You have to first check if the state/province/country you live in allows one-party consent recordings or not. If the law says it only allows two-party consent then your recordings will not be valid in any lawsuit. This guy was fortunate enough to be in a state where the law allows only one side of the recording to consent (given that one party is himself or if he received consent from someone who was a part of that recording) which is what helped him through this case. There was unfortunately another case where the plaintiff recorded wrongdoings of the defendant but the judge would not accept it as evidence because in the state where the plaintiff was the law was a two-party consent. Meaning that both the plaintiff and the defendant (that’s being recorded) would need to agree and consent to being recorded and no one would agree to being recorded if they know that the recording will make them look bad and get them caught. So please check your laws before going to court with recorded evidence because it will not be taken into evidence should your law say that it’s a two-party consent for vídeo and voice recording.

this just happened 2 me. i bought a used car w/ a 60 day warranty. the slick oil can refused to honor the warranty after he had 2 reimburse me 950 for a new fuel pump an filter. i had 2 pay for 2 more repairs out of my poccet. buying a car whether new or used is always a hassle.🥴🥴🥴
They should have put him through to the service manager and arranged for the car to be looked at straight away, it was leaking oil from the differential, something that should have been noticed before it was even put up for sale.

Ok, I was not sure about this plaintiff when he walked in, but ya know, looks can be deceiving, and in this case, that is true! Plaintiff did a great job and taping that hang up was EVERYTHING! Very, very smart move. As for the defendant, like some other people here have mentioned, yeah, a typical used car salesman. And I'm sure he would have liked to FIRE his boss who made his job twice as difficult by that HANG UP! Love how Judge Milian would NOT let that little incident go...like she kept saying it over and over. I just love her!

The Defendant doesn't seem to understand that they violated the terms of the contract, so of course they would have to pay for the repairs under warranty. He talks about the language of the contract, but that doesn't really matter when they renigged on their own warranty. I wouldn't buy a bottle of water from that place, much less a vehicle.
He said they were going to REPLACE the hitch. Which means there was one already in place that was perhaps rusted or otherwise damaged. Installing wiring would be an upgrade if the car did already already have it.
I think the plaintiff was probably very rude on the phone and some businesses once you mention the bbb or your consumer rights or anything legal, they will automatically stop dealing with you. No need for all that drama let them hang themselves. He should have at least asked for an appointment instead of insisting it had to be fixed that same day. A little accommodation on both sides would have avoided litigation.

Several years ago I bought a car and I negotiated a 30 day warranty from the place that I bought it. We actually discovered a problem that same day and brought it right back, but it just turned out that it was a part that they had replaced already and it got stuck or something. They said to drive it and bring it back again if it remained a problem and it actually didn't. Then we noticed a problem with the vents. Once we were certain that it really was a problem, we brought it back. The place honored the warranty and fixed the thing for free. It's a great body shop, I still go there to this day even though that car got wrecked in an accident 2 years ago (not my fault: I got rear-ended as the front car of a three-car accident). They do good work on my new car too.
I'm mid 40's and I hate to admit that I have been the subject of a jerk like this defendant with a "strong" type of salesmen. That type seems to get me most of the time so let me just say the plaintiff in this case did an amazing job! Well done, Sir!!
