To clarify why nintendo WILL fail. To patent, you have to make sure your invention gets patented during the spam of 20 years. Cause if your invention remains unpatented for 20 years, your invention becomes public domain. This includes game mechanics and is how patents work in japan. Pokemon has been around since 1996. But "the throw a ball to catch a monster" mechanic? It was filed in 2021; 25 years after Pokemon red and blue; 5 years too late to file that patent.
But their Nintendo lawsuits winrate is 100%. losing Nintendo is like asking a random cat to grow a horn, even whole world probably lose fighting Nintendo, I can't see it... I really can't see Nintendo losing 🫠
from what I've heard, the specific thing they're patenting is the system is Legends Arceus, where it's unique because of the "3D Space" and the "arc of the ball", which is awful for its own reasons. On the 100% win rate... this isn't true. Nintendo lost the battle against GameGenie on cheats, and some other times. It's true that they do win most cases though.
From what i study... Patent is only entitled to the actual creator of the design/ mechanics...? So being able to Patent something is like no different from Copyright...
What Nintendo needs to do is instead of cracking down on fans and parodies is crack down on GameFreak because it's become rather well known that they're a subpar development studio. They need to take their money, hire more devs, train those devs, and make a higher quality product. They're like multiple generations behind in terms of quality. We don't need or even really WANT AAA Red Dead Redemption 2 levels of fidelity, we just want competence and more depth. Pokemon has been skating by on the fact that the core experience is so addicting that as long as they do just enough on top of that, they'll still succeed... but they've done that too many times now and it's getting stale and the switch to console has caused the cracks to widen dramatically as now we're seeing jank, glitches, and major performance issues.
I read up on the patent they are claiming Palworld violated. The ideas they have patented are already so generic that it is insane that they can have a patent at all. The three primary ideas in the patent are: 1, use of mounts for land, sky and sea in an open world; 2, the pokeball issue that was addressed in this video; 3, the driving physics they use in Mario Kart. By no means should Nintendo be able to win this suit, but because Nintendo and PocketPair are both Japanese companies, and Nintendo is a nationally recognized organization with Pokemon itself being a nationally protected product, there is a high chance of this suit being rigged and PocketPair getting smacked with full-force of the law.
The ost problem is because they do sell their soundtracks.... only in Japan though.... but in all honesty I'm getting tired of Nintendo's bs these days. Pokemon has gotten stale over the years. I have more fun playing palworld. Mainly because it's innovative enough. Plus I get to play a better monster catching game.
@@mcgingerbread1625 Pokémon isn't new and fresh too. They're both buggy and mid. I love Yo-Kai Watch. They have interesting battle system, funny quests and story.
This game is saving my sanity and life (as a gamer) I was burning out hard on everything else, this is what we have to have, what we have needed and wanted for decades. Pokemon can grow up, if they don’t like competition then crush the competition with a better version of the game not lawsuits that hurt everyone.
There are so many failed people out there who suckle upon the Nintendo tit as if they're gosple when in fact they're just a blood thirsty company whos defending their bottom line like every other company. Nothing about them is great and the only saving graces are the people who make the games which they ruthlessly protect as if they're creating masterpieces, last Nintendo game I played and enjoyed was Smash and thats dated by the innovation in the industry now a days.
It would ultimately destroy nintendo's reputation and diminish customer loyalty. Not only will their customers betray nintendo for Sony or sega. But they will also boycott nintendo. Either way, it's a lose-lose for nintendo! So I will not defend nintendo.
They love to sue also in japan mainly people defend nintendo like majorly but everywhere else usually i've seen people on palworlds side also because of what exactly what they're suing them over and could make them or others sue for using common mechanics.
I strongly doubt how well informed Japanese people are about this lawsuit. Some of them seem to strongly believe that they will sue PocketPair for copyright infringement because it is more obvious and that the patent infringement is a translation error due to the language barrier even though at this point it has been very strongly confirmed that this lawsuit is about patent infringements. In any case, based on their videos and comments, the belief that Nintendo would have sued PocketPair over the game mechanics or features is weak in Japan as well and, at least I, consider this a big factor as to why they don't believe that the lawsuit was made because of suspected patent infringement. However, their reaction can also be partly due to confusion because no one expected Nintendo to sue PocketPair over patents.
One theory is that Sony partnered with Pocketpair, and they think stores will be full of Palworld Merchandise instead of Pokemon Merchandise. That is why they are determined to shut down the brilliant game of the year.
I've already gone and cancelled my Nintendo online subscriptions and what not. Tbh I'm probably looking at getting rid of my switch as well. Nintendo is clearly anti competitive. I can understand wanting to protect your IP from legit harm. However if you stifle innovation like this. It just sets a disappointing precedent. It's a divisional patent. The original patent was obtained in 2021 IIRC. The patent approved this August is a division of that older patent to make clearer one of the concepts of that patent, e.g. like for use in court. Not that I think this is fair. I'm just trying to correct this assumption.
@mcgingerbread1625 Maybe if the argument was "palwold has a cat so they obviously stole from pokemon" Then that would be an okay counterargument, but the argument is that palworld has a cat that stole meowths face. Pidgeotto looks absolutely nothing like the other bird, BTW
It's different because you choose what you want to believe is similar and what isn't I feel the same about lucario and anubis but somehow they say they are the same its a matter of putting bias aside
@shadowbolthaseo1861 but pall world also has primarinas hair, galarian meowths face, grass type cinderace, emo mega mewtwo y. Why does wooloo roll? Because it's based of a soccer ball, why does lamball roll? Because wooloo does. There isn't a single pokemon that looks like a dragon quest character
@sethidk6439 I am sorry but your using the dumbest comparisons 1.primarina is not the first thing to ever have mermaid hair 2. This might be a surprise but galarian meows face comes from a cartoon cat bus and the cat from the Alice and wonder land horror stories wich came way before pokemon coped it 3. Verdash is a god dam soccer rabbit there are hundreds of god dam furrys that do sports not to mention mascots are a thing it's also taken from somewhere else 4. Lam ball is based on the actual food named lamballs wooloo is not original your bias is blinding you so badly
Sticking up for the truth is just sticking up for the truth. If Pokemon has a patent on throwing a spherical object at a creature for a % to catch it, then Palworld wil have to change that or pay up. Im not defending pokemon I'm defending what is the law and right. If you are so easily manipulated that you flat out choose lying to fight their lawsuit then what's Pal world's chance at debating it? How about work towards legal avenues instead of coercion under oath of truth
And yes, this is an attack on everyone who once loved Nintendo, all I know is they lost a customer for pulling this shit show of a lawsuit. If Pal World edits their content to follow the law, then I will buy their products, or if they buy the rights, which would be the worst avenue for a new upcoming Game of the Year

damn I hate to see Nintendo/Pokemon and Pocketpair/Palworld fight each other, I love them both, and as a long serving Nintendo and Pokemon fan, I respect pocketpair Palworld for creating something Incredible for what Nintendo/Pokémon has failed to do, after all we all have to get ideas from somewhere that we find inspirational.
I'm siding with Palworld and pocketpair on this, cause they don't deserve to get law suited by them for patent infringement, As much as I Love Nintendo and Pokemon but I will NOT GOING TO TOLERATE THEIR DIRTY BULLYING TACTICS against small indie gaming companies like Pocketpair and Palworld and suing them for patent infringement, I've already downloaded Palworld on my PS5 to show some Love and support to Pocketpair.
@@jojough8283 well let's hope they They lose then...this time super hard that make them stop for whole year
From what i study... Patent is only entitled to the actual creator of the design/ mechanics...?
So being able to Patent something is like no different from Copyright...
I kind of feel like they will settle out of court
2:28 no, nothing new and fresh there.
Please tell me something new or fresh that pokemon has done in like 10 years
@@mcgingerbread1625 Pokémon isn't new and fresh too.
Easily could’ve made a 3D open world Pokémon game for the past 30 years. Just livid that someone else did it.
It should if you want competition to exist. The market doesn't work like in the books
10:35 what episode is that of ultraman: th-cam.com/video/3KaHYew2Rcw/w-d-xo.html&ab_channel=TokuSHOUTsu
ultraseven episode one
I 100% agree with everything you said in this video I left a like. And fully support pocket pair and hope Nintendo looses the case
thank you
They love to sue also in japan mainly people defend nintendo like majorly but everywhere else usually i've seen people on palworlds side also because of what exactly what they're suing them over and could make them or others sue for using common mechanics.
I dunno. I got mostly hate comments on my last short about it so we'll see. But glad to know that's the minority
That is why they are determined to shut down the brilliant game of the year.
unlikely, they were just helping each other cuz palworld wasn't originally on playstation
I've always enjoyed the Pokemon games, and they have definitely gotten a bit worse over the years it feels like. Maybe I'm too old I dunno lol. We definitely need and have needed something new in the monster taming genre.
*Careful showing Mr plumber there. Tendo might see that as a threat too*
dang man, following through I love it!
@@mcgingerbread1625 Definitely looking to follow through. I haven't sold the switch quite yet, but I just disconnected it this morning and set it too the side for now. Please keep up the videos and updates some great information and view points. I'll for sure be following closely for more news!
@@EclipseCrasher OH yeah this is one news event that I am very interested on how it plays out
but their both in japan imagine if American companies tried their hand at popular games
Let's say Hypothetically, either Microsoft or Sony offered to move Pocket Pair to the US to give them better protection, and that Pocket Pair accepted. In this instance, Nintendo's lolsuit would be laughed out of any and every US court.
Very first Pokémon game talks about death😂 even a Pokémon wearing the skull of it's dead mother appearing in the first 151 Pokémon😂
I literally made the joke we don't talk about lavender town, also I said MOST
@@mcgingerbread1625 thinking about it even more even the anime original series talks about death and how Charmander could die if his tail goes out, lame joke then as you had to explain :p
Nintendo deserves a spot in company Hell I'm just gonna say it
parody? isn't japan not allowing parody since fair use does not apply to japan's copyrighted law?
pretty sure
I didn't no Pokémon did these stuff. I really can't tell if the Nintendo company is evil or is just mean
little bit of column A little bit of column b lol
but live japan mostly side with nintendo is so complicated
My favourite monster catching game isnt even pokemon.
Its world of final fantasy.
I appreciate pokemon for creating the genre but I hate their greed in buying patents stopping others for making monster catching games or limiting in what they can do when making one.
smash community has been nothing but antagonistic to Nintendo and has shielded pdf files for decades thats not the hill you wanna die on.
every fandom has toxicity in it, that doesn't excuse collective punishment. Star wars has a way more antagonistic fan base btw
Also, I'm pretty sure if Nintendo wins this, it will mean nobody can make a monster catching game.
They literally have tem tem and nexomon on switch. This hyperbole is getting parroted way too often without any logic or reasoning applied beforehand
It a paten they got after palworld can out
technically palworld was still in testing when they made the patent if i'm not mistaken
It's a divisional patent. The original patent was obtained in 2021 IIRC. The patent approved this August is a division of that older patent to make clearer one of the concepts of that patent, e.g. like for use in court.
Not that I think this is fair. I'm just trying to correct this assumption.
The dragon quest picture isn't a good argument. I mean, just look at the pidgeotto comparison, they look nothing alike
the fact that they are even slightly close is enough to make the argument sound
@mcgingerbread1625 Maybe if the argument was "palwold has a cat so they obviously stole from pokemon"
Then that would be an okay counterargument, but the argument is that palworld has a cat that stole meowths face.
Lam ball is based on the actual food named lamballs wooloo is not original your bias is blinding you so badly
trashtendo shoud straight up be closed tere games suck and they are legit the Kim Jong Un of gaming
Lemme save you the google search Its a weiner. the mara demon is a johnson. A willie.
"Insert 'thats a penis' meme here"
Sorry to say this, but is not up to us.
If Pal World edits their content to follow the law, then I will buy their products, or if they buy the rights, which would be the worst avenue for a new upcoming Game of the Year
Parody is a legal avenue they can take and pokemon didn't patent the sphere thing until after Palworld was already announced
Nintendo sounds win. Cuz it's funnier like that
PLEASE do me a huge favour and look up how this whole thing is perceived in japan. and maybe do an update video. theres always 2 sites to a medal.
not a bad idea.
"small indi company" backed up by sony. *cough*
They just recently got backing by Sony. they weren't backed at all during the development of the game so kind of a moot point
@mcgingerbread1625 it'll be interesting to see if we get Sony or Microsoft resources going into the legal battle 👀
You should be Boycotting Sega and Atlus games if you really believe what you say. Don't praise persona. Don't praise sonic.
im not following your logic
Nintendo hasn't made a GOOD game since Final Fantasy 7. Lol my opinion.
breath of the wild tho?
Ff7 wasn’t even them that was Square Enix. Says a lot about Nintendo
I really hope Nintendo wins the lawsuit. So many idiots have no idea the actual reasons behind what's going on. Just parrots squakwing the same thing they don't understand. I refuse to go to bat for random idiots on the internet screaming about things they know nothing about.
bro wut
Hey hypocrite have you heard of a mirror? Maybe look into one and see if you find what you just described
I'll be rooting hard for the ninjas 🥷 Gaming needs this W.
It's crazy how you did nothing but lie and tell half truths to defend pirates and kiddy touchers. WIIIILD.
M64bros made a video called "How Nintendo fans make it hard to critize" And he covered all the things you lied about.
Technicals covered the Smash Bros kid touchers you gave a full throated defense of.
Disgusting.
bro WHAT are you talking about? are you saying Ninjas as Nintendo? Half truths? Kid touchers? you on something bro?
