Can you claim constructive dismissal for Mental Health?

    I was dismissed by a company without connecting the misconduct with their code of conduct, meaning that they fired me without telling why I was charged with the charges I was charged with. Let alone being ever trained by the company on the code of conduct.
    I decided not to appeal because the company was convinced that I was no longer wanted for doing something very minor or something that did not warrant for a dismissal especially without a previous warning.
    Worse CCMA commissioner said she does not want any evidence she only want to see if I was wrong or right and she will decide if I'm the dismissal was fair or unfair.
    That means the code of conduct was not looked into again and the only evidence used in the CCMA was the evident from the company.
    I wonder if employees are ever protected. 😢
