Unfortunately, the USCIS officer has the last say. My experience has been you have to approach it from the hardship angle. Even that is not a guarantee that the waiver will be approved. Even if it is approved, the timeline is dreadfully long. I often think how nice it would have been to be able to hire an attorney, go to court and have a judge decide. That wasn’t an option
How would you have a judge decide?
This all seems capricious and arbitrary. So if officer is in a bad mood one day are all his clients going to be denied that day?
Hi Jim keep up the good work , I am a LPR ( green card holder ) I was place in removals processing as an convicted aggravated felon I was granted a 212 C waiver by a immigration judge on January 2022 , my Question to you is will I be able to travel out the USA to Belize for vacation an return back to the USA from Belize without any problems from customs .

Jim, would you please give some examples related to Misrepresentation
its a fancy word for lying
Examples: Working with Tourist Visa. Marrying a US citizen with Tourist visa.
My husband submitted a fake divorce decree. His green card was denied. We reapplied, the officer asked him if he ever submitted a fraudulent document and he said no. His green card was denied again for lying to the USCIS officer.
Hi jim i have got misrepresentation waiver on my i485 application. my i130 has been approved. so my question is we dont have kids . is that going to be a problem to get my waiver approved. or having kids is helpful for extreme hardship ?

In us consulate, officer had requested for waiver on my behalf for c1d visa, last week, still I didn't receive any email from consulate, also I am not able to track my waiver status, if you have any link, please kindly share with me.

My Sister went for a Study for interview and they accused her for misrepresentation. And they stated in the letter that " No Waiver is available for the ground of ineligiblility"
