ADA violations can get really expensive, super quickly, as multiple violations increase the fine dramatically.
Now, to Nicholas, what statute would the litigation be brought under? If any are tempted to say HIPAA, you're wrong, as neither the school or professor are insurance or health care providers. Privacy is dicey, again, a statute is necessary for litigation.

Story 2: In the 1980s I had a professor who didn't want any papers given to him which weren't typed on a typewriter Most people then who had printers for their computers had dot-matrix printers, so anything printed on them would be easy to tell. Right after the professor made this announcement I got up, informed the class that I was a Navy Chief Yeoman (admin and personnel specialist) and at work I had an IBM printer that was based on an IBM Selectric electric typewriter. Also I had WordPerfact, WordStar, and IBM Word installed on my computer. So if anyone wanted to compose anything on their computers using any of those word processing programs, do so and give me the paper on disk so I could print them. I even mentioned that I could print using Prestige Elite (12 pitch), Courier (10 pitch), or several other typefaces. The professor was not happy with me and made some unveiled threats. I told him that if he wanted to play silly games I could play them too and, as a Navy Chief, I had received formal training on how to be an asshole. Many of my classmates took me up on my offer.

But. Im an exchef and love to cook and even tho at the time I couldn't really taste salt or sweet but if I didn't put salt or sugar in the food didn't taste right lol. Its hard to explain lol.
But my daughter, who didn't really want to learn to cook, has decided she likes cooking and often calls me. Mom it doesn't taste right. I ask for ingredients and usually its a bit of salt or sugar missing or a tiny hit of some type of acid to pop the flavor.
Also we found with lower salt cooking(for my hubby diet) that adding a tiny pinch of salt at the table(with in his alloted amounts) adds more salt flavor than items that had the salt added during cooking. So I do cook with a bit of salt but usually much lower and portion out hubs salt.

Yea, ADA is literally a federal law. No school administration (with halfway intelligent individuals running it) want the federal government on their butt about discriminating against individuals with disabilities. I’m going into education and we had to take a class that taught all about different types of disabilities or different situations children you may be working with could potentially have, and the one thing that is at the core of everything is the IEP (in the US at least). That is drawn up with the student, their parent, and a member of staff (and other individuals as needed) to ensure that student gets the help they need. It can be super simple (using a tablet for school work) or super detailed and specific based on the needs of the individual. A story on reddit not too long ago was about a student who had an IEP that allowed her a snack in class due to her diabetes I believe. And the teacher got fired after multiple instances of claiming “no one else eats in my class, so you can’t either.” Meanwhile another teacher allowing the student to eat her snack before her class is the only thing that kept her from passing out. I knew a girl finishing her senior year classes over the summer who had several points of her ADA (extra time for assignments, extensions for deadlines) that she admitted her teacher was violating. I felt bad for her as she was telling me she was struggling to keep up with her workload, especially since she was also working at the summer camp I worked at. I about lost it when she mentioned she had an IEP that the teacher was violating. I told her to tell her mother (who was in a better position to advocate for her, since the camp was in the mountains with little signal) and that this was not ok. She said she had, and not much had changed. Every time I think about her situation, it makes me want to be better for my students. Because no child who already struggles with school is going to benefit from you not giving them the tools they need to succeed, especially when you legally have to if it’s in their IEP. And IEP’s can be changed, but even my fiancé had a teacher who tried to get him in trouble for using his tablet to take notes in class. He now hates history because of that jerk of a teacher ruining a subject he used to enjoy.

    • @spvillano

@@robertjohnston8541 from an ADA compliance site:
Violations by ADA accommodations generally involve a failure to provide access, amenities, or services to people with disabilities. Failure to follow ADA standards and requirements can lead to penalties and even private lawsuits. The lawsuits are merited if injuries or blatant discrimination were caused onto the person with disabilities.
Hefty penalties await those business and organizations that do not abide by ADA standards. The first violation penalties can go as high as 75,000 USD while subsequent violations go up to 150,000 USD.
People with disabilities may file an ADA lawsuit to a federal agency as well as obtain federal court orders to stop ADA violations. Complaints are directly filed with the Department of Justice Civil Rights Division in order for an investigation to begin, followed by an attempt to resolve the complaint.
The Department of Justice Civil Rights Division is located in Pennsylvania, Washington D C.
The complaint alleging disability discrimination must be filed within 180 days of the date of the alleged acts of discrimination or violation against you or a person with disability.
If you or another person has been discriminated against by an entity covered by the Americans with Disabilities Act (ADA), you may file a complaint alleging disability discrimination to the DRS. The DRS is the Disability Rights Section in the Department of Justice.
It's recommended going local board or county, then state, if no action is performed to remediate the unlawful discrimination, the DOJ civil rights division will take appropriate action.
Given the fines and civil awards in civil litigation, I imagine that the local school board would crucify the scofflaw teacher and for entertainment, remove the nails from the hands and watch the teacher hang by the feet - well, in a more lawful disciplinary action. ;)
I'm aware of one extreme case where a teacher lost her retirement, as it was her final year before retirement, she refused to comply with federal and state law and the school board had no other choice than to terminate her for cause.
Just because you're retiring doesn't mean that the supremacy clause in the Constitution becomes null and void!

I have great respect for the pet store workers. I have over ten years of fishkeeping experience and you absolutely must take certain parameters seriously or fish WILL die. It's guaranteed. Quick example: show of hands, how many of you think Karen would have dechlorinated her water first? Chlorine = death within hours.
Karen thought that she could just put a starfish in a 5 gallon tank with salt and it would be fine.
Not only that, but starfish require more advanced saltwater aquarium care. I personally wouldn't sell a starfish to a customer unless they can demonstrate that they know *exactly* how to maintain a saltwater aquarium and list the equipment they have and the maintenance they perform and the nutrients they plan to introduce to the tank.
Besides, we ALL know that if somehow Karen had gotten away with her purchases, the starfish would have died and then she'd be back in the pet store accusing everyone of being at fault but herself, demanding a manger, demanding her money back for ALL of the equipment, threatening to sue, yadda yadda yadda. The starfish and the employees definitely avoided a bullet.

The professor story struck a nerve with me. I, while in my 50s, had to attend a community college to change my career path. I was physically injured and could no long do heavy lifting, etc., but not so injured that I couldn't work. Two separate professors had said something during their classes that I felt necessary to correct immediately. Both kept referencing the KKK as a Republican party construct. I corrected them both in class in front of my fellow students, most all of which were in their 20s. The older one said he didn't want to get into that debate in the class and never brought it up again. The other said "Yeah, but that's not the popular view of the KKK." To which I told him "That's because teachers like you keep enforcing the lie. And they trust their teachers to be telling the truth." Since that was an elective class and the comment was made in passing during a conversation about societal norms, the subject wasn't going to be covered again. I only mention this to commiserate on how poor our education system has been corrupted and, in my opinion infiltrated by liars feeding the kids garbage with their slants put on them.

Actually, it's easy to live on a No Sodium Diet...IF you understand that a critical word was left out of the name...
It's actually a No Sodium ADDED Diet, there is MORE than enough naturally occurring sodium in the foods we eat that we DON'T need to add more during meal preparation.
Such a diet WILL be fairly bland tasting mind you (as Sally found out), but you can life a very health life on it...
Much Healthier than our typical High-Sodium Diets actually, adding lots of salt typically leads to increased risk of High Blood Pressure and it's associated diseases...
If you really think you're getting too much salt, talk to your doctor and a dietician and shift to a Low-Sodium Diet and start drinking a LOT more water, drinking 2-3 times the amount of water you normally do will help flush excess salt (among other things) out of your body...

OMG that "Sally" at the dinner table who just wanted attention and to start drama (I bet she didn't think OP would actually go through the trouble of making sure EVERYTHING was salt-free). That's the kind of person that someone might do well to cut out of their social life (unless everything else about them is wonderful). That was a LOT of work for the OP, who, while preparing a lot of food, makes ONE PLATE special.
I think those on salt-free or low-sodium diets, if they have REALLY been on one for awhile, stop missing it. They get used to the lack of salt and use other means to add flavor. (If Karen really was "salt-free," and claimed how GREAT it was, she should have actually brought a dish that she felt was both salt-free AND delicious).
She's lucky the OP was kind enough not to make a fuss by overly "worrying" about her health and saying 'Oh no, I can't let you do that (adding salt) since if you're in a salt-free diet, that can be really harmful and you've been so adamant about it, it's got to be really serious. I care too much about you to allow you to risk your health. That's why I took the time to make sure your food was completely salt free." That would have been fantastic, but I'm sure she wanted all guests to enjoy their food eventually. :)

I did this not because I hated them or didn't love them. No, I did it because I loved them more than anything else in the world at the time. I knew I couldn't give them the life they needed, and that she would since either she or her family would be able to take care of them and I couldn't because of work, school, and social life. It was an easy, but very painful, decision to make
So people like the Karen in the story REALLY bother me. Pets don't get to choose the life they live. People need to give them what they NEED to live a happy life. They live short lives, make it pleasurable for them, make them happy, and they will repay it in spades.

Had he not been reported that year, he would have attained tenure and continued that behavior but with tenure it would be near impossible to fire him.
Imagine how many horrible professors and teachers get tenure and are pretty much untouchable… no wonder why education in the US is nearly the worst in the world.

So, I had a professor that was Muslim my second go through college and that'd normally not be an issue. However, he was tenured and horrendously anti American (I'm in America) and would go on about how lazy and horrible we all were. This went on with me recording (single party consent state) for three four hour courses. Halfway through the third class (I had to drop by the end) I stood up and told him that if he hated the US so much he could take his racist misogynistic ass back to Iraq (where he proudly claimed to hail from) as no one wanted to hear his fucking bullshit here. Now to be fair I was probably older than him and definitely the oldest student so I was a bit more ballsy, however as I walked out 16 or so of the 27 students followed me. I took my recordings to the dean and found out that while he was tenured, his rantings about the female, African American, Hispanic, and Asian students were grounds for immediate termination and that the anti American tyrades would get him barred from teaching anywhere in America. I've never felt so good to most likely destroy a person's life then I did in that moment. To that man, I hope you changed your ways because you made people in that class hate Muslims.

It's sadly not uncommon for ableism to be especially hard on people with learning disabilities. My partner is severely dyslexic, and so many times there have been problems when we are trying to get accommodations for my partner because of the disability. Like jobs were extra hard because my partner couldn't be a cashier because it took longer than average for them to read something. Or going into a building and someone stopping me or someone else from entering with my partner who needed help looking through papers. People seem to think that learning disabilities are an excuse for people, when it's genuinely difficult for an individual to do normal things.
The starfish story, ughhh people research what it takes to actually take care of an animal before getting it. Pets are not disposable and need proper care. OP out there being a hero.

I had a similar incident in college but due to my PTSD and severe anxiety I left the class. I talked to the ADA counselor at the school and told him I was quitting all of my classes. Unfortunately I had no one that would back me up… other students, staff or even the ADA staff. This professor was an extreme dirt bag. I too was supposed to get extra time for big projects and tests and was supposed to be able to use a recorder during the class (I had a difficult time focusing a lot of times on what the teacher said). He absolutely didn’t care what my reason was. He said he wasn’t going to enable me and that I wasn’t deaf or a baby (in front of the whole class). He was also hard to understand because he had a heavy accent but didn’t care. That was our problem to figure it out. I was shaking when I left and continued to shake for over a day due to my disabilities. I ended up quitting school and didn’t go back for over 15 years.

Because I wouldn't bend the rules and stated I would be facing disciplinary action if not complete termination if I didn't do what I am literally paid for. I was fuming at that comment. This person without going into detail is well off for doing practically nothing. So yeah I was offended for them looking down on me just because I like having job security and I pay my own bills.

Our kids were getting basically picked on by the school, as were WE as a family. To this day we don't know why, but this town is cliquey and apparently we did SOMETHING to get de-cliqued. C'est la vie. So the school weaponized the Dept of Child and Family Services against us. If we didn't notice our kid went to school in pants with grass stains - we're not clothing our children. Our daughter had the same STYLE glasses frames for 6 years (3 different frames with 4 different prescriptions), they claimed (without asking ANYONE) that they were THE exact same glasses for six years and we were therefore medically neglecting her. Schools are encouraged to call DCFS if there's even a hint of a crumb of a suspicion, and I get they should, but some schools abuse that and weaponize DCFS for simple harassment (and over the years we've heard from other parents who've suffered the same). And you can be picture perfect parents in any and all respects (not saying we or anyone else IS perfect) and DCFS still has to respond and investigate everything, walk through the home, interview the kids and scare the crap out of them, etc ... and while they're at it they'll crawl up your ass with a microscope to make sure your colon smells like roses. ie They can and WILL find stuff to report on ANYONE, which they did solely because we kept getting reported, not because there was any evidence of actual guilt. After 2 years and 3 different DCFS bullshit "investigations", we were relating our horrors and anguish to a family member who was a teacher and she asked if our son had a 504 plan which basically determines if the child is considered legally to have a handicap due to a medical condition like my son's ADHD ... *slow evil grinch grin*. We'd never heard of it, but demanded one immediately. Principal tried to blow it off because our son was leaving elementary in a few weeks and would be in Jr High next year ... another principal's problem. My wife went full Mama Bear on her ass and it GOT DONE immediately by the last week of school. With the 504 plan in place, my son is technically protected from these harassments (our daughter has since graduated). A violation of the 504 is a violation of his civil rights, literally. And darndest thing, y'know, the school has "coincidentally" not had a single complaint about our parenting for 4 years since? Funny that.
