    Hello so if i overstay my H2B visa due to had a case of human trafficing but my sister apply for my green card, can i avoid waiver and or face have to go back to home country?thanks

      If you were inspected when entering the US… usually you don’t need to leave the country to adjust your status. Please confirm my answer.

    Thank you for the video. What happens if one of your parents who you added as part of your explaining of extreme hardship passes away within the waiting time for approval?

      Hello!
      We should do a video on this! In our experience, if a qualifying relative dies during the pendency of the waiver, the waiver can still be approved - death is considered the ultimate proof of extreme hardship. However, if that person is also your petitioner for the I-130, the case may require requesting reinstatement of the I-130 or conversion of the I-130 to an I-360 widow’s petition in order to continue. In cases of death, we definitely recommend consulting with a trusted immigration attorney to determine the best strategy for continuing with your case.

    This is my thing, we got an I-601A approved and my wife went to the interview process in Juarez, which she passed but they wanted us to get a I-601 waiver approved which is different from the first one. But to get this second one approved we have to prove extreme hardship again. Why? We already got that approved and is how we got to the interview process. So our lawyer completed and sent another form and they sent back a request to explain the hardship. This is unreasonable. We already explained it the first time, just go look at the file. She has been in mexico waiting for 2 years now. So now I am writing another affidavit explaining the exact things that was said in the first one that was approved. I guess our lawyer didn't think we needed another affidavit but now they are asking for one. This is inhumane.

      Ugh, I’m so sorry to hear you’re going through this. We completely agree with you that it is unreasonable to have to re-prove the same thing again and also wait again for them to adjudicate the case after so many years of already waiting. It is inhumane, but this is the immigration system we have until our leaders make a change - which they will not do until forced by voters.       @jlw.immigrationlaw nothing to do now but wait again. We sent in the affidavits in the mail. We aren't sure if we have to wait another 2 years for them to look at the affidavits. I hope not. It does appear we will miss another holiday season yet again. Hopefully it's the last.

    I'm a US citizen from Chicago and i'm currently waiting for the i-130 application for my wife to get approved and I was wondering if you can help me file for the I-601A waiver, I'm currently working with a non profit organization that helped me file the i-130 but the lawyer that is helping me told me that he can't help me with the I-601 waiver. any help will be greatly appreciated

      Published processing times for the I-601 Applications can be found here: egov.uscis.gov/processing-times/. They are currently showing as 27 months (for all countries).

      Hello, Susy,
      A U.S. citizen child is not technically a “qualifying relative” for purposes of the I-601A. However, if hardship to the child will also cause hardship to another person who is a qualifying relative, then that child’s hardship can be used to strengthen the waiver.
