      @@chrisstewart5992 I think the defendant is a scammer as well, but the plaintiff screwed up the paperwork to the point that Simpson couldn't proceed. Instead of dismissing the case and forcing the landlord to start over, she has a chance to amend the complaint and get a judgment next week.

    Simpson chided the lady, declaring "you people are using big legal words and have no idea what they mean" when she announced she was acting pro se. A moment earlier Simpson was told the lady's father was a licensed, practicing attorney in Ohio. I'm pretty sure "pro se" means the same in Ohio as it does in Michigan.

    I’m dead I don’t ever think I heard Judge Simpson laugh so hard when she said objection! At least her dad’s a lawyer so she’s familiar with the terms and how to use it I presume 😂😂😂

They know that, made a calculated decision and now it is very possibly going to cost her as the property would appear to have been secure until one in her party entered through a window.

      @@Heather_A1 People typically aren't penalized because someone they are with commits a crime unless there is evidence of collusion or participation.
      The plaintiff is a witness at this point, nothing more.

    “Quiet use and enjoyment” is something some landlords forget. Yes, you own the property BUT if you’re accepting, and cashing, the rent checks, the tenant quasi-owns the property and is allowed a peaceful use therof. That landlord broke the law, it’s a criminal case now. 😂😂😂😂😂

      Not to mention she potentially opened the door to civil liability for the money and items the defendant claims were stolen. She said they never went in there, then she personally never went into the property, etc, THEN finally admitted someone went in on her behalf. That whole 20 questions bit to get to the truth doesn't exactly make her look credible, and Simpson is obviously unimpressed.

      I think that the whole case is in danger of being thrown out or reset, because just as they can't accept rent when they give a notice to quit, neither party can violate the terms of the lease (even a default one if none was signed). So violating the lease could mean the notice to quit is invalid or quashed, or there's damages to be had.

      yup i rented a private house from someone i thought was a friend and someone i had done alot of work on the property when she lived in it and still made sure in the memo section of my check i wrote rent for xx month. when they illegally entered removing a bunch of appliances including the fridge and leaving my food to spoil when we went to court she tried claiming because it was one house she was not a landlord and therefor was exempt from landlord tenant laws judge looked at her and told her you accepted and cashed checks that clearly said rent therefor you are a landlord and are subject to the rules and laws and found in my favor wasn't much but better than nothing

      ​@@AnonymaxUKThere is no lease and no rent owed. The 'tenant' was the live-in girlfriend of the now deceased owner. The plaintiff is the representative of the estate, not a landlord.

      @@PCFLSZ I was using an example of rent as one reason why an eviction proceeding would be invalidated. A lease isn't required to benefit from tenant rights.

      yeah long term "hotel or motel rentals" are one of the biggest scams out there it is legal but still a scam your paying at least $2400 a month for a room!

      @@gregwessels7205 His client is fine unless there is evidence that she directed the sister to break-in and/or steal from the defendant. Simpson is already punishing them by delaying the eviction hearing for a week.

      @@PCFLSZNegative..she said her sister entered her home..her sister is not whom the contract was with it was her.. So her sister had no right to enter that home, that is indeed breaking and entering. Not to mention in Tenant and Landlord Laws the Landord has to give at least a 24 hour notice that they will be entering the home. So even if it was the Landlord that entered she’s still in violation because she didn’t provide a 24 hour notice to enter.

      @@SH3SS0CALIGIRL619 You are correct, the plaintiff claimed her sister entered the property alone. Since the plaintiff is the Landlord, she did not violate the Landlord/Tenant Act.
      The sister is not the landlord so the Landlord/Tenant Act wouldn't apply to her. She could be criminally charged with B&E and possibly theft if there is any evidence it.
      My point was the eviction should proceed unless evidence is provided that implicates the plaintiff.

      You’re not meant to stay there for a month. It’s a cheap price for a daily rental for a motel but if you stayed there a month you’d have the money to be renting your own apartment. Unless you didn’t have the credit to do so.

      @@seantimmons5900As one who has worked for and managed one of these properties, I definitely agree with you ,some people do not have the the credit or have other problems that prohibit them from having an apt. This may not be the best option but you do become a resident after 30 days.

    On a side note, when they're in the courtroom, the audio is awful. The mics aren't on and they aren't even close to them, if they were! It's awful.

    The last case, the attorney seems incompetent. He doesn't know what he needs to prepare for a final settlement conference? Might want to switch area of practice.

      ​@ToadsMCFROGGY No idea what you're talking about here. When you have a case, only two people csn file paperwork. Yourself if you are pro se, or your lawyer if you are represented. That he is a lawyer in another state is as useful in Michigan as being, say, an electrician in Michigan. He doesn't know Michigan's laws. He could go ahead and get charged with improper practice of law.

    The first case. she did not share the evidence with the other side of when a tenant has to live in a hotel or motel. bad move. And she does not understand what she needs to do for the judge. And that is the fool for a client when you represent yourself in court.

      This is not a typical apartment rental. What we are dealing with here is what is known as a long-term stay hotel. These hotels are designed for stays of 2 weeks to 6 months. The average daily rate tends to vary from $54 to $109 per day. Sometimes, in cases of a stay over 3 months, the property may negotiate a lower rate as a favor. However, after 30 consecutive days, they may not charge any taxes or fees. It defaults to a flat daily rate.

      @@RJB1013 I know there is places in Norway where I live who stay at a hotel in weeks/month’s but that’s it’s because of work. The company get a very nice deal because they stay so long. My husband stayed at a hotel where he worked one time. They had rooms at the hotel where there was a sofa and some snacks and stuff. But I have never ever heard about that people use hotel in Norway like a house. I have seen it many times one You Tube but everytime they trew them out of the room. And they have always only underwear on and scream and hit the police. But it looks like many hotel is very cheap. Have almost nothing at all. Please excuse me grammer and spelling. I am Norwegian. Born and raised and live in Norway. Have a wonderfull day where you live😀

    lawyer (and i suspect the client on advice from the lawyer) were being so disingenuous during the proceedings. It was only after the judge Simpson pressed further and after the landlord, admitted that her sister had entered the home that the lawyer acknowledged having spoken to his client on that day and advised her to leave the premises

    All jurisdictions should require the rent to be placed in escrow in full in order for a tenant to pursue a case. These cases taking months a years with someone squatting is ridiculous

      @@jbsack Escrow for all unpaid rent must be deposited to the court registry before the court will hear any defenses in Florida. Non-payment evictions take about two weeks.

    That last case I could not hear the plaintiff at all and I really want too bc that company is trying to screw her over. I’m not finished yet but he knows they are trying to eff her over he’s trying to talk a bunch of mumbo jumbo. I just want to know what he’s saying.

    HOW or WHY DOES ANYBODY PAY $86.44 a DAY to live in a MOTEL!!?? That is ALMOST $2600 A MONTH!!! 😮😮😮😮 REALLY!!! WHY DOESN'T THIS WOMAN FIND A NICE APARTMENT FOR AROUND $1400 A MONTH, AND NOT HAVE TO GET BEHIND ALMOST $10,000 IN JUST 4 MONTHS!!!

    I cannot believe the number of people who talk over judges, today was insane!
    - That Lisa chick rubbed me the wrong way from the start, I'm pretty sure there is a lease that magically disappeared. You kick someone out and then complain that they aren't mowing the lawn? I hope her tenants are able to get a good lawyer.
    - The one with the judgement, someone screwed up the numbers and left that poor lawyer to try and fix it for them with the judge...
    - That Ashleigh lady, resident and legal owner are two VERY different things, the only way the police would have told her she could enter the home is if she LIED to them and said it was her residence. She just admitted that she committed a felony live on Zoom Court and you can tell that her lawyer knows she's screwed herself.... She might be able to get the Melanie evicted but she's also going to be facing some fines and maybe jail or at least probation. What an idiot!

      This isn't Brown's first time being evicted. He never sent an email or text to Reppert referring to the missing lease? If you noticed, he only said that he had moved out of the house. But his son was dropped off there the other day. It doesn't sound like the wife and kids have moved.
      None of his arguments addressed the issues with his tenancy. He never said he was going to pay or that he was taking care of the property. Instead he claims a missing lease, the plaintiff has trouble with the bank that somehow affects him, he has been constructively evicted, her attorney father is acting as an attorney without a license, he needs time to find an attorney, and his disabled family is being traumatized.
      He lucked out with the plaintiff screwing up the paperwork because with the exception of the lease which he has provided no evidence of, he has made no argument to stop the eviction.
      For the final case, the plaintiff may have thought the home was vacant when they entered. There was no testimony that anyone went through a window. This case isn't a normal eviction, the plaintiff isn't a landlord and the tenant never had a rental agreement. Unless there is evidence that the plaintiff is involved with the theft, it's unlikely any charges will be pursued. After Simpson scolds the plaintiff, he should go ahead and issue judgment for possession as the tenant isn't arguing that she is not supposed to be out.

    Just saw the results of another case where the cops told a person to simply break in to a home. Both times, the person told them that they were the legal resident. Both times, cops took their word for it and mistakenly asserted they had the right to enter the property. At least in the first case, the cops were disciplined for their errors.

If she claimed residency and asked the cop if she could break in, he gave the correct answer. In a situation like that, if there is no one in the property, the cops shouldn't assist her with breaking in but could ask her to provide proof of residency once she does enter the home if they doubt she is being truthful.
      Did the other video state what the cops should have done instead?

      Woman who claimed residency had moved out two weeks prior, but left some items in the exe's place.
      The cop told her that she had a right to break down the door.
      The woman kicked the door in and the cops rushed in after her.
      They confronted the ex at the top of the stairs and during the struggle, almost fell through a window.
      Despite the ex shouting that he had a pacemaker (with a visible scar) he was tased, cuffed, and arrested for battery on an LEO.
      His charges were later dropped.
      Out of the four cops involved, only one had footage of the incident on bodycam. The other three were misplaced/lost.
      All four cops were reprimanded. The one who encouraged the woman to kick down the door was suspended.

      @@conscientiousobserver8772 That sounds like an incident covered by the civil lawyer a couple months ago. Was it in Ohio and was the man in the shower when the police rushed in? If so, were you able to see an uncut version? The CL's version was a heavily cut video that left out most of the interaction between the cops and the woman including the fact that she called the police to request an escort inside because she had been locked out by her ex (essentially a self help eviction) who owned the home. She only wanted her property which she described to the cops when meeting with them. When the man didn't answer the door when the cops knocked, they told her they couldn't force entry without a warrant, but as a legal resident who had not been evicted, she could.
      If I recall, the officers were suspended because of allegations of excessive force against the man, not because they allowed the woman to break-in. The woman wasn't charged with any crimes as she was able to prove she had been improperly locked out. I tried to find out if she had sued for an illegal eviction without success. Anyway, if this doesn't sound like the same case, could you let me know where I can find what you saw? I find these particular scenarios very interesting.

    I had to stop watching landlord/ tenant cases. After watching a lot of them ive learned that people working 40-50hrs a week to barely get by and paying taxes so that others can live virtually rent free are getting screwed over. And the other half who are living with all expenses paid for by the govt just seem to think theyre entitled to it.
