Excellent conversation indeed , Mr Kapil Sibal , senior Supreme Court advocate ! Kindly carry it on . The citizens of this country will get an opportunity to know how the esteemed judges of our constitutional courts , High courts and supreme courts think about the multiple problems and issues of the people and how serious and committed they are in their efforts of giving justice to them against all odds.

Veey great judges with sibbal sahab on the most important issue of differnce of opinions of judges in passing a public issue but solution is only the constitution, s mandate even vide mandate of article 375 of the constitution ,, basically if supreme court judges will deviate from mandate of preamble and mandate of article 21 ,, 14,, 19 ,,, and press into judgement their own views ,, there would be anamolies ,, it is not that a person with experience of years as judge is fit to become a judge of a superior court ,, having taken oath in the name of constitution does not change the orginal charector

Credit goes to Sibal advocate to raise issues concerning justice in courts. Why judges wants to leave it to executives or government which would scuttle down to courts to follow in their dictates. It is high time to improve judiciary and its administration so that people start believing in courts rather than netas

This is ideal discussion in ideal situation as how to administrativey make Courts workable. The Men's Rea of judges come into picture. Sam ,Dam, dand, bhed policy of Executive play its destructive role to disturb the ideal state of affairs. Human beings are amenable everywhere now a days. Reverred Harishchanderas n Vikramadityas are not available now. Now people follow the culture n saying of Yudhishtra n Krishana "Ashavthama mara gya" just to win the war n to kill the opponent. Nostalgic.

Also, taking the court to people is also important. Why a poor pliant has to go to New Delhi to fight his case often against rich corporates?
SC should have zonal benches to deal with bails and civil cases. Delhi bench should only deal constitutional matters. Similarly every HC should also have regional benches.

The judiciary is the most ineffective institution in India. 5 million cases pending for dates and judgments. There are no riots or protests to speed up court decisions. Justice is thus denied to 5 million cases. Justice delayed is justice denied. Indian democracy with 150 crores survives and progresses without a judiciary. Rich advocates like Kapil Sibel can get dates, bail, and judgments at lightning speed. Judges are granting bail liberally citing the constitution but no accountability when several incidents of accused criminals attacking and killing the victims or witnesses while on bail, have been occurring. Recently, the Honorable President of India appealed to the CJI to speed up the decades-old cases of illiterate, innocent Tribals from her home state. The judiciary does not accept technology to bring in efficiency and reduce staff. Long vacations, few working hours, Judges appointing judges as appointing authority which is an executive role, YOUR HONOR, and CONTEMPT OF COURT culture are adding to ineffectiveness. These debates with retired judges by an advocate Kapil Sibel 🤣are not intended to improve the judiciary but for publicity and bring pressure upon the sitting judges.

Please quote USA in full. There supreme court exist in each state. Hence there is basic disconnect in the structure here and USA. Quotes can be very good story. There judges are not appointed from 15 families unlike in bharat. These stories are from people who are retirees from an unjust system and now spending a life of luxury out of tax payer's money where govt is feeding 80 cr people.

I am surprised at sibbal expressing his displeasure over judges who differ in their views on a particular matter. This is how it has been going on for the last several years. And this is why the common man is unsatisfied and the lawyers like sibbal have been going around with billions in one pocket and favourable judgement in another. Remember the case of Manish kashyap in SC. Sibbal was able to convince the judges that Manish was the rogue element who must be put behind bars and yhe SC judges were more than happy to oblige him. Since this program involves retired judges but my vie is that they should not have talked to this person called sibbal who have been labelled as court- fixtures. While I have no objection to judges discussing how the courts function , they should not have talked to sibbal as he is a practicing lawyer and widely believed to be one of the most influential court-fixtures of our times. Now a days he is very sad because the judges refused to give a favour. This is a good sign which will enhance the prestige of the courts in the eyes and mind of common man and will deter the court- fixtures like sibbal in future.

It is important for a multi ethnic, multi linguistic, multi cultural country lile india where communities do not and cannot trust each other and does not see eye with each other it is important that there is established multiple supreme courts with ambit of jurisdiction over their respective subjects and not over others.
This is very importsnt for india and this does not mean it should be statewise too, for example I do not recommend same supreme court for Bengali community of west bengal and gorkha community or tribal community of west bengal. Similar and much more complex divisions exist in other places. For example i am sure much of the problems of mistrust in judgemets snd judged will get resolved if supreme courts for each caste based communities are setup in many placed of north india which cuts across state boundaries, so maybe one for brahmin community of bihar and eastern up and one for dalits (which itself is an umbrella term) of those places or maybe one for muslims for those places.
It is important to understand that once suspicion creeps in on judges and their integrity the widening fussures will be thoroughly exploited by individuals whether politicsl or not.
It is important to understand that the weakest part of india, the underbelly, is its multi demographic nature even though that makes the place appear colourful or exotic to outsiders.
