      But copyright infringement is still copyright infringement. I would guess their lawyers probably know what they are doing. GW would have probably stopped with the DMCA if he complied but he escalated it, so they sued.

      That is other companies that do this. You are in effect *encouraging* the "buying isn't owning" business practices when you level that accusation against companies that don't practice "buying isn't owning!"

      When you buy a GW mini, you own it. You can do whatever you want with it. GW will not tell you it must be used in any specific way. If you want to chop it up and make it into something entirely different - that's encouraged, not banned. If you want to scan it and make copies of it and sell it - then GW and their lawyers will (rightly) come after you.

    As much as I hate GW's scummy practices, I don't think they're in the wrong on this one. The dude literally took something that was free, wasn't his IP, did some extremely minor tweaking and then slapped it behind a paywall. That's textbook copyright infringement.

      This is in a copyright/trademark grey area but you can get away with it if you make your work distinct enough.
      What is 'distinct enough' is for the court to decide.
      From what I've seen, he's in trouble because he didn't distinguish it enough from official gw products.
      Also doesn't help that he ripped off GW owned designs.
      If he made his own from scratch that just looked similar, he'd be in the clear.
      Like I said, it's a very grey area but ppl do get away with it.

      if he had made any changes to the model other than only adding 3d modeling supports he would be covered potentially by parody laws. I'm not sure where it fits on this industry but for the purpose of the vape industry it only had to be a 5% difference. the company i was part of sold the fcKu unregulated mod but we also carried the FU mod they were identical except for the emblem they stamped on the mod and a slight texture difference on the battery cap.

      I'm surprised more people aren't calling out how scummy this guy is for taking what GW generously gave people for free and locking it behind an exorbitantly expensivepay wall!!
      I get it that GW charges more. But they have invested millions into lovingly designing this models crafting a world, crafting a game system, and all the other things that have made their product popular. They invested most of their income on both the setup and necessary upkeep (like rebalances) to keep their product enjoyed by fans.
      This scumbag is taking that and charging $65 because he clicked a button to add extra supports in his 3d software and then used his 3d printer as a cashgrab factory. Gouging people looking for a cheap alternative without any of the money going to GW.

      He didn't just upload them, he enhanced them. Think of the model STLs as materials for a final product that has to be produced by 3D printing. If I get free bricks does that mean I can get sued for making a house out of them to sell? GW offered a free resource, if they were worried about their IP they should have disclaimers (and IDK they may have them) on how that resource IP is to be used or not offer it at all.

GW has the law on their side here, though I'd say their reaction is entirely overblown and will negatively impact them further down the line.

    Ok. As much as i like to gang up on GW. Im finding it a little difficult to sympathise with ripping models straight out of the game and rigging it for 3D printing.

    I'm no legal expert, but it does seem like to me that Games Workshop is well within their legal right to file these 12 cases/claims against EmanG. Even if the models were sourced from a site that shared them for free, and even if that site ripped them from something that was essentially free to begin with, and even if one went to the extra effort to add customizations to provide the supports the models would need to survive the 3D printing process and beyond... The moment a paywall is introduced, wouldn't just that alone make one an unlicensed 3rd-party making profit off a trademarked and copyrighted intellectual property that they had no percentage of ownership in, and no legal say over how the property is handled?
    Is it morally reprehensible that an over a billion dollars net worth company is suing a private person for such a sum? Certainly; this is in essence a Big Corpo punching down on the little people... But at the same time, it does seem like a clear-cut case of infringement on intellectual property, that I'm afraid that in this case, with how established copyright, trademark and intellectual property laws are in this day and age, the law will be on GW's side. I just can't really see that going any other way.
    And I don't even want to try and say anything about any potential fair marketing/competition laws in finance that probably most likely perhaps even absolutely exist (I faintly recall that monopolies aren't well liked by trade associations and what not)

      Unfortunately, this is a consequence of GW being obsessed with controlling every last ounce of how its IP is presented to the public. They don't like things like Marneus Calgar having Imposter Syndrome, even if that's just for laughs and a valid satire of how GW handles some of its characters. So, on the clamps go and out go the lawsuits. The fans are going to have to decide for themselves how much they are willing to tolerate this behavior.

      It could be, but it depends on whether it can be proven that *the models* are what was sold, or if it was a breach of copyright for them to be uploaded in the first place. Suppose the models are freely available *and* what was solid via Patreon/etsy was a skillset or support parameters that make the files usable for printing. In that case, there is no outright copyright infringement, as the used assets are not what is being sold, but the seller's skills/time/additional files.
      It's a loose line of reasoning but one that could be legally viable given the presented wording.
      The issue here is that a individual-gone-artisan coming up with means, seemingly within the boundaries of the law, to address price gouging is being lawfared into oblivion. I don't think it's as open-and-shut as claimed here but I also am totally open to that being the case.
      Nevertheless, the exorbanent cost of the GW models being confronted by a consumer offering their own skillset to parse and render *freely available* 3D models for personal print usage, as well as printing a representation of the work using different materials and a custom setup, doesn't technically constitute copyright infringement.

      However, there are other, interesting looking IPs and tabletop wargames out there, for sure.
      I'm a warhammer fan, but I never touched the damn tabletop. It's way too expensive a hobby for me. And I don't have time to paint and assemble armies.
      But I do play the videogames from time to time.

They also gave him two chances to avoid anything bad and he chose to ignore them. It's like when you download a free app or software, there's a bunch of stuff you scroll past and click agree and then download. All that stuff says you can't copy and redistribute what you've downloaded. I can't download a free to play game like Fortnight and then put Fortnight behind a patreon pay wall, even if I change it by fixing bugs or adding content. This guy was asking for it.

      Especially because things that are Free of Use like the models GW offered and the guy used, dont come with a "Free of Distribute" sign. Those things often just allow you to use them for yourself and for free, like certain apps or programms, but rarely do they allow you to just start distributing them yourself EVEN LESS if you use them to make a profit. Imagine you give you friend a glass of jam and they start making the same jam using yours as a basis and then selling it, you would be pissed too.

    He was selliing an item that was protected by copywrite. If he wanted to post the files for free then I doubt they would have went after him. The problem is he was making money off someone else's IP. They even sent him a DMCA which he ignored. He has no one else to blame for himself. I don't like Game Workshop especially for the wokeness, but I urge people to think critical instead of emotionally and not turn into the same people who push woke agendas.

    Unfortunately, based on your description, this was clearly a copyright violation. I’m not a lawyer and have never played one in film or television but have spent a fair bit of time as a creative director making sure I never got hammered with a copyright lawsuit. If you create original content “in the spirit of” Warhammer and do not use any of their copyrighted/trademarked material, you’d have a fair chance winning a lawsuit (it would still be expensive if it happened). In this case, it appears he used files that originated from GW. While the files were “free”, I’m sure there is legal language somewhere that clearly says “for personal use”… “you can’t make money from these”. Just because a file is available on a website doesn’t mean it’s free to be profited from. I feel bad for the guy and it sucks that they picked him to file a claim. It’s pretty safe to say we all hate GW pricing. 3D printing is a really viable way to affordably pump out armies for a fraction of the cost even with the price of the printer. This is clearly a threat to GW and this is probably a reaction to that. Unfortunately, GW has trademarks and copyrights on as many things as they can think of. The Warhammer version of the Aquila symbol is trademarked. If you create and sell something using that exact mark, and you hit their radar, keep an eye on your mailbox for a cease and desist… if you’re lucky. This stuff is no joke and we all need to be really aware of the potential consequences when money starts to change hands.

    To my understanding he used stolen assets from one of their copyrighted game total war warhammer to make models added framework to help them stand and was sued for it. What is the problem here? it does not matter if you think he was offering the STL file for free because it was not you had to pay to get access to the file via patreaon so he was charging for it no matter what anyone says. CW is required to defend their copyright or risk losing it that is the simple fact here while i feel they were heavy handed i do not feel that they are wrong for doing so. I could give 2 fucks about someone's job status he was making 5k a month for a few hours of effort on stolen assets he did not create from the ground up. He would have an argument if he completely redesigned and imagined elves or whatever to fit on a 40mm base but thats not the case here he str8 up got his hands on stolen assets that does not make them un stolen that he purchased them from another marketplace. Thats like going to a pawn shop and selling them a stolen watch they are still required by law to give that watch up.

      Not exactly, at least as I understand this. Check this time stamp. 3:33 Here at least that guy states that the models he used were given away by GW quite some time ago. He took those free models, added supports to make them printable and sold those.
      I am not sure what the law in the UK or the USA say about cases like this, if the give-away of those models also meant that he could use them otherwise or even sell them. That part is giving me a headache as well, at least it seems to be a grey area and considering it's GW we are talking about, I myself would definitely give this area a whide berth.
      Thing is, though, that move from GW is still more than scummy. Other companies in much better standing with their customer base have reacted a lot more lenient in similar cases and often it ended with a slap on the wrist or even a gentlemen's agreement. GW on the other hand decided to go right for the jugular and for the kill. They must be _fully_ aware that they will literally destroy this guy in the meanest possible way.
      Sure, one can do that and maybe even has the law completely on his side, but there is a massive difference between the law and justice and this is just... disgustingly mean. What are they hoping to achieve with this? Will this keep people from doing this again in the future? Maybe. For a time. But the damage this will cause to the company on the long run? Incalculable, but most likely massive and lasting.
      I never played the tabletop and never will, but I am a massive Wh40k lore who also happens to paint miniatures and create little dioramas. The last GW product is a Baneblade and yes, this will be the last product indeed. Their insane pricing has crossed a limit for me anyway, but where I might have saved up for a particulary cool thing I would like to have, I will now spend my money on other companies' products and I something is telling me, I am not the only one by far.
      Sure, the whales who casually spend in a month as much as I make as nurse at least netto per year will definitely keep them afloat for a while, but even the whales will leave at some point, in case they won't find anyone to play with. Erosion is something that comes creeping and you might not feel it for quite some time, but once a critical point is reached, that's it, and they work with quite the determination on the erosion of their customer base.

    When printing minis, or creating your own, they can't be named Warhammer or anything related to GW.
    He shouldn't have sayed they were Warhammer models, every 3D Printer out there that sells their stuff calls it something else.
    Majorkill sells his own minis all the time, even made an Emperor of Mankind. Just none of them are Space Marines, Warhammer etc.
    When you try making money on established IPs, you take that risk.

    I am going to point this out for your first story (though most are not going to like me doing so) Emang was taking copyrighted models (doesn't matter if they are free) and claiming that HE made them where the only thing he did was adapt them for 3D printing (this does not change the model just saves everyone else time) and then sold them without Games Workshop's permission in the USA that is classic copyright infringement furthermore to maintain a copyright the holder of said copyright MUST defend it or they risk losing it. Emang was warned to stop since he was served a S and D but he chose to ignore it, he can try to fight the lawsuit but he will lose, best case they let him settle the suit for something that is reasonable...

    I'm not a lawyer but my very surface-level of understanding of copyright law would suggest that he's not going to win, he was blatantly violating copyright law, even if it doesn't doing any material damage to GW or their 'brand'. When GW makes available free STLs or the like, they still get to control how those are distributed so unless they explicitly distributed it with a license that allows redistribution, he doesn't really have a leg to stand on there. It's possible, though I'm less sure, that a similar argument would be made regarding the profiting off of those files because the free availability of the files originally doesn't automatically allow someone to profit off of their redistribution, even if they are legally allowed to redistribute them. I wish the guy well and I definitely don't support what GW has been doing lately but I don't see this working out in his favor.
    If it could be shown that the files were released with a license that would allow him to redistribute the files or prints of those files for profit and GW later decided to revoke this license, then maybe he would have a case but it doesn't seem like that's what's happening.

The idiots using actual models made by GW and licensed companies for their models were asking to get sued once they made money off it.

So that wont save you and its still illegal to sell. you can make everything you want for your own personal use, but you cannot profit off it and you cannot give it to any one else. that violates the law.
      The only things that get around this is Fair use (which is determined by a court and can be difficult to prove), or if the work is public domain.
      This particular case is interesting and could go either way, since the models used werent stolen and were given away for free. But GW might likely still win.

    It's scummy of the company, but the dude is also ripping off them selling custom pieces and charging for his patron. He also doesn't have a job to pay the bills, and was likely getting by from these earnings. Shit that it happened, but I don't really feel sorry for the guy. If they have enough to legally charge him, then he was either not careful enough with how he did his business, or just thought he could get away with it.
    I also think their tactic is to scare him and others like him to stop doing what they are doing. All the news I've seen from Games Workshop recently makes them out to be pretty scummy, but I think they have the right to protect their business and their assets.

      Also there's most likely issue that even if models were given away for free by GW there was probably some kind of license agreement where further distribution is prohibited, especially if someone requests money for it. Not to mention IP copyright infrigment by requesting money for those models. Is it scummy action by GW? Yes. Are they within law and right to do so? Even more yes.

    He did get sued for sharing free designs, he got sued for taking free designs for hobbyists, using them to create a product, and selling it for a profit. You cannot do that. It is the very core of IP law.
    If people want to engage in the hobby but do not want to pay GW too bad. They own the IP. You use it under the conditions they set or you don't use it.

The dude was literally taking copyrighted files from one source to publish a copyrighted figure. GW is never going to be able to stop 3D printing from supplanting them and are indeed going to have to adjust their business model... This poor bastard though poked the sleeping Bear one time too many. I feel sympathy for him and I hope he makes it out of the lawsuit okay..... But I can't exactly blame games workshop for fighting against the tide either. Doesn't mean I agree with what they're doing in other areas....       Guy downloaded copyrighted models put out by GW, rigged them to work for 3d printing, then put them behind a paywall. GW sues him into oblivion to protect their IP (defend it or lose it). It would be like if he downloaded a movie and started selling CDs of it to people.

    OK for the first story its important to know that "Free of use" does not mean you can just destribute it further. I also find it always a really iffy case when people use copied models they got for free or made 1:1 copies to make money with, it is copyright infringement, so if you are so willing to risk them why not publish them for free so you dont overstep too far.
    Like you can find carbon copies for Warhammer stuff and other copyrighted stuff and people act like it is not illegal to use those to make money.
    Personally I can fully understand a company for trying to stop people from stealing their stuff, however taking it so far is also a shitty thing.

    GW is doing a kodak... keeping the product as is rather than adapt. If GW just put the stl files available to buy at cheap on their site. They would allow new customers and future fans to join. And offset the people they see as stealing their profit margin. GW wouldn't have to eat their own profit for materials and transport related items.

    So the thing is, he put the files he ripped from total warhammer and edited so they're 3D-printable under paywall from his patreon, that's where he fucked up. If you could get the files without paying, if supporting on patreon was optional he'd be fine. There are loads of sites with old world models from total warhammer series up online and they have been up for a long time and they're free. GW don't seem to care unless you monetize it, so he kind of brought that on himself.

    I mean....he put it behind a patreon sub, he is charging money for it and already had a DMCA filed against him. Wtf did he expect? For them to just go "yea sure, you can make money off our IP"? This one's entirely on him. He should've removed any mention of Warhammer the first time he got hit and claimed that it was something else and distance himself from the IP as much as possible, yet he seems to have doubled down on it.

    The dude literally stole files and locked it behind a pay wall. The dude was stupid since this is actually a serious case of literally stealing their copyright. If what is stated in the video is true, he 100% stole and sold their copyrighted stuff, no wonder he got sued. This is literally copyright infringement, Like one hundred and ten present he shouldn't have thought he could make money from stealing the files from their games and their designs. this isn't like other shops that do space marine like stuff, this is a 1 to 1 copy.     one of the problems you were ignoring is that he was selling the 3D printables without approval, even if they were handed out for free you do not have a right to take that and sell it. No matter if somebody else stole it and you happen to be the one caught you don't have a right to use it.

      @@HarryMacklin-wg2bi Nothing I have seen about Endyiom has shown me that he is a National Socialist of any sort.
      He seems to be a fan that really loves Warhammer but hates GW and like some people can't see that sometimes GW is in the right when it comes to things like 3D printing. You can't just steal somebody else's property and say it's justified because you don't like them or they are a large company.
