    I used to work at the Scottish Refugee Council 20-ish years ago, and asylum was a minefield then. The fear and suffering was appalling. This new legislation is horrifying. Thank you for speaking out so magnificently and unequivocally.

Brexit the loss of the Dublin accord and cooperation with our fellow Europeans Johnson should have negotiated a returns policy before signing but he ignored that totally, all he was interested in was been able to brag about getting brexit done, not to mention this sorry excuse for a government who have completed failed in processing applications. Tories are playing the public blaming refugees not their own failings. This government is taking the country into the economic gutter and trashing the reputation of the country on the global stage.

      You're clearly incapable of following the article you're commenting on. It is not "illegal" to seek asylum in this or almost any other country, no matter by what means you arrive, no matter how many other 'safe' countries you have passed through, no matter whether or not you have documentation. This is not a matter of opinion, it is a matter of fact, a matter of international law; laws, it should be added, framed and initiated largely by British lawmakers, not least of whom was that well-known "left" political figure (that's irony, I would point out as I fear you may experience difficulty in grasping it) Winston Churchill. So, to pick up on your own 'theme', if the right want make illegal the perfectly legitimate immigration we have currently, "what you're essentially saying" is that they will have to break international, in so doing, this country would immediately become an international pariah state , along with Russia and Belarus, in addition to the mantle of world laughing stock it has assumed since the disastrous Brexit decision. That is not going to happen, of course, because they know very well that what they are proposing is illegal. It's just another part of their culture wars agenda to provide a smokescreen for their appalling lack of any solutions to the real problems facing this country and in order to throw some 'red meat' to their hard-of-thinking voter base. But then I expect you would know all about that.

    I'm not a lawyer but just for specific sources I have found, Article 31 of the 1951 convention states that Countries shall not impose penalties on refugees who entered illegally in search of asylum if they present themselves without delay. In UK court system article 31 has been enforced previously: Regina v Uxbridge Magistrates and Another ex parte Adimi; R v CPS ex parte Sorani; R v SSHD and Another ex parte Kaziu: Admn 29 Jul 1999. My question is would it even reach international courts or would it fail even in UK courts.

    The successive UK Gov seem to be keen ignoring domestic as well as international laws. Often we see MPs voting into laws regulations which are unlawful to start with. Lacking knowledge and only guided by greed and keen to keeping their position first they go no matter what then look like fool when they have to back off.
    Something is also weir with the system in place.

    The right wing press is doing a wonderful job judging by the comments on this broadcast. We have a cost of living crisis, the NHS is in dire straits, the police are underfunded, the fire fighters are underfunded, social services, mental health services and long term care are stretched to breaking point and you choose to focus on migrants who are coming from war torn, countries, faced torture, slavery, rape, hoemlessness...I am quite certain the majority would prefer to stay in their homeland not come to this polluted, xenophobic, not so pleasant land!!

      That is the problem with democracy, unfortunately - not all voters are well informed before voting, and look for easy solutions to complicated problems. They find it complicated and boring to get to grips with what brings inflation up and down, what international agreements apply, and the rights those are supposed to secure for refugees and asylum seekers, so they instead come up with their own explanations and blame it on the immigrants, cause that is easier, and also give them a direction for all the anger they have built up over 13 years of Tory rule. But which the thought that the problem might be the government's incompetency, rather than ill will from the EU, or immigrants taking all the jobs, still hasn't struck them. Even though many seems to starting to wake up. I pity the old style Conservatives, who now feel they no longer has a party, cause they are too well informed to be tricked about nonsense about the small boats danger. They know immigration would have been much more orderly and efficient, if there were legal routes, both for foreigners to apply for seasonal work permits, and to seek asylum or claim status as a refugee.

Had you been, you could have returned asylum seekers to the first EU country the asylum seeker came to, since that is where they should asylum according to EU rules (remember the EU has internal free float of people, so after having been granted asylum, the asylist is free to travel or relocate to other EU countries. That is why sending asylum seekers to the first EU country they arrived in is possible within the EU - but does not include countries outside the EU.).

      Probably because the French understand their responsibilities under international law? And the British try not to? Even though it was the British who played the leading role in creating those very same laws that the French (and so many other countries) signed up to and actually take seriously.
      Yup. Helluva country the UK has turned into. When Parliament is asked to introduce laws that are, themselves, unlawful. And then expects people to respect the laws it passes thereafter.

      ​@@Tvjunkieful12 There was no need to leave the Dublin regulations when we left the EU, but the extremists wanted the hardest possible brexit regardless of the consequences. There are about half as many asylum-seekers now as there were 20 years ago. The Home Office used to process 90% of claims within six months, now it's 4%. The small boats are a very recent phenomenon. This entire "crisis" is deliberately manufactured.

    The current right wing government and it PR machine (Daily Mail etc) are making this country so bad it hurts. It feels like Germany in the 1930's.

      It more or less is like Germany in the 1930s. High inflation, politically isolated, economic problems, and an extremist government which goes after anyone who oppose them from unions to independent voices like Lineker, and push forward immigrants as scapegoats the same way the Nazis blamed Jews.
