  • Is India ready for a Uniform Civil Code? The founding fathers of India wanted it, yet for 75 years the concept has remained a dead letter. Why have we failed to implement it? How will it change personal laws? Does it undermine religious freedom? Palki Sharma decodes.

Although I am not Indian nor from India, a Uniform Codified Law offers equal rights and protections for everyone, at least theoretically. I am American and live in America. Though not perfect, the American Constitution is an amazing document and a guiding light. It makes America, in my opinion, the best place to live. Just think, all else equall, India can take advantage of American legal history, learn from it and fine tune a Uniform Code of Law. Likely not 100% perfect, but at least a great starting point. I love India and wish the best! Forever live India.🇺🇸🇮🇳🇺🇸🇮🇳🇺🇸🇮🇳👍

The US is not an appropriate example to emulate here. Each of the 50 states has its own laws in the civil and criminal realms. The federal law exists only to guarantee minimum constitutional protections of the US. This leads to some strange situations where where the same crime can attract different punishment in different states depending on where it was committed. Similar discrepancies exist in the civil statutes. So, you need a lawyer licensed in a specific state to practice in that state. I am not saying this to criticize the US (I live here) but am acutely aware of its artifacts and limitations, as good as it may be. Undoubtedly, the founding fathers did a fantastic job at a time where monarchies outnumbered democracies. In India, there is a single uniform penal code (criminal) for all states, but not a single civil code. The current civil code is mostly based on religion rather than on the state. The uniform civil code aims to change all of that and replace it with a single civil code (laws) for all states and religions. Thus the US model is not applicable to India; the US is a federation of states where the federal government’s powers were specifically limited by the founding fathers. India, OTOH, has a strong central (federal) bias as envisioned by India’s founding fathers. Dr. Ambedkar, the father of India’s constitution, specifically traveled extensively to the US and European democracies to gather the best practices from each system (Presidential, parliamentary and direct democracies) before drafting the Indian constitution. His biography is a fascinating read, if you are interested. It explains why he and his colleagues chose the type of system that they did.

When younger, I had always thought that India is a secular country with equality, that the words in the Preamble are actually consistent with the constitution. But when I came to know about some issues, a major one of which is the history of personal laws in India and the topic of UCC, I was shocked. While reforms were rightly made for some communities, some communities were left behind due to backlash. The words of the preamble seemed like irony of the highest order. The idea of secularism went into not angering some communities. Parties claiming to be secular and liberal opposed UCC, and called it communal. The hypocrisy of it! Women didn't (still don't) even have basic rights, and these parties did nothing for their true upliftment and tried all means to block and abuse people trying to do so.
And amidst this some strong willed people stuck to their belief in UCC, amidst all allegations and abuses. The truth is now dawning upon us gradually. I mean it's really shocking to realise this, how the word 'secularism' has been misused.
Now when attempts would be made to actually be secular, allegations of being communal would be hurled by many.
This is the case with some other provisions in the constitution too.
I am sure there are many people who are ignorant of these things. And when a standing issue based on religion is addressed, attempts are made to make reforms, resolve the issue, it's said to be communal and an attack on religious freedom.
Many people claiming to be liberal and secular, won't even be knowing that these issues exist, that highly regressive practices are authorised by law in India for some people, in the name of secularism and liberalism.

I can't understand why muslims need different laws everywhere, why this specific community can't make compromise in a multicultural society but it always makes non muslims to cede in favour of Islamists. India, if it remains to be thriving hindu civilization must protect itself from these discriminatory laws. It's past time for us to pass UCC. We refer to ourselves as a secular nation, and every politician preaches that we should all be treated equally. If they honestly think it, then all rights and laws should be equal for everyone, regardless of gender. Religious personal law, in my opinion, is nothing more than an Indian women's course. The majority of women in our society are considered objects rather than human beings. To stay in power, most of our politicians will go to any length. The case of Sha Banu is a wonderful illustration. It is past time for our country's women to be empowered. India should not just pass the UCC, but also legislation that empowers women, such as allowing women to have equal rights whether it is education jobs and equal salaries as well as empowering women financially. Huh! This is so interesting. Though as an outsider it seems to me that the term "personal laws" is probably* misleading, I think they are probably better refered to as " communal laws" or "religious laws."

      Not that much.
They are called personal laws as they govern mostly personal or private aspects of human life.
Civil laws involve generally deal with public, society, government or civil life.
The problem in some.overlapping aspects- from "certain communities", there is always a demand for continuous expansion of personal laws into greater aspects of civil life - eg. Religious communities, since the source is the same.
Counter-wise if religious communities are brought under civil law, then there is a drama about "religious freedom in danger" , "personal rights being encroached on ", and international nexuses get active, US publishes a report of international religious freedom, saying india is dangerous and situation is getting worse etc.. haha

Uniform Civil Code is much needed step for today's India. We need ideal secularism not over-rated pluralism. Religion should always be separated from marriage, divorce, inheritance or custody. And to the large extent, the personal laws especially Sharia is extremely discriminatory towards women. All types of discriminations has to be ended if we want to make a peaceful scientific society.
