  • Declassify your DJI Mini 4 Pro before 2024 to get a declassified drone. But are there any downsides to declassifying your DJI Mini 4 Pro drone?
    Will your unclassified drone still be able to fly over people in the A1 open category?
    Will the removal of the C0 sticker make the DJI Mini 4 Pro a C1 drone?
    There are so many questions that i will answer in this video.
    Let's go through these drone laws.
    Firstly I will go through the drone A1, A2, and A3 categories, and then I will go through the C0, C1, and declassified drones and what will happen with declassified drones after 2023.

      Thank you. Any drone without classification that is 250g and over will (as far as I can understand) be a drone that falls into the A3 category by 1 Jan 2024.

    Thank you, I decided to declassify, what was holding me back was the point 3 that you mentioned. It seemed unclear what actually are you allowed to do after removing C0. But I also agree that the warning is just for confusing people, I read the rules and it seems to be wrong what thy write.

    Thank you for this excellent video again. So since you don't need to classify again, there are really no downsides of declassification the drone.
    You still are not allowed to fly above 120m in the mountains, but no one is going to check that.

    Sooooo if I declassified my mini 4 I would not have the 120m height restriction (except low flight zones) and there won't be any other negatives ? I just simply would need to register myself as a drone operator ? In a tight situation rn as my last trip to EU is next weekend and I'm 50/50 with buying it right now and then taking ti with me to de register as I understand you can't de register in the UK and only while in EASA airspace?

    There are still some uncertainties. It's easier for me here because I live in Switzerland and am directly affected. The TRANSITIONAL REGULATION is currently in effect and will remain in effect until the end of 2023. It is slightly adjusted and a little more open than the real start with the EU drone regulation from January 1st, 2024. Only there does an upper weight limit of 500g apply. Otherwise, the mentioned upper weight limit of 900g applies. This is relevant because a Mavic 3 Pro exceeds this weight. The original Mavic 3 was adapted exactly to this and weighs 895g. This is exactly where the intersection is between A1 and A2 or, in other words, drones with C1 and drones with C2 classifications. This means that the Mavic 3 (I own one) is eligible to request a C1 classification. This was not possible when entered the market. I did that and am now ready for 2024. This is where it gets pretty big: If a drone doesn't have a C classification AND is heavier than 250g, you can ONLY fly in the A3. Speaking in DJI drone models: The Mavic 3 (if requested), Classic and the Air 3 are C1 classified and ready for 2024. They are allowed to fly in the A1 regulatory range. All other models: Air, Air 2, Air 2S, Mavic, Mavic 2, Zoom, Pro are only allowed to take off in the A3. Far away from people and buildings. Quite a limitation. This explains why no one here in Europe wants a drone that is not clearly C-rated.
    As part of the transitional regulation, drones weighing less than 250g will be regulated differently. No matter how they are equipped, if they are below 250g, they are considered stock drones under 250g. In DJI models: Mini, Mini 2, SE, Mini 3, Pro. Existing drones are allowed to fly in the A1 u250g (slightly adjusted compared to A1). Even if they have not been classified.
    DJI takes advantage of this and interprets it as follows: If the M4P hands over its C0 now (necessarily before 2024) then it is a non-classified existing drone. It’s allowed to fly in the A1 and also (this is the crucial point) fly higher than 120m. Otherwise the M3P would be better than the C0-classified M4P.
    However, one question still remains unanswered: Is a classified drone with the revocation of the classification really an “existing drone”. This regulation exists because the EU regulations had not yet been defined at the time of market entry. This definitely does not apply to the M4P. They knew exactly what the requirements were and that included the height limit above the starting point.
    I'm one of the very few who says I won't remove the C0 yet. Wait a little longer and hear what EASA says on this topic. If the M4P is definitely recognized as an "existing drone", then you should definitely remove the C0.

      Regulation text is very clear in article 20 of 2019/947.
      If a drone:
      - does not respect the marking rules (and the mini4 doesn’t when unlocked)
      - is released before Jan24 (true)
      - has a declared MTOM

      @@Avoletta-qs6nf If they need to release a new conformity certificate is there a need of proof outside DJI or do they just print whatever they want?
      All drones are in need of a C-label starting 2024. There’s no rules what happened when you remove an existing classification because you don’t want the restriction who cames with it. Someone removes the permit and access to C0 and claims to be allowed anyway in the rules of C0?
      DJI is prepared to those eventualities. You checked the box to be well aware there’s no return. You are aware as a C-label you only can apply a C1. They even mention the ban in specific if you fly without C-label (if they don’t accept the M4P as stock drone).
      Overall I don’t think EASA is interested in the mood occurs if they would not accept the DJI trick with Stock drones.
      The M4P with C0 and the M4P without C0 are EXACT the same. Why should they be treated differently? Why is the one allowed to fly higher? Correct! There’s no more the C0-label with the forced regulation to block a flight higher than 120m above the starting point.

      I read art. 20 in a slightly different way: if there is a drone not compliant with reg 945 (i.e. is a legacy drone), and...
      M4P IS compliant, because was released with C0 markings, so is not subject to art. 20. I think we have to wait for a formal explaination by EASA legale.

    I'm new to drones, Just to make sure i understood that right, Once you declasify the Mini 4 Pro it can go above 120m, therefore it turns it into a C1 clasification with those restrictions?
    or does it only turn into a C1 clasification when/if you reclasify the drone?

    Thank you for this very clear explanation. Still one small area of ambiguity, though. Do the C1 "appendix conditions" apply to the mini4pro if I leave it unclassified, or do I need to classify it as a C1 drone to be able to legally go up to 500 meters? You mentioned that no one should cosider doing that...I'm just wondering why? Thanks

      If you are declassified and drone before December 31, 2023 there is no reason to classified again. If you opt into classify the drone, it will become a C1 drone.
      The only difference is that you will have some limitations according to the C1 classification compared to an unclassified drone.
      The appendix that I’m referring to at the end of the video is the instructions for the manufacturer of the drones.

      Ik denk niet dat je het helemaal begrepen hebt. Als je de drone declassificieert, heeft hij geen classificatie, dus ook geen C1. Verder verandert er niets. Je kan dus het beste je drone declassificeren, vanaf 1 januari kan dat niet meer.

En ik doelde inderdaad meer op het zinnetje wat je ook venoemd, als je je drone weer wilt laten classificeren dan is het een c1 en voor c1 heb je wettelijk gezien een drone bewijs voor nodig wat ik dus juist niet wil. Dus het gehele verhaal begreep ik volkomen. Hoe en wat en het ging mij vooral om die zin van als je......... dan... en dat antwoord is hetzelfde van jou als wat ik gaf.. maar wel bedankt voor het verduidelijken... 🙏🏻😇 plus het feit wat als de eu, of dji regels erop gaan verzinnen en je hebt het al gedaan. En je word zo C1 ingeduwd uiteindelijk? Dan zit je met je handen in het haar als je niet zit te wachten op nog meer kosten en een drone bewijs. Maar nogmaals ik begrijp het verhaal verder prima hoor.. 🙏🏻👌🏻 en nogmaals dank voor je antwoord en de info.

      @@petitbarzun Wat ik niet helemaal helder krijg: Mijn Mini 4 Pro is nu nog C0 en kan tot 500m (tijdje geen update gedaan). Als ik de procedure doorloop blijft dit zo, ook na 31 december. Maar aangezien ik vaak over niet-betrokken personen vlieg en boven bebouwing vraag ik me af of dat een probleem gaat worden. Of gaat dat niet op bij

      ​@@MarcelVanderWerf C0 is een verplicht label dat DJI vanaf 2024 op nieuw verkochte drones moet plakken. Ze doen het nu al, want ze weten niet wanneer de nu gefabriceerde drone wordt verkocht. Maar je hebt het nergens voor nodig.
      Door een fout in de firmware kan je tot 500m vliegen, maar bij de eerst volgende firmware die je er opzet wordt dat beperkt tot 120m. Je kan de procedure ook alleen uitvoeren na een upgrade.
      Voor drones onder de 250 gram is er geen verschil, je mag in A1 vliegen voor en na 1-1-2024. Zonder label kan je tot 500m vliegen omdat er geen beperking op zit. Je mag tot 120m boven de grond vliegen. Met de beperking kan je alleen tot 120m boven het startpunt vliegen.
      Je moet dan wel de procedure doorlopen voor het eind van het jaar.

      UK does not recognise the "C class " and we're not part of Europe. So some of this doesn't apply to us . We are in transition mode at the moment and it's been talked about in government all our rules and regulations are on hold until January 2026. I guess we were just have to wait and see what happens in the meant 😊 . It's all rather confusing isn't it . Personally I don't have a problem with 120 meter restriction . on any on the drones .. and the line of sight etc etc ...

      Like I've said already United Kingdom the UK does not recognise the " class labels" the DJI drones . As we are not part of the European Union anymore ...
      the drone laws are on freeze at the moment and based on weight only until January 2026.

      I might be wrong but Ì think that the concern here 🇬🇧 is that if you take a drone that is registered in the UK to any EU country then the limit is imposed. But it will then remain in place once you return to the UK?

    Om man idag inte äger en drönare alls, finns det då nån fördel med att skaffa en mini 4 före årsskiftet? Tyckte att jag uppfattade något om ”Previously owned…”. Ska ha en förr eller senare men vill ju inte missa en regulatorisk förändring som kan ge fördelar.

      Den enda skillnaden är att om du köper en före årsskiftet så kan du avregistrera den från C0 vilket gör att du kan öka maxhöjden till 500 m istället för 120 m.
      Den enda gången du egentligen kan använda det är om du går uppför och du vill ha med dig drönaren i luften. För varje meter du är, ovanför starthöjden så får du flyga 120 m upp från höjden du befinner dig på. Men en C0 drönare tillåter dig endast att flyga 120 m ovanför starthöjden.
      Du får fortfarande inte flyga högre än 120 m från marken.

      @@MK-Creatordet låter som samma sak, starthöjden plus 120 eller 120 över marken. Eller missuppfattar jag? Man kan alltså inte flyga till 500 m oavsett? Tänkte filma skärmflyg, 120 är lite väl lågt. Om jag startar från skärmen på 400 m, hur högt får drönaren gå då? Många frågor! 😅

    What about the note from DJI that you showed in your video mentioning that 'you are no longer allowed to fly i the A1 category any more'? And you will need special permission for flying flight authorization through SORA? Arent these points creatimg concerns for Declassifying DJI mini 4 Pro?

      Personally, no. The reason is that the regulations by EASA is indicating otherwise, that it will be a legacy drone as long as it’s done before 31 December.

    Whether it is selectable above or not, having it always set to 120m (with slider going up to even unlimited) it legally falls within C0 description of drone being limited to 120m height. Whatever DJI interpretation of that rule might be, if that was the case they would forbid take off with the bigger battery pack (bought from outside EU) too but they don't.

      DJI states there are two 120m height requirements though. One is for the pilot to not fly more than 120m above ground (Drone Operator Responsibility for C0/5). The other one is for the drone company to not have the drone be able to fly higher than 120m from the take off point (Manufacturer Technical Requirement for C0/4). For the later one the c0 category writes:
      "A class C0 UAS shall comply with the following:" and "have a maximum attainable height above the take-off point limited to 120 m;". But yea, it also says it must be under 250g and if it the drone still works with the plus batteries, its not really consequent from dji.

      @@MK-Creator I mean that is the part about the re-classification I don't quite get. It's a software limitation. I don't see any reason they couldn't put it back in place. Other than maybe customers rather fly in C1 than C0 so they choose to don't even bother putting it back in later for a C0 label.

      A1 category is for drones under 900 grams. For example Mavic 3 is a C1 classified drone (895 grams) and is allowed to be used in A1 category. However C1 classified drones aren't allowed to fly over people. Only under 250 grams is allowed to fly over people. You should check the facts

      C0 class drones doesn't need remote id but DJI mini 4 pro have remote id always active.
      It will broadcast the serial number, your takeoff point, location and altitude. The authority can scan it and see if you are on C0 altitude parameters.

      @@RaulFrizado thank you Raul! I also notice that the dji mini 4 pro doesn’t have a remote id page and I cant add the UAS registration number, so when I fly it they cant know who is actually piloting the drone, making dji’s remote id sort of useless in tracking down the pilot.
      so the question is: Is the integration of UAS registration number forced by the dji fly app? If the mini 4 pro is flown without the UAS registration number registered in its app, what’s the worst that could happen?

      @@rogerregor2489 DJI is doing their best to sell and follow the rules.
      But Remote ID shows the drone serial number. Then the authorities could figure out if the drone is legally registered and allowed to fly and record.

      Yes. If you are in a EASA country (and many more) you do need to register the owner the one that is responsible for the drone as a drone operator. There are no tests or examinations. It’s just a registration process.
      You don’t need to be a certified drone pilot because it’s a legacy drone that is sub 250 g .

    I‘m not sure why it appears so complicated: if you want to fly more than 120m over the start point and you have not declassified your drone in 2023, the only option to do this is to classifiy the Mini 4 as a C1 drone and DJI will offer such a process. But for some reason one important aspect of C1 is always missing: C1 requires the drone to transmit the position of the pilot, of the drone and the flightpath to the direct environment (remote ID). For me this is far worse than the 120 over start point limitation.
    Also: if you declassify your drone, DJI will probably not be able to send you a declassified Care-Refresh-replacement in 2024 if required. So the entire declassifying thing is probably very short lived.

      Pros : Better control on the altitude.

      @@DorianSun87 should still work if the drone was available before Jan 1st like if an electronic shop is selling it and has it in stock. But class 0 allows you to fly over people which is hard to beat even if your height is limited

      @DorianSun87 don’t doesn’t work anymore? Why I’m asking is because the regulations says “put in the market before dec 31 2023” which could be interpreted as if the model itself was put on the market (aka. released), or that the individual drone was put on the market… it was not very clear.

    Thank you for the excellent explanation. After my first flight, I declassified my drone immediately. Yesterday I experienced this 120m restriction. It was like your example at the bottom of a hill, and my drone could not go above it cause of this restriction. One point, though, for DJI, it will be excellent from 2024 to let their users change their drone classification from C0 to C1. This way, you can still go over 120 when the drone operator sees it is safe. I believe this will be DJI's next move after the regulations take place.

    I'm posting this comment as constructive criticism😊. Your content is excellent and I'm certain to put much effort into creating these videos.
    Having said that, you know these videos are watched "world wide".
    Creators MUST be very careful when they post information on laws and how to avoid/interpret them. That, could get someone in trouble, if, they make a mistake following or understanding your instructions. Also, and as you just explained, these rules you are discussing, currently only affect the EASA countries. Maybe you should keep a banner throughout the video to alert viewers the info only relates to those EASA countries for now... Anyways, I hope you consider these thoughts.

      I appreciate your feedback.
      This is the exact reason to why I in the beginning of the video just pointed this out.
      I also pointed out what countries this specifically applies to. But honestly, it’s very similar in most parts of the world.
      It’s also very important that people understand that they, for example need to be a registered drone operator, which is not the case.
      It is indeed a very thin line that you have to try to balance on every single day.
      We also cannot not neglect the fact that every individual has their own responsibility to follow rules and regulations.
      Even though in some countries, without mentioning any by name, it more seems to be the case that individuals try to blame the luck of personal responsibility on other parties for their own benefit.
      I think I stopped there without going further to that discussion, but again, I thank you so much for sharing your thoughts, I truly appreciate your feedback.
      Also, the intention of this video is not to get people to avoid the law. It rather informed what rules one have to follow.
      Also, the purpose of this video was to try to figure out why a DJI mini 4 pro would be a C1 drone when it in fact should qualify to be a C0

    Time 09:24. "Can't buy plus batteries"??????? I bought plus batteries for the Min i 3 pro and they fit to the Mini 4 pro as well, as I've got it.

      According to EASA a toy is:
      A drone is considered as a toy when it could be attractive to a child. More precisely, products designed or intended whether or not exclusively, for use in play by children under 14 years of age should be considered as a toy and comply with the Directive 2009/48/EC on the safety of toys. The compliance of a drone with that directive is declared in the corresponding EU declaration of conformity. In case of doubts, the fact that a product should be considered as a toy is assessed by market surveillance authorities based on a number of characteristics related to the attractiveness of the product for kids, accessibility, etc.
      However, manufacturers may clearly exclude their product from the application of the Directive on the safety of toys (when a confusion is possible) by indicating clearly a minimum age > 13 years on their product (packaging, manual etc.) (e.g; “not for use under 14 years”).
      Regulatory reference: Article 2 of Directive 2009/48/EC of the European Parliament and of the Council of 18 June 2009 on the safety of toys.
