daw ang area na pinatayuan ng reservoir, which is from the beginning hindi sa amin nagpaalam bago nila ito pinatayuan.

    Very informative video. Atty tanong ko lang, yung part po ng lote ko ay nagamit sa construction ng diversion road sa pamamagitan ng expropriation. Hindi pa nasemento lahat kasi 4 lanes pa lang muna ang ginawa kaya meron pa po hindi nagamit at hindi pa rin kami nakakapagsubmit ng documents sa dpwh kaya sa amin pa din nkapangalan yung part na hindi pa sementado sa tabi ng kalsada. Maaari ko pa po ba gamitin o paupahan yung space kahit kasama na sya sa road map ng dpwh kung hindi pa nman ginagamit ng gobyerno at sa akin pa nkapangalan ang titulo? Salamat po.

Although sa mga nasirang mga tanim , kabahayan ay maaring entitled kayo ng REPLACEMENT COST ng mga ito sa ilalim ng R.A. No.10752 otherwise known as the right of way Act.
