The prosecutor has a strategy - using one against the other until all of the information causes them all to be ensnared.
I think the prosecutor's office wants to see if they get a conviction against Charlie off this evidence first. If so, they will probably charge her next.

Being a lawyer herself, with the divorce and custody battle going on, she knew she would be #1 suspect after Dan’s murder, that’s why her name was never mentioned in the entire plotting because they knew she would be looked at the most. But considering how freakishly close this family is, I’m not convinced that they would go ahead to kill her ex husband without her being ok with it.

I'm kind of surprised they hired Rushbaum for the defense. According to his website profile, assuming I'm looking at the correct law firm, he's not really a criminal attorney.
You’ve probably got the wrong person. This is Daniel Rashbaum (not Rushbaum) who is a longtime criminal defence lawyer and has also been a Federal prosecutor - 23 years of courtroom experience altogether.
