Most of these comics are, there's some tropes they can't just leave behind, like Joker scaping, inconsistent power levels, shitty heroes without superpowers being better at everything than actual SUPERheroes. I think people have to turn off the critical thinking part of the brain to enjoy the characters.

A judge could have given a rush order on the death penalty based on how horrific his crimes are. My point is Batman doesn't need to be a killer just because a reader thinks it is just. The hardest thing is not having Batman kill him, but you have to consider what a superhero killing means. People will say killing Joker is different, yes to a reader. However, if you write it that means Batman lives with it. You have to understand killing is not something that Batman doesn't and can't truly do. At least if a writer understands why.
