- The plaintiffs, a mother and daughter, sent the daughter’s laptop to the defendant’s repair shop. The plaintiffs say the computer wasn’t ready after six months and claim that the defendant threw the laptop away. They’re suing for the cost of a laptop, irreplaceable photos, and travel expenses. The defendant argues the computer system was corrupted and he tried telling them that, but the plaintiffs never came back for their computer. He’s countersuing for unpaid labor and services.
Case 29-328
this episode was straight coming for me because I was literally just talking to someone about how I am TERRIBLE at backing things up and would be destroyed if my laptop ever died unexpectedly
Girl back it up. I lost all my sons baby videos and photos on my old laptop. I still get sad about that. He’s 15 now.
And I'm so confused because the momma sounds like a dude and the man sounds like a woman... LOL
@@annabanana730 😂
Did anyone ever think that maybe they weren’t suing to be greedy but because when you take your things to a shop they should treat it as if it was their own. If all they’re going to be charged is $50 they really don’t need to worry about being careless.
It was a broken computer that was worth 250 when it was new to them
@@thecheshirecat299
It’s not just about the computer for one. Not everyone know how to back stuff up on a hard drive. The point is that if they know that they might have to actually pay more than it’s worth they will be more inclined to treat someone else’s property with more care. If you look at the Kelly blue book my car is not worth much to someone else but for me it is because it’s in good shape and drives well and I would not be able to buy a car that’s in that good of shape with what it’s supposed value is. Maybe you can understand it that way. Another way is if you had a ring that was your Deceased grandmother’s it’s monetary value might not be much to other people but if you care for that grammar it could mean the world to you. If you took it in to get it cleaned or fixed and they lost it how would you feel.
@@debbieherrera1605 I wouldn’t feel entitled to more then the cost of a brand new one.
@@thecheshirecat299
Well I guess it would depend on what the photos where that were on it.
Still it’s not hard to back up photos especially ones she’s had taken from her phone they are automatically saved onto the cloud in her phone,I know not everyone is tech savvy however she is 23 in school we were taught especially know a days to save things on hard drives in case something happens. I’m speaking as a 20 year old art student who backs up everything on an external hard drive from photos that need editing to portfolio work. I learned very quickly at age 12 when my first computer died to save things externally and not to just rely on one source. I understand you want things to be treated as your own but technology is unpredictable and there is always human error nothing and no one is perfect. It’s all about reading reviews and you get what you pay for in these types of cases.

How the hell do you allow anyone anywhere the privilege of giving you the run around on anything concerning business for six entire months? AIN'T NO DAMN WAY! 💯
That hard drive could be anything, including a malicious virus.
Let's hope!
They should have gone to Judge Judy she would have awarded them for the photos.
This judge acts like the money is coming out of her wallet and penny pinches everything.
They got the hard drive back, which should have the pictures on it.
I agree
Why didn't the defendant, (who admitted he couldn't fix the computer) just give the hard drive back right in the beginning? Did he even make a note to document that there were pictures on there the plaintiff wanted? Something about his story doesn't add up. Wish she was awarded more for her time and trouble.
I agree something seems off with his story
I agree
Of course you do
I think sometimes these shows don’t want to pay. I read online that when someone wins the show actually pay. They also pay flight, hotel and give them a little bit of money for coming.
Me too! Something ain't right 🤨
I was 21 when my mom died and had no idea about backing up on an external drive and using the cloud really, so when someone robbed me of my laptop, I lost every pic from my moms cameras. It sucks but people really don't know sometimes *shrug*
but yeah she is asking for a lot tho lol smh
😥
Thank you I completely agree it’s like she always assumed that because you’re young you know all these things about technology but guess what her generation created technology when it came to laptops and computers and cell phones, obviously we wouldn’t know this stuff these things were just handed to us
I’m so sorry. 😕
While I understand the judges motto of “compensation is to make you whole again”, I do think it’s a circumstantial thing. In this case, the computer guy gave mom the run around for 4-5 months only to trash her daughters laptop ? That made no sense. She should’ve gotten a greater judgement in my opinion.
The problem is, it is only property, and old ar that. There is no compensation in the law for the photos, so in a court, the judge has 2 go by the law. The same with the frustration, he wasted her time and gave her the run around, but there is no law in place monetarily for that...
@@giondennis6808 yeah, I’ve actually seen on other court shows where some litigants win larger amounts based on the circumstances. For example, I’ve certainly seen judge Mathis give ppl the max of their claims or somewhere in between.
Actually that's not a motto, that's law
@@azure9729 yeah I agree. I definitely think $2500 was a stretch . However, he did mislead them for months then decided to trash their laptop for an unknown reason without requesting they pick up the product. I do think she should’ve gotten more then $50 though .
@@geminijohnson4019 google that law and copy n paste it for me when you find it hun. I want to “actually “ see where it states litigants aren’t entitled to anymore compensation other then the EXACT value of an item and nothing more. @me when you find it
This ruling annoyed my soul.
Why?
Right felt she should got like 2-300. Cause the laptop could have been fixed but he did whatever so she out of a laptop
I agree with you.
This was a poor ruling.
@@daziaray1233 But she only gave 250$ for it when it was brand new, and then it got broken (which is why they wanted to fix it). An old used broken computer would never add up to the same or more than a new one. She (the judge) might want to reward them personally, but she has to follow the law and give them what it is worth (they did get the harddrive back also).
Why?? She only paid 200 for it when she bought it
Mom & daughter looks identical to each other the daughter is gorgeous 😍😍😍😍& very well-spoken & mannered good job mom 🙏🏿 I think the defendant should have just given them everything back if he came to the realization that his shop wouldn’t be able to fix the plaintiff’s daughter’s computer instead of giving them the run around for 6 months I think that was a bit extreme & unfair but, overall I think the ruling was fair
Yeah but $2500? Greedy azzz
I think it was tossed in the recycle bin, weather by accident or deliberately . But I guess when they crash the only thing they need is the hard drive , so why didn’t the shop just return it.
I work at a computer repair shop. First, we tell the customer if something is worth us working on. Second, we tell the customer there is a diagnostic fee. In a case like this we wouldn’t charge them most likely and it certainly wouldn’t take weeks. We take of things like this within a week. The judge is right, if something is valuable, back it up. Sometimes customers don’t like it when we tell them we wouldn’t recommend putting money into a old computer. We explain to them they will be better off in the long run and that’s our main objective. Sure, we want to make money, but having a customer who knows we aren’t ripping them off is much more valuable. Btw, we do sell computers also, but there isn’t much profit in new sales.
I agree and I run my computer shop the same way.
My laptop did that June 3, I paid over $900 for it two years ago. Went to best buy paid the $100 to fix it.... And took an "L" for all things lost. They told me it could happen, but I needed my laptop more than I needed to catch an attitude about pictures

2:50 So then why is he trying to sue them for unpaid labor if the laptop was unrepairable?
(Not done with episode yet)
That was my first thought!
Because just like a plumber or many other tradies, you have to pay for time and effort even if they can’t repair it. My local computer repair place always, ALWAYS says “It’s $85 if we take it, and that’s ours whether we can fix it or not. Once we diagnose the problem, we’ll call and give you what the total will be, and you can decide whether or not it’s worth it. The $85 is for our time and effort diagnosing the issue.”
8:00 once again Judge we all follow society's norm. I don't have a cloud backup and external drive breaks just as easily as your computer. She needs to stop that and realize we all do things differently!
JM sounded as if she was punishing the daughter for not saving her pictures on an external hard drive or cloud. What?

I *literally* rewatched that episode of SATC this weekend and it was all I could think about during this case, lmbo!! "YOU DON'T BACK UP???"😂
Yup. I got burned about 10 years ago and I DID have a backup. Whatever corrupted the drive copied out and corrupted my backup. Now I keep four different backups. Two are Time Machines (hourly, daily, weekly) swapped out every month or so, second is cloning each of my drives to separate backup drives once a month, third is a cloud service (nightly). I've got about 5TB of data. NEVER again.

Agreed. He lied sold the laptop for parts
She wanted to recover the files on the laptop, the laptop was trash, the harddrive they removed to try and datamine, unsuccessfully. It's common for them to take it out like that, and with the time he had it apart, it's understandable why he misplaced/ trashed the laptop
He DID give them back the hard drive. The Judge even said so during the ruling.
JJ- "You have the hard drive & that's the most important part."
He just recycled the shell.
He put everything on a hard drive b4 he recycled it.
$50 for a 1 year old laptop that he threw away? The battery is worth that. This judge's ego does not allow her to ask an expert for advice. She asked the defendant for the value.
Plaintiff's are going to find out real soon after this episode how priceless those photo's are. Harddrive recovery like this is going to need starts in the hundreds and goes well into the thousands depending on how tricky the recovery will be and how much dismantling that drive needs. In some cases a donor drive(s) will need to be sourced and parts and individual chips swapped over.
Would be funny if they did and the drive they were handed by the defendant was just some random drive he had lying around his shop.

@@pmabrouk oh thanks sooooo much for your helping me understand that explains so much about why the plaintiff jacked up her lawsuit more than 50 × what it was worth and added expenses that were never the damages caused by the defendant in the first place like the loss of photos which was why he was hired and why he was not paid up front because there was never any guarantee of retrieval.....makes so much sense now having you to explain things to me 😂😂😂😂😂😂😂

Fun fact, if your computer breaks, you just need the hard-drive. You can take it out, super easy, plug it into a 10.00 case, and plug it up to your next pc. All your precious data is right there. It's not that common that the hard-drive breaks. It happens, but odds are good that you can salvage the data.
Not if the laptop was dropped while it was turned on. IT will damage the drive and the data for the most part might not be easy to recover.

I've been in the business for over 15 years and a diagnostic would not take 10 hours of Hands-On work! Maybe more like, maybe, 1 hour. I wonder if she would have sued if he just gave the hard drive sooner. Glad they have it now however not sure if this was worth coming to court for.
At least they have the option of taking the drive to a data recovery specialist.
More sophisticated equipment - like a $10 hard drive enclosure. Plug it into your computer's USB - get your photos.
I wonder if the mother knows she is going to pay a fortune to recover photos of the food her daughter eats and thousands of selfies in front of the mirror... ha ha ha
That woman never called the shop but decided to visit twice? Why? Who drives to an area they no longer live or work in to check on a laptop that might not he finished.
If it's a standard hard drive then it can be plugged into any functioning system and the pictures recovered. My camcorder that my wife bought me 10 years ago got some corrosion it it and would not turn on. It had many videos that were priceless to me stored on the internal memory which is on the hard drive. I bought a used camera the exact same model off eBay for just a few bucks, switched in the hard drive with the broke camera and voila, all my pictures are now safely loaded onto a storage drive.
I so disagree with this decision ... remember to stay safe and stay blessed
