But my guess is that it would probably never even come to that! They’d find a way to make the problem “disappear” before they’d ever have to deal with it in a court of law.       It is the Californication legal system. CA judges are SO corrupt, it is unbelievable. The 9th District court is the worst. Honestly, I'd put a bullet in the bitches head. Get injured and call police to arrest her for abuse. There is another to get her out. She isn't paying rent, file eviction papers. There are a multitude of ways to get someone out of your house. Frankly, get injured, blame the fat ass, let her get arrested, and then get a restraining order on her. Problem solved.

      Or have a domestic quarters built so that they dont sleep IN your house. Like we have such a room with a bathroom on the outside of the house. We dont use it but most stand-alone houses have it here in south africa. That way, at least she will not have rights nor the access to enter the main house

      Squatters at least shouldn't have any rights regarding properties that are not fully and completely abandoned. Squatters rights only make sense in such a context. They make zero sense whatsoever when a home is occupied. I lost my home-the one i lived in-to squatters in Arizona in 2013. it was a nightmare.

      Landlords have been known to kill tenants or die in struggles with tenants, some of whom aren't even behind on rent. For example, a lot of landlords like to increase turnover so they can increase rents faster, or they might want your apartment to house their kid during college(the latter happened to me despite being ahead on rent).

      The court considered her a tenant so she would be allowed access to the common areas of the house. To restrict her access, the owners would need a court order.

    My sister in law was in this situation, she found out the squatting nanny was allergic to cats n dogs. They got 2 of each...nanny was out by the end of the month!!! On her own. Joyce kept the dogs n cats❤❤❤❤❤

      I’m a professional nanny and that is exploitation. Very illegal. Families in California try to do this often. I advise nannies and families to conduct their search via staffing agency. The process is seamless, thorough and fair. You must be compensated in accordance to the law. Most agencies will require that you have a clear line of expectations, have a CONTRACT, as well as BENEFITS. OVERTIME is non negotiable. That’s exactly why they went through this.
      Additionally, how will she afford a place to go if she was not given a compensation? I’m certain we do not know the entire story. This piece is awful. She was most likely mistreated, on several roles because she doesn’t know her worth and allowed people to exploit her.
      I made $28 an hour as a live-in nanny. 50 hours a week.

      I agree Chanice. I am a Nanny and found my employment through {Care.com}. Although I am not a live-in Nanny, I feel like if you’re going to go “cheap”, you’re going to get CHEAP... if you know what I mean. On Craig’s List, it could be anybody. I’m not saying {Care.com} is perfect (I don’t work for them, they were simply a tool for me to find a good family!) but they do as much as they can to ensure safety between both parties, which includes a background check and motor vehicles records check of the Nanny for the family. That wasn’t mentioned in the interview and Craig’s List doesn’t facilitate that. So, here’s what I meant about “cheap”: when people advertise (for example) 3 children; ages 4, 2, and 6 months, let’s say, and for 40 hours/week they want to pay a Nanny a flat fee of $200/week (😑). What type of person would answer a listing like this one? NOT ME. My background: I’m in my mid-40’s, I was an RN, in the medical field for 11 years, raised 2 AMAZING children who are both in college, and I’m just kickin’ it with my husband of 22 years ☺️ I digress 😂 But seriously, that’s basically what that family was paying the Nanny! Nanny AND clean house for room and board. She got the short end of the stick, for sure, but she agreed to this and that’s what I mean about cheap. I’m SURE she doesn’t have a professional or medical background or else she would have gone for a job with more money. Currently, I make $600/week for 1 darling little girl. I’ve been with her since she was 2 months old. And my only priority is her; I don’t clean or have to do anything else.
      Sorry so long! My point was meant to be that you can’t expect to get GREAT when all you want to pay is FAIR. I definitely know what that’s like... I was there once upon a time but somehow it all worked out. Regardless, that “Nanny” still has no right to do what she did. I’m curious to know what the outcome was!

      The couple were breaking the law trying to offer room and board only for a job so they're fucked because they broke the law in California on that. They needed to be paying her minimum wage. But now they have to give her 30 days notice as proper eviction procedure. They're also apparently breaking the law deniing her access to a fridge.This lawyer from California was on here pointing out all the laws they broke.

    This actually happened to me! Not the exact same situation but similar.
    I live in Sweden so the laws are different, but here we have _a lot_ of protection for tenants that they can’t just be thrown out on the street. Generally a good thing that I agree with, but the laws didn’t take into account the difference between a private person sharing their home and an actual landlord.
    I got a two bedroom apartment with a friend five years ago. It was great, but after a year she moved out to live with her boyfriend, which is what happens so I was completely understating. I could not afford the apartment alone, so I was faced with either moving myself too or getting a roommate. I loved living there so I placed an ad for a roommate. I met a few people and this one girl I really liked and thought it would be great. It was a nightmare. One of the worst experiences of my life.
    She was so outgoing and fun and we got along great at first. We would sit up and drink wine and talk and I liked her. After a few months I noticed she would eat a lot of my food and like use my shampoo and conditioner and stuff. I didn’t say anything about it because I’ve learned that living with other people means being very able to overlook the small stuff and just, you know, take the good with the bad.
    After about five months I had friends visiting from out of town and I had bought some wine for the occasion. She wasn’t going to be home, she was away at some other place. When I was going to get a bottle of wine in the evening I noticed one was missing. She’d taken it with her when she left earlier in the day. It had to be, because we were the only two people living in the apartment. I asked her the next day and she just lied to my face. A few weeks later when I was doing my make up my mascara was missing from my make up bag. I asked her about it and she lied again. When she went in the shower I went into her room and looked through her purse and found my mascara.
    After that I told her to move out, but the law requires three months notice and there is no budging on that whatsoever. I had to live with her in my apartment for three more months. A few days after I told her to move, she stole the car key to my grandmothers car from my key chain. I found it in her room luckily. I had to move everything I cared about into my own bedroom and install a camera in my bedroom and lock my bedroom door when I went to work. Except for work I didn’t go anywhere else for three months because I was so scared every time I had to leave. She kept eating my food the whole time, she knew I couldn’t do anything about it. It was HORRIBLE.
    Honestly. When I was thirteen years old I was the victim of rape, but this was WORSE. That’s how bad it was. I lost 12kg in three months. I couldn’t eat. I couldn’t sleep. I was so scared the entire time and felt so helpless.
    Your home is your castle. That’s our domain. Not being able to kick someone out of your house is horrible. I really feel for these people.

California Civil Code 789.3 makes it illegal for the landlord to shut off the electricity to force a tenant out of the property. You may sue your landlord in civil court for actual damages, attorneys fees and other damages if he does so. The statute allows an amount up to $100 per day for each day the electricity was turned off .

    This nanny is a schemer, but I saw this couple on another show back when this case was in the news and they were pretty much schemers as well. The position they hired the nanny for was unpaid. You may say, well yeah but she got free room and board in exchange for watching the kids. However, when you hire a live in nanny, a free room usually comes with the job, but they usually get a salary too. This couple was trying to get childcare, which can be quite expensive, for free. Also, at some point they wanted the woman to steam clean their carpets. So they were trying to get a free maid as well. This story makes the couple look sympathetic, but they were basically trying to take advantage advantage of people who were down on their luck and didn't have a lot of options and they wound up meeting their match. I dont sympathize with the nanny, she a crazy, lawsuit happy con artist. I just think the nanny and the couple deserved one another.

      Therefore, room and board in exchange for being a living nanny is not feasible. People will take it for a month and then move on. In this case, the house owners were played by a better con artist than they were

      To be fair, the law originally was worded to protect tenants of rentals from being thrown out by angry landlords getting revenge against their tenants in cases but due to its poor wording, squatters are manipulating it's original intent to benefit themselves and take the properties they don't lawfully own.

Now as far as breaching the actual none documented contract, she would have broken it and should have been kicked out but with no physical proof she cannot be removed esp since there technically was some proof of her own residency there so that raises the Squatters abuse of the Adverse Possession that I'll re-iterate was originally used to protect tenants from the landlord retaliating should the tenant and the landlord be involved in some kind of legal matter and are in court against on another.

      Its equivalent to evicting someone that stops paying rent. She isn't actually allowed to stay there it just takes the courts a long time to agree with the family and makes her leave. Its kinda like criminals on bond, you dont actually stay in jail until that is what the Court decides even though you were guilty the whole time.

      That was my exact thought. She wasn't a renting tenant, the room and board were part of her payment for the work she did. When she stopped doing that work, I assume they stopped paying her. I don't know why the courts are treating her like a tenant...her room and board was payment for work she no longer does, so why can't they evict her on the grounds that she no longer earns that R&B??

      She has to be legally EVICTED. That is the LAW. They cannot just throw her out on the street. This is a very slow process, and it could take several months. It has to be done legally, or she could sue them, and end up owning the house.

    I had the same thing happened with the roommate. Look like a sweet little man come to find out he had spent three years in County Jail waiting trial for murder and he's on the streets. I finally got him out when I informed the police officer they that came they had somebody in the Sheriff's Office he told me that he had killed someone. It's kind of like whenever you have a child molester in the neighborhood they should be notified of that kind of thing. You need to do a background check and find out who her family is. Maybe they would know something about her behavior.

    The couple was in fact, exploiting the nanny. Not only did she have tenant rights, she had employee rights. She was entitled to at least minimum wage, social security, workers comp, and unemployment. They cannot charge the nanny rent if she is required to be living there at the family’s convenience.
    This couple got what they deserved for being freeloaders, not wanting to pay their help. The nanny should’ve also sued for back-pay and penalty for late payment.

    I ended up with a roommate who cooked fish every single night, but claimed the smell of popcorn made her sick and forced me to stop making it. She put all my houseplants out on the balcony in the middle of winter one day to kill them because she didn't like them, and demanded I move all my books into storage because "you've already read them." Then she replaced them with her own. Her boyfriend moved in with her, and each of them then paid one-quarter of the rent while I paid half.
    I told her I was considering moving out, so she gave notice for both of us without telling me. I only found out I was homeless after she moved out and told me I had to be gone in a few days. She was an artist and she had painted murals on all the walls, which I had agreed to so long as she agreed to paint them over before she left. Of course, she didn't. So instead of trying to find a place to live, I spent what little time I had left struggling to carry her furniture to the trash and repainting the whole apartment. I ended up homeless, lost almost everything I owned, and ended up moving to a new city to start over. She ruined my life.
    Never have roommates. Ever. It's better to live in a collapsing, cockroach-infested hovel and have it all to yourself than to share a mansion with someone else.

    I remember watching a Dr. Phil episode about this case. The nanny was clearly a well-versed scammer, but I also didn't feel too sorry for the couple. Who hires a live-in nanny for no pay? They tried to exploit someone who was down on their luck and ended up getting exploited themselves. Serves them right, if you ask me.

It’s supposed to protect people from getting evicted for no reason so squatters get mail sent there and take advantage of it and claim the home as their residence, so they have to be fully evicted through court which takes time and money. Anyone else you ask to leave your home who doesn’t live there would be trespassing tho yes 😁

      Facts. This is the case in most states, if not all. It is very simple to establish residency in someone's home quickly. Once they do, you will have to go through a legal eviction process to get rid of them.
