    You do your passport online now in the Philippines. I overstayed during the pandemic. Cost me an arm and a leg (something like 200,000 pesos). That was right around the 3 to 4 year mark too. I do have a friend from the past who is in the same situation and he just lives on….

      if he hasn't been doing anything to resolve his issue, he most certainly will be arrested and deported.

      @@mikesphilippineretirement Not sure what will happen to him. I paid my fines and left the country for 3 weeks before coming back. I had been stopped at Manila airport by Immigration when I was trying to fly out. They sent to the main office the next morning, I spent the whole day waiting in lines and then received the bill, including fines, like I mentioned it came to about 180,000 pesos to be more exact. The paperwork did say ‘deportation’ in it, but I was allowed back in. Lesson learned. Now I stay up to date with my visa stuff. I should finally just get residency as I have been here the last 11 years (before I worked in Afghanistan so I was always traveling in and out of the Philippines). I do think there are many more expats then you suspect just living here without visas, and by now, with expired passports. I do not know why you keep getting stopped. The very very few times I have been stopped. No one asked me for identification as I am an obvious foreigner.

      It sounds as if this guy is at the verge of the event horizon of the black hole to absolute hell. The Philippine Bureau of Immigration does not take this infraction of immigration laws lightly. His days here are are numbered

    Mike real good subject. My first priority is my visa and my passport. Now we can extend our visa on line. There is no excuse. You are a guest of the Philippines and must respect the laws.

    This is a perfect example of money management and preparedness wasn't taken into consideration. You always have to remember these important dates when in other countries when it's not your own. I hope this gentleman takes care of this. Thanks Mike for another information video.

      Apparently he came to the Philippines 8 years ago with no or very little savings. Or may have blown through what little savings he had in 3 years and doesn't have any other savings or income beyond his SS. And his SS sounds like way down on the small end of the scale, may not have had alot of years built into the system to collect the average, which today is around $1500/month. Sadly, it doesn't seem he looked at the long term financial impact and obligations he would require to remain in the Philippines. Now his US Passport will expire for the same reason, he doesn't have the $300 to RENEW his passport.
      He looks to be stuck with barely surviving with his$700/month SS retirement and unable to SAVE any portion of it for years. Meaning, he should have been living on say $400-$500 month and save $200-$300 month, that would give you $2200-$3600 year or about $8800-$14,000 over 4 years. Then he would be able to pay the $2500 in back Visa fees to the Philippines and also get his US Passport Renewed. Meaning, he COULD have had enough in savings all these years by living frugally and cheaply.
      For NOW, maybe its best he live on a strict budget for the next year and start setting aside $300/month, live in the Province with his girlfriends family cheaply on $400 or less, then in 1 year he will have $3600 saved and can get this all resolved. Otherwise, if caught he will be deported and sent back to the US, were he surely will be homeless and living on the streets, unless he has family to take him, as its impossible to live in the USA on just $700/month now.

      He is still going to be black listed forever from the Philippines. Now he goes back home to the U.S. and has to survive in the I.S. on $700 a month…Mike should have never put this video out. He just jeopardized this guy’s stay in the Philippines. Good OLD Mike, anything to make money.

    Had a friend who was over the 13 year mark for overstaying. Thumbed his nose at everyone. No visa, no driver's license, no insurance, no business licenses, etc. Then on September 1st, he just up and died. Buried here in the Philippines.

    By the way, I was technically ‘deported’ but they did let me back in. It was like the 3 year mark on visa extensions. Once I was out, when I came back it was a clean slate. Yes one Calendar day to be safe. I was gone for 3 weeks.

    About 6 years ago, I went to the Philippines for 29 days. Our flight home was delayed, so I was in the Philippines 30 days and 2 hours. On the way home in the Manila airport, my wife was in another line with all our money and I was held back to pay the fine. It was about $80. I almost missed my flight because we could not find my wife. She boarded the plane not knowing I was held back. Everyone was so nice to us. One young man ran to the plane to get the money from my wife. Then, someone ran with me to help me get on the plane on time.

      Sounds like you got screwed. Even at todays rate, a 1 month extension is only $25.54 + $9.03 for the fine, $34.57. I realize that 6 years ago, the rate was about P10 lower but $80? I believe even the extension was a bit lower priced then. Especially for 2 hours being late?

    I had the same problem with my stay because of Covid. They charged me the same fees you said here, but because of Covid & the lock downs I ended paying around 130,000 pesos to get caught up. They did allow me to update my visa but it took me over 3 months to pay it off & get current.

    Just to add, here in Japan I’ve never dared overstayed my visa for even a single day in almost 13 years. Japan Immigration is very strict, in the same building as the department of Justice. ‘Ted’ really needs to get his situation resolved to put his mind at ease.

      @@mikesphilippineretirement Sad to know a man in his 70s that should be enjoying his final retirement years is in this situation. I’m sorry to say, but likely simple negligence on his part. He should have met with immigration from the very beginning. If he had to, perhaps he could have arranged for a bank loan to have enough funds to have done his visa run 5 years ago. Then he should have made his monthly visa renewals. He’ll have to pay it + more eventually.

    I believe it is far better to contact the immigration office to talk to them and work out a payment plan. Ignoring it will only make matters worse if and when he gets caught.

    Hi Mike, I met you today at BO;S coffee at Ayala Mall Just happened to come upon this blog and thought I could give you a little insight from past experience , we had a client come to the office with the same problem he had overstayed his visa by 5 years and had to return home for a death in the family at immigration they had assessed him a penalty of about US$15,000.00 he came to see us and my office manager went to immigration and negotiated for $5,000.00 he then went home and stayed for a year and came back and got a PRA visa and just died here three days ago. What I mean to say here that if you are sincere and act decent they will sometimes reduce the fees for a one time good deal it is always helpful to have someone with you that understands the system and is known by the folks at Immigration. But never have a fixer or so called immigration person that says they have friends at Immigration try and do a fix , we have had clients that have gotten into a real mess like that..

    I was stuck during pandemic time frame. So I was stayed into the 3-4 year mark. Exactly just like him. Will cost him about 200,000. You can do passport renewal now ONLINE in the Philippines and mail your passport to Manila and get it back same way. I do not know why the comment didn’t stick the first time.

      The immagration office here in the Philippines was closed for covid, but they simply let all staying here back pay there overstay to get current.

    I just renewed by US Passport (with 50 pages) via mail in the U.S.A. -- $130 US dollars to renew. You have to send your old passport to the US Passport office with a check for $130

    It is crazy this guy let it run this long. He might maybe contact JRC Constituency for some possible advise on the issue. This is a pay service but JR is very knowledgeable in all aspects of all the issues this guys has. He really needs to talk to someone they really knows what he is facing rather than sidewalk lawyers. Bottom line, he needs to own up to this and get it fixed ASAP!

    Mike good topic to discuss. Seems crazy to let your tourist visa laps this far. As far as U.S. passports go, you can mail in your existing passport with a new picture and of course there’s a fee, sounds like this could be a stumbling block. Worrying about it absolutely never helps, you have to get up and make it happen. I made it to the Philippines this past August wish I’d have run into you then somehow. Anyway have a great day Mike

    Depends on the Judge at the end of the day. Without mentioning names, there was a guy in a similar situation from Australia. He was found by the police and taken to jail. He ended up paying his overstay fees with the help of his family but ended up being deported anyway. Would be interesting to find out if he was or is allowed back into the country. I suppose it's a case by case situation.

    While working in Brazil, I asked my co-worker what happens if you get into trouble with police/courts? He said the solution is simple "You have the money no problem, you have not the money you go to the jail"

    The law is the law,I remember I over stayed I had to pay $260usd i lived 3 years in Philippines and I didn’t missed one payment since and I went to Thailand, for 3days for clearance thank God I had my money saved, make sure you do.

    Philippines government is friendly if your are over stay in Philippines is not a big deal filipino happy your stay longer in the Philippines and some people of the Philippines help you to fix your visa again.

    Another concern would be the ACR card. If you are here more then 60 days you need an ACR card. It is almost as important as the passport for id.

      you only need the acr to open a bank account once i did that i never was asked by anyone for a acr card ive had three of them. one time when i was back home flying to the phil. i didnt have a departure ticket so when i was getting my boarding pass they wanted a departure ticket i told the lady at the air port i live there and wont be leaving she wanted to see a visa i handed her my ACR she didnt know and let me board lol

    When you do your 3 year visa run you should take your wife with you and your marriage certificate----on your return you enter through the same immigration gate with your wife, produce your marriage certificate and ask for the Balikbayan privilege visa and you will have a 12 months visa-----and I think you can get that extended before it expires-----saves doing monthly visa extensions and paying if you are on a tourist visa

    Anyone foreigner who runs out of momey or overstays their visas should be thrown in prison for life. They was pathetic in their own county and can’t get their lives together in the Philippines. Just waste of life and space.

    "Express lane fee" that appears to me is just a way to charge foreigners more to stay in the Phils. when I did my extension there was not 2 lanes at the BI office such as a regular & express lanes.

    I was told to go abroad and return the next day but when I landed the plane I was on was returning after refueling so I had enough time to get my stamps and return on the same plane. Year 2004. He may be able to get a passage on a private boat and go to Manado, Indonesia then fly back.

    I caught covid and put into quarantine which put me past my visa termination. It was the 3 year limit. I even had my paid air ticket. Once I got lot of quarantine I went straight to immigrations with all documents in hand. I got off with a P20,000 fine which is much less than the fine for people with no excuse. What went in my favor is that in all my 22 years in Philippines I never failed to renew my visa on time.

    I have family that doesn’t save or plan, it drives me crazy.
    This man had 3 years to plan and save, pure stupidity.

    I renewed my passport. Very simple and fast. That is what I would work on first. It is really hard and amazing what people do. Good luck

    One of the first things I did, when I decided to extend my stay an extra 33 days, was contact Heidi’s Manila office about a visa extension!
    My late Wife was an overstay, in the U.S. It took us 10 years to get her status changed, even though we’d been married all that time. It was very expensive, and we lived in fear of her getting caught and deported, during that period.
    I definitely don’t want to fall into a similar situation in my new home country, and that’s one of the things I’m grateful to you for; introducing Heidi and C&G Consulting to your subscribers! It will make visa extensions, and getting my 13A visa so much easier. Plus driver’s license, ACRI, etc.

    Retired expat from the US livjng jn Thailand 5 1/2 years.
    ALWAYS ensure visa is ok. On one year retirement visa. You dont have to leave the country, just do the paperwork requirements.

    good topic - NEVER EVER OVERSTAY YOUR VISa - PERIOD ! it is a headache for us - if in his case more then 4yrs overstay they will stamp you in most cases as unwelcome - now depending if you married and have kids...if not 99% will not be allowed to come back. #1 keep your US passport current - in his case get immediately a new US passport , Cebu consulate or Embassy in Manila - fairly fast to obtain, a must have - now overstay and invalid passport means double trouble - and he will be detained locally then shipped to Bicutan detention center in manila - not a pleasent place to be - and it will cost him extra $ - a lot ! he will be processed as any "criminal" and most probably be detained 4 weeks at least before deportation be placed and for state department to be active...per year he can count at least 50k peso on fees/fines - but can be payed or not...coz deported for sure ...Keep your passport always current and Visa !

    Everytime I go through a checkpoint, they bring a flatbed to load it with bikes confiscated from Philippinos without licenses. Its usually full with a dozen bikes. Decent cash grab once they are auctioned.

    As with anything in the PH it all depends on who you're dealing with. I've seen cases of elderly foreigners in poor health that have overstayed many years but don't cause any trouble, and the government leaves them alone, but the problem arises if they try to leave. Then there's younger guys that overstay and bring attention to themselves that get deported and blacklisted. It seems that having the money to pay arrears is a big factor.

    I suggest for him to renew his passport first. My mother (95 yo) is naturalized citizen, 21 months over stayed, demented with glaucoma. JRC consultation will process to file Motion for Reconciliation, P35K. Takes 2-3 mos to process then pay the late fees.

    It is like telling me about someone who let his drivers license expire. Then complaining because he got stopped driving by the police. Be an adult and take care of your business. It is not necessarily an expat problem.

    Not too long ago, they use to pay Filipinos for a bounty on foreigners that had overstayed. My neighbor who's USA passport expired, went to the Cebu Water front embassy office and did his USA passport renewal for somewhere around 150 dollars and used a credit card to pay(a year ago). Received his passport in less than 5 weeks is what I think he said. Don't think they ask for anything to prove he wasn't an overstay or anything. But if they did ask "Ted" about his stamp in his USA passport, he's caught. Maybe he should just not do anything but I would hate that over my head but maybe he doesn't have a choice if he doesn't have that kind of money. Don't get yourself into a situation like that.

    It’s kind of sad, but yet he brought it on himself. If he’s living beyond his means and can’t afford to take care of Visa stuff, then he shouldn’t be in another country. I say let them go to jail. I’m losing compassion for people that neglect their responsibilities!

    He needs to get a lawyer who specializes in immigration. Hopefully the attorney fees won't cost him that much, but it can save him alot of headache and probably imprisonment.

This elderly man has literally chosen his top option. Add given the fact that Mike can't discern between legal, an illegal entry into a country, and it becomes easy to come down hard on one that is less fortunate.

    If I was him I would try to save enough money to get a boat captain to take him to Thailand…. If he is able to leave they will never know he overstayed….he could also potentially hitch a ride on a private plane….you asked for ideas…. I know this is not a great option and its risky, but its a option nonetheless

      There are ferries from Zamboanga to Tawi Tawi. From there you can catch a 5 mile boat ride into Malaysia then fly out. Or get a passport replacement then fly back into the Philippines if you're brave. lol

    Fundamentally this is a financial management problem. Apparently he came to the Philippines 8 years ago with no or very little savings. May have blown through what little savings he had in 3 years and doesn't have any other savings or income beyond his SS. And his SS sounds like way down on the small end of the scale, may not have had alot of years built into the system to collect the average, which today is around $1500/month. Sadly, it doesn't seem he looked at the long term financial impact and obligations he would require to remain in the Philippines. Now his US Passport will expire for the same reason, he doesn't have the $300 to RENEW his passport.
    He looks to be stuck with barely surviving with his$700/month SS retirement and unable to SAVE any portion of it for years. Meaning, he should have been living on say $500 month and save $200 month, that would give you $2200 year or about $8800 over 4 years. Then he would be able to pay the $2500 in back Visa fees to the Philippines and also get his US Passport Renewed. Meaning, he COULD have had enough in savings all these years.
    For NOW, maybe its best he live on a strict budget for the next year and start setting aside $300/month, live in the Province with his girlfriends family cheaply on $400 or less, then in 1 year he will have $3600 saved and can get this all resolved. Otherwise, if caught he will be deported and sent back to the US, were he surely will be homeless and living on the streets, unless he has family to take him in, as its impossible to live in the USA on just $700/month now.

    Read RGB711 comment... What is the current cost for a regular SRRV Visa? Is it $10k US? Is the only benefit for SRRV visa not having to "Visa Run" every 3 yrs? Thinking this may be an option to help eliminate overstays.

    I don't think with absolute authority anyone can say for sure what will happen to this overstayer if he is caught or turns himself in. I know situations where immigration was on the lenient side and allowed the overstayers to pay up and remain in the country, but I also know a guy who overstayed by 2 years (and was also working illegally) and immediately was arrested and take to the immigration jail in Bicutan (Manila) where he remained for 5 months until he was deported back to the US.
    My advice to him would be to (with cash in hand) humbly turn himself in explaining his situation and beg for forgiveness. Perhaps immigration would be hesitant to deport someone who was in a relationship and was supporting a family. I know of this other situation where this guy has overstayed for 15 years and has no intention of turning himself in: tick toc, tic toc.

    He can apply for a new passport online, and they will send it to him in the Philippines. He will have to pay 25kPhp pesos for every year he has overstayed + fees. If he goes to the immigration and explain due to covid and maybe say he was sick for a while. But make sure he has the fees to pay. They will also give him 3 months to get a new visa.

    Wow...... Lots to unpack here. If he is a veteran, I wonder if he can find help through the VA or maybe even the new Navy base. As veterabs, we are also entitled to use MAC flights for a very low price but I've never done it and Im not sure how the overstay problem would be addressed. I have always been told that US passports can be renewed at overseas embassies as well but again, Ive never done it.
    The biggest thing I'd be worried about is his age. Let's face it. None of us are immune from medical issues and if he needs to be rushed to a hospital in the middle of the night for something serious, could he possibly get caught that way? Also, if he has an emergency that absolutely requires him to return to his home country, what would he do then? If it were me, I'd have trouble sleeping at night.

    I'd expect this from a young person in their 20s , but 70s ? Life is unforgiving , you have to look out for number 1 at any cost.
