    Quite a few high courts are really of no use these days because of some judges uncontrollable inclination towards certain political parties!

    Meaningful discussion . In case of appointment of judges of the Supreme Court and the High Courts, there must be full time Independent Committee free from incumbent executives ,incumbent justices and political parties.
    In the matter of post retirement assignment of judges there must be cooling off period of atleast 5 yrs.

    Since judges get benefits from govt even after retirement , they may not be allowed any post under govt . After 5 years of cooling period they go for any post under govt but after surrendering all benefits being taken by them.
    I m not judicial person but from audit background.

    Lot of debates like this should be conducted throughout the country regarding established independent National judicial academy appointment should be transparent merit on basis from lower court to apex court 2) new courts establishment on population ratio 3) discover easy way to common man go to higher courts or facilitate technology to the rural area people filing cases in higher courts 4) court experience must be considered in appointing judicial posts even for small courts also 5) in all court premises lawyers chambers must be established

    Great to listen such enlightening conversation and thanks to all advocates for conducting such show the problems in the democracy at any aspect is not always due to the systemic problems but also due to the lack of ethical values and knowledge and The end of democracy is not possible unless its citizens are satisfied with living in an undemocratic environment, hence citizens should demand free and fair institutions from their elected government as the first priority to save democracy.

    These eminent advocates should also talk about the huge number of pending cases and everlasting resolution.
    Because of this delay in judicial process we have totally lost the confidence in judiciary as it gives preference to the cases of elites and rich people.

    In 54 years of Congress rule, I wonder what Congress party might have done to Judiciary when even media was not free in those times (mainstream is not free even now), if this much harm BJP can do in just 10 years of continous rule.

    I believe the collegium, bar councils, and civil society should have discussions and set a high bar of both morality and submission to the Constitution along with yearly transparent service review based on the judgments decided, withheld or kept pending/reserved for weeks and months.

    Apart from the criteria of eligibility, as a concern citizen, i think the best way forward are: to ban judges from any post retirement office including rajya sabha seat, independent judicial committee to review the performance of judges of SC as well as HC before appointed him as a judge, and remove the law minister from the collegium system..

    Meenakshi nailed the fundamental issue. We have become a value-degraded society - a self-centric society, and so everything is up for grabs in the name of being 'successful'.     A new law is required to keep the principles of neutrality, impartiality and dignity of judiciary for function ing healthy democracy in our country. Actually it is worrisome, that our judiciary going to lost its dignity. So, God save the Supreme Court had to written by Justice F. S. Nariman.

    Very good to listen to some hope for the better future for our country.
    No one should be appointed for at least for five years after retirement.
    The retirement age should be increased for Supreme Court at least on the lines of USA/ or upto 70 years.
    Retirement at 60/ 65 yrs. is making many Govt. Employees for seeking alternative jobs. Nowadays people can work for 70 yrs. due to better health.
    In the training at the time of recruitment the moral values and ideals specially the aspect of Dharma should be stressed. I had seen it vibrant in the villages at the time of Independence.
    'Sathyameva Jayathe', was inscribed in our National Emblem. The educational system and the elders should think and develop "Healthy Public Opinion", which Gandhiji effectively used.
    The public awareness in this bonds case should be an eye opener and it should be continued for the betterment of public life and the image of our great country with great cultural heritage.
    I hope and wish people like you will continue the public debate developed at this time.

    Nothing shall happen. We cannot change the direction that the entire profession of law has taken. Our British Rulers politically united us and brought a system of law with which they were familiar. Without delving into their motives, we must acknowledge that they were successful in implementing what they thought good for maintaining the law and order. It would be obvious that they did not take up the task tinkering with the law based on custom . They did try to make uniform civil code. But they maintained the system of law and order to highest degree they could. They did not interfere with normal courts except in the cases when they were threatened with ouster. They appointed persons of moral integrity lest people may not go against them. The constitution of India is based upon the laws made by the British. We could not maintain the same respect for law by persons administering it because we are divided by religion,caste,community, race etc. Gradually we have reduced our constitution as a source power rather than an outline for governance of the vast country of so many divisions . Power rules us all and we do not care for poor and downtrodden because of their birth in poor family. Judges too are power hungry and they want to maintain it as ong as possible.

    Court should sup moto order not to appoint any judges after retirement for minimum 5 years and any such appointment should be with the approval of a committee to be appointed by apex court .There will be nothing else if people loose faith in judiciary

    Unbelievable understanding was and is delays in Proceedings are being allowed based on Senior Advocates having to attend Personal Wedding functions, birthday parties or not in the mood to attend hearing etc. Its so sad.     This scintillating interview with four of the finest of lawyers in the nation’s top court - is really welcome and timely.
    However the problem goes long back- as far back as Justice MC Chagla’s tenure - when he lamented about the state of the judiciary and foresaw its imminent decline. This was during the heyday of socialism when the salaries of judges- then- was sought to be capped at Rs 4000/- per month.
    Justice MC Chagla had graduated from Oxford and his background and rectitude and integrity weighed heavily on the Bar even though he was a tad elitist- but then the elitism that manifested itself then- saw to it that men of sterling reputations were appointed to the Bar and the Bench.
    Today, the bar is so low that one finds that some of the drafting could be described as trash and in telegraphic English. I had the misfortune of appointing Mr Mihir Desai for some private matter - and was disappointed with the kind of output that he and his junior staff produced. The drafting was pathetic and he never had the time to listen to his clients who were paying through their noses to have him as counsel. He was always chasing the limelight and on one occasion, when my wife and I decided to visit him in one of his offices in Dadar, a Mumbai suburb, he was in consultation with a lady who was fighting the current regime in cases relating to the Godhra episode in 2002. He was more attentive to her tribulations and experiences than he was to his clients whom he neglected and never bothered to speak up for them. One was sure that he was fighting pro bono for this lady but he was doing so on the strength of the monies his clients were paying him.
    I think Ms. Meenakshi Arora was spot on when she decried the loss of character and moral values in the current generation. The fact that character building has gone for a toss, shows the deep rot within and which could plague not just the judiciary but every other arm of civil society-in the long run.
    One thing that needs to be focused on is the extent and willingness to maintain British traditions and values infused into the judiciary, civil services, the armed forces and other organisations- we need to keep them and cherish them because it has been proven that whichever country has cherished these values, they have been successful in warding off the intrusive tentacles of the government of the day- Kenya being one example which this gathering spoke and extolled about.
    The current regime, with its stress on the indigenisation of the armed forces, will tamper with the traditions of the judiciary as well- there’s no knowing as to what might happen next- even though a prognosis can be made. They tampered with the British traditions of Universities- especially an imposing one like Bombay University- and decided to make it sound and appear more trashy than it is.
    Palkhivala, one of Bombay High Court’s leading luminaries and one who repeatedly denied the offer of judgeship despite being offered the same no fewer than three times- exemplified this behaviour when it came to protecting the traditions that the colonisers left for us. In a lighter vein , when asked about the renaming of Bombay to Mumbai, he’d exclaimed that : “a rose by any other name will not smell as sweet in this case”. Parsis in general exemplified these trends and they’re delightful and graceful in the Bar and on the Bench.
    The subtle vernacularisation of education and the propensity of allowing lumpen elements to get into the civil services because of this facility of allowing potential aspirants to appear for the exams in Hindi and other vernacular languages, will prove my point. Gone are the days when the ICS strode like a colossus in undivided India- exceptional men- who worked and strove hard- to transition India from a former colonial vassal to an independent, democratic country that could rightfully claim its place amongst the comity of nations as a lodestar of newly formed nations emerging from the shadow of colonialism. Zareer Masani’s “Macaulay” must be read and ingested by every Indian and the late Nirad C Chaudhuri’s works also need to be read for their insights into what the British left us and what could happen if we were to neglect or do away with those traditions.
    In fact , even as we write, speak or deliberate on these aspects, the nation’s values in almost all aspects of life- are going for a toss
