    My wife and daughter were stuck in Administrative Proccess for 6 months.
    I wrote to the embassy many times and also contact the office of my congresswoman and senator with no possitive results..
    We call Mr. Hacking's office and sue the embassy. 15 days after the lawsuit was served the embassy called us and they got the Visas..
    5 days ago after 6 months stuck in this process we got our Visas thanks to you.
    I am so happy that I made that call. The paralegal Josefina was great!!
    You are the best!!! we will be forever thankfull with the great job that you have done.. thank you so much

    Hi Jim! My husband and I are coming! Just getting our deposit together! P.s. you guys Jim is absolutely right about contacting Congress or Senators and Ombudsman. I tried these routes- and absolutely Nothing happened! So the only thing left now is the Mandamus lawsuit. My husband and I are both almost 54 years old and my husband has been in delay for almost a year now and now we are convinced that the Mandamus Lawsuit is a 'legal laxative ' to get the Embassy to MOVE!

    Jim. You're right. For a decade, I used to submit a threatened or proposed Mandamus Complaint after a Congressional Inquiry and it worked fine. At some point, I just got ignored. Mandamus works well.

      There have been rumors that USCIS has retaliated against those who seek redress by Mandamus. I know of several times where this definitely happened.

    I 751 case 1 )18 months extension 2) I 551 stamp valid for 6 months then interview and another 12 months stamp . Still no decision and just called the agency to get another stamp . The one I got is valid by November 15 . It’s almost 4 years now and no decision yet . Fantastic !

  • @pbr5887

    Hello Jim, I have been watching several of your videos lately... i definitely appreciate the no-nonsense candid information ... Thank you for spending time explaining all the processes .. .
    My situation should be simpler : I got my EB2 based GC back in 2001, renewal in 2011 was straightforward and I was expecting something similar for my renewal in 2021 ... I filed my i-90 renewal in july 2021 shortly after the 6 months window opened before my GC expired ... fairly quickly I received my receipt notice (mentioning the 12 months extension ), I also received a notice indicating the biometric appointment was waived .... but since then (summer 2021) its been crickets (no requests from USCIS of any kind , no communications , nothing ) ...
    In late september of this year i saw the USCIS announcement about issuing i-90 receipt notice valid for 24 months instead of 12 (like i had) where they also said that they would issue amended receipts for those like me with pending i-90 renewals "before the initial receipt would expire" ... but so far I have not received anything in the mail (and nothing appeared on my USCIS portal account either ) ...
    Have you seen any of those amended "24 months" i-90 receipts ? are they truly issuing them ? do they have a schedule to issue those (like 2 weeks before the 12month expiration ? ... )
    My 12months extended GC expires mid november 2022 ... at which point i will not have a document showing my status ... I am looking for options given potential business travel before the end of the year ...
    What are the chances that a new receipt extending my GC through november 2023 will show up on time ?
    Given that this expiration is now less than a month away should i start the process of calling / asking for appointment for a I-551 stamp ?
    Is expediting an amended "24 months" i-90 receipt something that can be requested online (chat) or on the phone ?
    Looking forward to hear what you think of this situation ...

      This may (or may not help): My wife and I applied for our GC renewal as soon as it came up - February 2021, and had our biometrics appointment at the end of April 2021. My new GC came within 2-3 days of that, but my wife is still waiting for hers (as of Oct.2023). As soon as she was able to (based upon her receipt date) she put in an online request for an update and her case was 'updated' to include a 24-month extension - for which she received a paper copy about 10 days later. I would note that we travel out of the US several times a year, and although initially, when she was still within that initial 12-month extension period, she was put in a 'sin-bin' at US immigration until they had run checks, the last few times, even with that 12-month extension expired, the immigration officer didn't bat an eyelid (probably realising the whole system is SNAFU). Just keep checking you case for updates... .
      Anyway, odd that my new GC took 2-3 days (from biometrics), hers is 20 months and counting.

      @@christopherkidd9982 thanks for sharing your experience ... hopefully i can find a way to get my case "updated" like in your wifes case without waiting for the "online request" window to open (in my case march 2023) as i definitely need to travel between now and then...

    • @christopherkidd9982
      @christopherkidd9982 ปีที่แล้ว +1

      Hi - just an update. Oddly, within a couple of days of posting my initial reply here, my wife got an 'action' email, and received her new GC in the mail a couple of days later. Mere co-incidence?

      thought i would add a good news update .. the day after the 12month original receipt extension expired i noticed a new "document" was added to my uscis account ... and that document is the amended receipt showing the new 24 months extension ...
      I have not received the paper copy in the mail yet ... but at least it looks like the amended receipts are a real thing ...

    What about suing for monetary damages as a result of the delay?? If nothing else fee waivers due to their delay. If a government agency has to start paying damages in civil lawsuits, that may be a strategy to combat their intentional delay tactics.

    Hi. I have a question, can you please reply through here ?;
    My brother is getting married cause he's a naturalized citizen. And he wants to get his girlfriend his green card. The problem is ... he's living in Indiana while she lives in NY . They were boyfriend and girlfriend back in the 2000s. He just wants to do it for her ,cause she wants to help her. Anyway he can send the petition after getting married even though he lives and work in another state ? I mean ..he changed his address to her apt in NY . But he just wants to stay in Indiana and do what he wants to do for her while living in Indiana and she in NY . You think it won't work ? And why not ,? Or how can he make it work while still living in Indiana while she's staying at her place in NY ? He said he can make it to the immigration appointment and take care of things if he has to. Help please. ! Reply when you can my friend please
