      Battered spouse syndrome. That’s why she’s with him. It doesn’t have anything to do with her intelligence or values; BSS presents very similar to Stockholm Syndrome.
      She needs a very good trauma therapist and compassion.

      I don't know either, although I've been in abusive relationships, way too long. Why? Can't answer that. Looking back, I just had to have been a different person at those times. I'm very hesitant to pass judgment against someone who has so obviously made a bad choice in a relationship. It does not make any sense, it really doesn't. Why? is irrelevant. There is no why.

      @@ServiteJack Like the judge said, they were far enough removed from that situation to have crossed 2 different streets and then get on video, and all the video shows is them talking, then him punching her.
      Doesn't matter what happened prior to that, as of THAT MOMENT he was in no danger he needed to defend himself from or anything like that. AT BEST you could say he was, what, getting revenge for something that happened quite some time prior? Who gives a shit? No excuse.

      Sadly, this is part of the uncomfortable situation of being a defense attorney for somebody with no case. You still have an obligation to do whatever you can to make as strong a defense for your client, no matter how utterly fucked they are, which means sometimes throwing hail mary's you 99.99999% know won't work.... cause what else have you got? 😄

      This was a prelimary hearing or probable cause hearing (not a trial) so there's typically no evidence from the Defense in these.

      What "pass" did he get? The Judge bound him over for trial, increased his bond to a *huge* amount, and made sure that his past courtroom behavior would be paid for. That's literally the worst outcomes that could have happened to him at the conclusion of this hearing. Where's the "pass?"

    Clear communication is something that is super important to me. I cannot imagine how hard it is to stumble through life, let alone as a freaking DEFENSE ATTORNEY, unable to formulate and deliver a coherent thought out loud. I have immense respect for defense attorneys, especially public defenders, and I hope that this particular attorney avails herself of some communication classes. It was palpable how frustrated the entire room was, including herself, with her stumbling bumbling nonsense. Imagining her going through law school is a trip... I guess not everyone graduates at the top of the class.🤷‍♀️

      Could not agree more. She was in a no-win situation but could have clearly enunciated any mitigating factors instead of waffling off irrelevant talking points which only served to antagonize the judge.

      She's a terrible attorney and did absolutely nothing to prepare for this hearing. She actually had a couple of legitimate reasons to object to the videos being admitted into evidence, and if she had just done even an hour's worth of research and preparation, she would've been able to clearly articulate them and on what grounds. But she didn't. Obviously.
      There's someone on here who wrote a book trying to explain that that attorney is actually brilliant. 😳👀🙄

      tbf this is why you should get your own lawyer. There are a few really good ones but a lot of public attorneys are only really good at working a plea deal

    Sad that some women don’t have enough self esteem that they let men abuse them. If he does this in public, what does he do behind closed doors. She’s lucky to still be “here”. 😢😢

      That is NOT how it works. It's actually incredibly rude to say that. I'm a court advocate for women seeking restraining orders. I know what I am talking about. They don't "let" men abuse them. Abusers are brilliantly manipulative. By the time you realize you need to escape, it's often too late to do so safely since they've isolated you from everyone and have convinced you that if you leave, you and everyone you've ever cared about will die. Don't be nasty. I'm not saying you MEANT to be nasty, I'm saying that you were anyway. These women don't go into these relationships with low self esteem. They become conditioned to live out of fear.

      Realistically, she was doing the best she could possibly do with an open and shut case. Do you think that if you got appointed to represent him, you could do a better job? He's obviously wildly guilty, so of course the public defender resorted to semantics.

      @@small_golem Sort of a silly question since I’m not an attorney. Nor do I need to be to point out that she isn’t very eloquent. My comment had more to do with her manner of speech. She wasn’t able to put her thoughts into words. The pauses after every two or three words didn’t help. It was uncomfortably choppy. There is a reason the witnesses needed to ask for clarification on her questions. Her communication skills need improvement.

      I actually think that the defense attorney did a good job considering what she had to work with. After all the crime that she's trying to defend her client from being convicted of was captured on camera. It's an open/shut case for the prosecution.

      Nobody really knew what the hell she was talking about most of the time. Judge Simpson kept trying to put into words what she was trying to say, but it really was absolutely impossible. The witness was utterly confused by her questioning. I also know that I, for one, didn't know what the hell she was talking about most of the time. When I did, I was like, why would you say something so stupid 😂😂

    These women fear being alone and what they really want is for the partner to simply stop being abusive. They are hoping that being arrested and court will "wake up" their partners, that their partners will "learn their lesson, learn that what they did was wrong." They are also hoping that their partners will see that they are being generous and throwing themselves under the bus of the courts to protect the abuser. What these partners fail to realize, because they are looking at their partners through rose-colored glasses, their partners will nearly always see the arrest as a betrayal and will likely - never - forgive them.

    I sort of feel bad for the defense attorney. She knows she has to object to the video and the bond over but it's funny to hear her argue why. It's equivalent to "because it's bad for my scumbag client and I have nothing else I can say"

      I think it’s because of Mr. Allen, the bailiff. I don’t mean to objectify, just stating a fact. I know I’d lose my ability to think and/or string a coherent sentence together lol!
      However, I have to defend Ms. Gaines she is a brilliant lawyer, I’ve seen her win cases that seem impossible to win. However, when you have a client who is caught on camera committing the crime in question, it is very hard to put on a vigorous defense. Try to come up with some questions you would ask these witnesses or arguments you would make if you had this to work with. It sucks, but every defense attorney has been there were your brain essentially short circuits because you have nothing to work with but every defendant is entitled to vigorous defenses sometimes you are just stammering and buying time, hoping a winning argument will just fall into your lap. You can see why she fought to keep the videos out… but she has to make a record objecting to their admission. Otherwise he can claim ineffective assistance of counsel, which could result in this all coming back on appeal. The ‘ums’ come across as her being extremely uncomfortable, particularly when speaking about the victim’s statement. She seems to be very uncomfortable, that’s when you hear the increase in the number of ums, and you can also hear the manor in which she is speaking regarding bond modification is not with a lot of conviction. Plus, she is making sure to state where each statement is coming from. I don’t think she wants anything to do with the bond modification argument.

      Judge Disanto is the worst in my opinion when it comes to the constant "um" ... maybe im more annoyed or noticing it more with her during editing and trying to take out as many ums as i can.. i just finished a video and it was pretty much every other word "um... do you ... um... plead... um... guilty or... um... not guilty" i remember my english teacher grilling us about not saying "um" or "ah" and now i grill my kids about not saying um or ah and like CrystleShadows mentioned... that damn "like" word! Oh yea, and "BRO" .. my kids dont really say it but their friends do and it drives me insane!

      There's way more to this than just a DV victim being coerced into protecting her abuser. She knew the defendant for years prior to becoming romantic.
      IMO, it sounds like the defendant was on bond for felony drug charges meaning he's likely a dealer. I'd be willing to bet she's trying to protect him merely because he's the local supplier to her and their social group. For her to sit there in court and repeat the "I fell, your honor - It was MY fault, your honor" after watching video clearly depicting her being shoved, grabbed, and hit multiple times is pathetic.

      It's called Victim's Algebra. She is trying to weigh up what will cause her loved ones and herself the least abuse in the long term Making the judge angry isn't going to hurt her children. Making statements against the abuser in court...that WILL hurt her children and her.
      He is not going to be in custody for the rest of his life. He's not even going to be in custody for a year. He is already pre-disposed to attacking her. Every day he's in jail, he's blaming HER. Not the bar, not the bouncers, certainly not himself. What's more, she knows that HE knows that her most vulnerable spot is her children. She is thinking ahead to when he gets out and what she has to do NOW to try to appease him from terrorizing her children.
      Abusers always get out of jail or prison. From the second the abuser is arrested, the victim is even more terrified. They torture and kill your pets, they terrorize your entire family, and your work place, they abuse your children. They make your landlord and your employer ask you to leave because they cannot handle the problems the abuser causes.
      What she is trying to do...appease him, in advance, it won't work. But it is the only thing she can think of to do.
      The law isn't going to protect her. Not in the long run. A guy like this, he'll go after her forever.
      I left my husband shortly after we had a child. Because I needed to protect my child from him. He's was starting to do the same things to her as he did to me. I moved across an ocean, to the other side of the world.
      That was 20 years ago. He is STILL stalking both of us. STILL.
      He even remarried and had another child. But he STILL is after us.
      However, Judge Simpson is a very smart man. I am SURE he understands what this woman is doing, and that is part of the reason he spends to much time speaking as though he is addressing her, but he really isn't. And what he does is to reiterate her lies to help the abuser and then say, "but I can see from the video that you are lying ".
      So he is making sure the abuser hears him saying to the victim, "you tried your best to lie for this arse ache, but I'm guided by the video, not what you say, "
      He is a great judge.

    If he will do that to the mother, what the hell does he do to the kids? And the victom not only wants his phone privilages restored, but the case dropped too? I spent my early childhood being raised by my paraents, my father was a true monster. A Vilent mind twisting creature who blamed everyone else for his actions. I wish someone like Judge Simpson had been involoved, perhaps my mother would still be alive. My grandparents raised me and my two siblings after that point, but even more then 30 years later it still haunts me. I'm glade the Judge knows right from wrong, I hope the defendant rots in jail.

    It's sad this woman is so use to being abused either from this guy or from her past that she doesn't even see the abuse anymore. He's gotten her to believe this is her fault and he's not an abuser. This is classic victim blaming. Guaranteed he's said all of these things to her: "Babe, I love you. If you would have left me alone this wouldn't have ever happened" or "look what you did to me. I wouldn't be in trouble had you have not push me to this point" etc etc

      Yeah, she sucked. The questions she had for the witnesses were not articulated well nor were they printed off. She brought her laptop up to the podium. The difference between her performance and the prosecutors were night and day. She looks like she's quite a bit older than the other lawyer. Maybe she started law school late or she is just an unprepared lawyer who underperfoms and charges accordingly.

      Those guards were trying so hard to keep him away from her and she basically ignored them. They formed a barrier around her to keep him away and did everything they could to stop this from happening. I give them a lot of credit

    I've been looking for this, I have only seen the victims statement during the motion to reduce bond, and someone else included the CCTV video , it gets frustrating only catching parts of these sometimes... Thanks for sharing. I'm definitely subscribing!!

    How would she have an accurate recall of what happened that night, she was so drunk that she pissed herself, you can see the huge wet spot on her right buttocks. Some people are just so afraid of being alone that they will endure the most degrading and abusive treatment from another person, it really is sad. Let those of us who are in healthy and loving relationships be grateful.

      I have a “hunch” that after this testimony the State Attorneys office may call her to the stand during his actual trial for this part and tear her to shreds for the lies. Maybe she will still see contempt. Her giving a statement was pure stupidity on the public defender and the prosecutor was smiling.

I feel bad for domestic violence victims, men and women, but this would be the time she can get away. She's choosing instead to defend him and try to get him out. I hope she gets the help she needs.

    Every person assigned to be defended by this ‘defense attorney’ should take note of how absurd she is, how ineffective she is, and beg the courts to appoint different counsel. I would be HORRIFIED if this attorney were assigned to represent me. May as well beg the State for ANY offer and agree to it no matter what.

    Also…did this poor woman wet herself!? I feel such secondhand embarrassment for her. Not only bc she peed her pants, but mostly because she can’t even see how awful her guy is or that she is of more worth and/or value than she’s being treated with.     Judge was angry at the defense attorney because she knew what was on the video very clearly showing what this coward did, and yet she calls the victim to testify to what is a lie. Knowing that the defense attorney should have never called the victim up to lie to the court, and that is why he was livid about what this defense attorney tried to pull.

    The defense attorney got her law degree from Tony's School of Lawyers. I couldn't follow anything she said. She just belabored the point with nonsense. How Judge Simpson figured his way around her nonsensical objections and backwards explanations is a mystery to me. Good on 'em. I'd love to hear her explanation as to how to hard boil an egg. 😂😂
